About this file
This is a Solicitation document for the Department of Agriculture Forest Service restricting competition to current Region 5 Zone 2 FERM (Forest Emergency Response Management) BPA (Blanket Purchase Agreement) holders. The solicitation number is 12363N26Q4193 and represents a limited competition opportunity available only to qualified incumbents holding active FERM BPA positions within the specified region and zone.
The restriction to current Region 5 Zone 2 FERM BPA holders indicates this is a follow-on or renewal solicitation leveraging an existing blanket purchase agreement vehicle. Only contractors who currently maintain valid FERM BPA status for Region 5 Zone 2 are eligible to submit proposals in response to this opportunity. This approach allows the Forest Service to streamline procurement from pre-qualified vendors while maintaining the efficiency and responsiveness benefits of the BPA structure for emergency response and forest management services in the specified geographic region.

This solicitation implements two FAR class deviations to ensure compliance with Executive Orders 14148, 14173, 14168 and 14208, issued since January 20, 2025. These deviations reflect recent policy updates and remove outdated requirements, as outlined below.
The following FAR provisions and clauses are hereby removed in their entirety from the LMIR Stewardship BPA:
• 52.222-21 Prohibition of Segregated Facilities
• 52.222-22 Previous Contracts and Compliance Reports
• 52.222-23 Notice of Requirement for Affirmative Action To Ensure Equal Employment
Opportunity for Construction
• 52.222-24 Preaward On-Site Equal Opportunity Compliance Evaluation
• 52.222-25 Affirmative Action Compliance
• 52.222-26 Equal Opportunity
• 52.222-27 Affirmative Action Compliance Requirements for Construction
• 52.222-29 Notification of visa denial
• 52.223-10 Waste Reduction Program (MAY 2024)
• 52.223-19 Compliance with Environmental Management Systems (MAY 2011)
• 52.223-22 Public Disclosure of Greenhouse Gas Emissions and Reduction Goals—
Representation (DEC 2016)
• 52.222-55 Minimum Wages for Contractor Workers Under Executive Order 14026*
*This provision was removed to comply with the Executive Order titled "Additional Rescissions of Harmful Executive Orders and Actions," dated March 14, 2025.
The following FAR clauses now include deviations to align with recent Executive Orders:
• 52.204-8 Annual Representations and Certifications (JAN 2025) (DEVIATION FEB 2025)
• 52.212-3 Offeror Representations and Certifications—Commercial Products and
Commercial Services (MAY 2024) (DEVIATION FEB 2025)
• 52.212-5 Contract Terms and Conditions Required To Implement Statutes or Executive
Orders—Commercial Products and Commercial Services (JAN 2025) (DEVIATION FEB 2025)
• 52.223-1 Biobased Product Certification (MAY 2024) (DEVIATION FEB 2025)
• 52.223-2 Reporting of Biobased Products Under Service and Construction Contracts (MAY
2024) (DEVIATION FEB 2025)
• 52.223-10 Waste Reduction Program (MAY 2024) (DEVIATION FEB 2025)
• 52.223-23, Sustainable Products and Services (MAY 2024 (DEVIATION FEB 2025))
12363N26Q4193 TAHOE ASPHALT REPAIR AND MAINTENANCE Page 6 of 170
All call orders will incorporate these changes by reference at award.
Disclaimer: System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations. Examples include 52.222-25, Affirmative Action Compliance, and paragraph (d) of 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services. Contracting officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.
In advancement of Section 2 of Executive Order 14208, the removal of requirements related to Executive Order 14057 eliminates all non-statutory sustainability requirements or preferences in purchases of food service wares, including paper straws. In addition to removing requirements related to Executive Order 14057, the attachment also reflects recent updates to Code of Federal Regulation citations for the U.S. Department of Agriculture’s BioPreferred® Program, a statutory purchasing preference program.
These class deviations will remain in effect until rescinded or incorporated into the FAR.

Technical Proposal element in the evaluation. Text from previous solicitations may be edited for use here. CO will determine whether to use Best Value or LPTA after reviewing COR comments here.
TECHNICAL PROPOSAL INSTRUCTIONS
General Proposals shall be submitted in two parts: a technical proposal and a price proposal. Each part shall be separate and complete in itself so that evaluation of one may be accomplished independently of the other. The price proposal shall be submitted with the solicitation forms.
Offerors are cautioned that sufficient and detailed information must be presented in their proposals to enable the Government to evaluate their proposals fully in accordance with the evaluation and award criteria contained herein. The Government is not obligated to ask for additional information and in the absence of appropriate information, the proposal will be rated deficient.
Price Proposal A completed schedule of items with pricing information completes this requirement.
Technical Proposal Offerors shall submit technical information for their firm and any proposed major subcontractors.
Performance information may be obtained from references provided in the base BPA. Also, the offeror shall submit information that illustrates a technical understanding of the work to be performed.
1) Relevant Past Performance:
Relevant Past Performance shall be obtain from the base Blaket Purchase Agreement (BPA) and utilized for evaluation on this call order.
(2) Technical Approach:
All offerors should show a high level of understanding of the work to be performed. This can be accomplished by submitting with the proposal the following information:
(1) Description of how the work will be performed
(2) Construction Schedule (accomplishing work while meeting weather conditions)
(3) List of equipment to be used
12363N26Q4193 TAHOE ASPHALT REPAIR AND MAINTENANCE Page 18 of 170
(3) Cost or Price: A completed schedule of items with subsequent pricing information completes this requirement.
EVALUATION CRITERIA
Technical Evaluation Criteria
Technical proposals will be evaluated and rated by a Technical Evaluation Panel. Proposals shall be prepared in accordance with the proposal preparation instructions. The following factors and their associated sub-factors will be used in the technical evaluation process are listed below: Relevant Past Performance and Technical approach of work to be performed.
1) Relevant Past Performance:
a) Relevant Past Performance shall be obtained from the base Blanket Purchase Agreement (BPA) and utilized for evaluation on this call order.
2) Technical Approach:
b) Understanding of Proposed Work: Offeror demonstrates a technical understanding of the proposed work including but not limited to preliminary scheduling, equipment requirements, site conditions and location, project challenges, and material requirements.
(3) Acceptability:
We will view the acceptability of each offer on a pass or fail criteria. An offeror’s documented response to the solicitation will not be deemed acceptable, if not received by the specified closing date and time, and the submitted proposal not clearly demonstrate the offerors understanding the needed work. In such cases the offeror will be viewed as having “failed” this criterion and will not be considered for award. An acceptable offer will receive a “pass” rating and will then be evaluated solely on price.
(4) Cost or Price:
Each acceptable offer will be evaluated for reasonableness of proposal price. This criterion will include consideration of cost information provided. It is the Government's intent to assess the unit prices to determine reasonableness and offeror's understanding of the work and ability to perform the contract. The importance of price may become greater as the differences between technical proposals decrease. Where technical proposals are determined to be substantially equal, price may control award.
(b) Award. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
