SECTION 2

STATEMENT OF WORK

2.1 BACKGORUND

The US Department of State (DOS) through the Bureau of International Narcotics and Law Enforcement Affairs (INL) is an instrumental leader in the development of policies and programs to combat international narcotics and crime. INL programs support two of the Department of States' strategic goals: (1) to reduce the entry of illegal drugs into the United States; and (2) to minimize the impact of transnational crime on the United States and its citizens. One of the many ways to effectively meet the listed goals is to collaborate with allied governments both directly and indirectly to promote the modernization of and support the enforcement operations of their foreign criminal justice systems and law enforcement agencies.

The need for law and order - as well as justice and respect for human rights - is paramount in a world of growing transnational threats including terrorism, crime, porous borders, and violent internal conflict. Unfortunately, many nations around the world lack important resources for their police forces to counter these growing threats in a timely manner. This poses a major problem not only for those countries and regions, but also for the United States. Countries with weak or ineffective law enforcement can serve as transit points for narcotics and other contraband and threaten political instability. Tackling these challenges is paramount to U.S. national security. For these reasons, increasing the effective capacity of criminal justice systems around the world is among the most important U.S. national security and foreign policy goals.

DOS INL is mandated to pursue these goals by furnishing assistance to countries and international organizations for the control of narcotic drugs, controlled substances, and other anticrime purposes, including strengthening foreign police and criminal justice systems, countering the flow of illegal narcotics, and minimizing transnational crime. INL’s authorities are found in Chapter 8, Part I of the Foreign Assistance Act of 1961 (FAA), as amended. In furtherance of its counter narcotics and anticrime mandates, INL has assumed an increasing role in stabilizing post-conflict societies and strengthening democracies through the institutional development of criminal justice systems. To this end, INL has supplied K-9 canines, training and equipment to Mexico, Colombia, Afghanistan, Pakistan, Iraq and numerous other nations over the years on an as-needed basis.

2.1.1 LOCATIONS

The canines will be for both CONUS and OCONUS locations. Each Blanket Purchasing Agreement (BPA) Call will specify the location in which the dogs will be shipped to.

2.2 SCOPE

3.3.1 Evaluation Factor 1: Corporate Experience and Statement of Understanding:

The Contractor shall submit a clear and complete proposed understanding for performance of the required work (e.g. including critical review of the statement of work mission objectives). The understanding shall be comprehensive, implementable, and creative in meeting the requirements of the scope of work. The understanding must include description of its approach for achieving the Department’s objectives through discussion of the following elements:

(1) a discussion of the background, objectives, and work requirements included in the Statement of Work;

(2) a discussion which supports “how” each BPA Call shall be evaluated for full performance and acceptability of work from the contractor’s viewpoint; and

(3) a discussion of anticipated difficulties and problem areas, along with mitigation plans.

The Government shall use the following adjectival ratings to evaluate the Factor:

Evaluation Factor 1: Corporate Experience and Statement of Understanding Rating Description

Outstanding

Proposal meets all solicitation requirements, demonstrates an excellent understanding of the requirements and has features that offer some advantage to the Government. Advantages/strengths generally outweigh any disadvantages/weaknesses. Excellent probability of success with very low degree of risk of unsuccessful, if any.

Acceptable

Proposal meets basic solicitation requirements and demonstrates an adequate understanding of the requirements but does not offer significant advantages to the Government over basic RFQ requirements. Disadvantages/weaknesses are not significant, unless significant advantages are proposed that outweigh significant disadvantages. Where there were areas of concern, clarifications given by offeror, were acceptable. Reasonable probability of success with low degree of risk of unsuccessful performance.

Unacceptable Proposal does not meet requirements and contains one or more significant deficiencies. Risk of unsuccessful performance is high. Proposal is un-awardable without being rewritten.

3.3.2 Evaluation Factor 2: Past Performance:

The Contractor shall substantiate that it has recent (within the last 36 months) experience in performing the required work and demonstrate how past and present experience validates that it shall provide 15 | Page INL Canine and Items: Blanket Purchase Agreement (BPA) Solicitation NOV- 2015-revised SOW expected performance and customer satisfaction. The Contractor shall provide a minimum of two (2) and a maximum of three (3) Past Performance Contract Profiles (refer to Appendix B - Past Performance Contract Profile) that are directly relevant to the required effort and are of similar size (dollar value), scope (substantially similar services) and complexity (degree of difficulty). A minimum of one (1) of the past performance profiles shall be for services performed by the prime contractor.

The Contractor shall provide the required information using the Past Performance Contract Profile template provided in Appendix B.

The Contractor’s past performance evaluation shall also examine how the Contractor’s past and present experience/performance validates expected performance and customer satisfaction based on the information provided by the Contractor’s references and other Government sources. The past performance evaluation shall examine the Contractor’s Past Performance Contract Profiles and the Contractor’s actual experiences/performance in work of similar size, scope, and complexity of efforts and actual results achieved during performance.

The Government may consider all information available on the Contractor’s experience and past performance. This shall include information that is in addition to that which is provided by the contractor (e.g., Past Performance Retrieval System). The Government reserves the right to interview the clients identified by the Contractor and may interview other clients of whom the Government is aware.

The Government may share a copy of the Past Performance Profile with the referenced customer to validate the contractor’s report. To facilitate the evaluation of past performance, the Contractor shall ensure the accuracy of the information furnished on references (names, addresses, and phone numbers). Failure to provide accurate or complete reference information shall have a negative impact on the evaluation of the contractor’s proposal and may render it unacceptable.

The Government shall use the following adjectival ratings to evaluate the Factor:

Evaluation Factor 2: Past Performance Rating Description

Confidence

Contractor provides at least 2 Past Performance Contract Profiles that are directly relevant to the required work and clearly cover the majority of the required work and performed within the last 36 months. Additionally, based on the contractor’s past experience and customer past performance evaluations, little and/or no doubt exists that the contractor shall successfully perform the required effort.

Unknown Confidence

The Offeror has no relevant performance record. A review was unable to identify any relevant past performance information (see FAR 15.305). This is a neutral rating. It does not hinder nor help the Offeror. An offeror with less than three relevant past performance profiles may be rated as unknown confidence if the client profiles provided do not demonstrate confidence.

No Confidence The Offeror either does to have the minimum of 2 relevant Contract profiles and/or the Offeror’s past performance record provides extreme doubt that the offeror shall successfully provide a product that meets our requirement.

3.3.3 Evaluation Factor 3: Price

Since adequate competition is expected, the Government shall be conducting a price analysis to determine the reasonableness of each offeror’s proposed price.

Contractors shall fill out the Sheet 1 (E.g. Price Matrix: Pricing per category) and Sheet 2 Price Evaluation Sheet) of the pricing template (e.g. ATTACHMENT PRICE MATRIX).

• Sheet One (1) shall be the pricing schedule, not to exceed rates for the BPA. Sheet One (1) pricing schedule will be incorporated by reference into the Vendors BPA Award. At time of BPA Calls, the Vendor shall comply with FAR 8.405-4 Price Reduction.

• Sheet two (2) shall be used for evaluation purposes only.

The prices listed on Sheet 1 must correspond directly with the prices on sheet 2 and shall not be discounted from the proposed prices on sheet 1. Failure to provide adequate pricing shall result in elimination from award. All other factors, when combined are significantly more important than price.
