SECTION 1

GENERAL INFORMATION

INFORMATION TO CONTRACTORS

Contractors are reminded that information furnished under this Request for Quote (RFQ) may be subject to disclosure under the Free-dom of Information Act (FOIA). Therefore, all items that are confidential to business or that contain trade secrets or proprietary or personnel information must be clearly marked. Marking of items will not necessarily preclude disclosure when Department of State (DoS) determines disclosure is warranted by FOIA. However, if such items are not marked, all information contained within the sub-mitted documents will be deemed releasable.

QUESTIONS

All questions must be submitted in writing. DoS will accept questions via e-mail. Written questions relating to this RFQ will be ac-cepted through Thursday, September 24, 2015 by 2:00pm Eastern Standard Time (EST). STATEMENT OF WORK

FOR

AFRICAN PEACEKEEPING RAPID RESPONSE PARTNERSHIP GENERATORS

1. BACKGROUND.

1.1 The Bureau of International Narcotics and Law Enforcement Affairs (INL) is an instrumental leader in the development of policies and programs to combat international narcotics and crime. INL programs support two of the Department of States' strategic goals: (1) to reduce the entry of illegal drugs into the United States; and (2) to minimize the impact of international crime on the United States and its citizens. One of the many ways to effectively meet the listed goals is to collaborate with allied governments both directly and indirectly to promote the modernization of and support the enforcement operations of their foreign criminal justice sys-tems and law enforcement agencies.

1.2 Police are a critically important element of United Nations (UN) peacekeeping operations, as evidenced by the 10 fold growth in police authorized for UN missions over the past 15 years. Recognizing the growing demand for police as well as the increased com-plexity of the roles they play, INL/CAP assists police contributing countries (PCCs) and the UN to improve the quality and timeliness of police deployed to UN missions. INL provides equipment, training, and capacity building assistance to PCCs as well as technical and funding support to the UN Police Division.

1.3 President Obama announced the African Peacekeeping Rapid Response Partnership (APRRP) during the August 2014 U.S.-Africa Leaders Summit in an effort to better address this challenge. Through APRRP, the Administration plans to build, strengthen, and in-stitutionalize capabilities to generate and rapidly deploy peacekeepers in six initial partner countries: Ethiopia, Ghana, Rwanda, Senegal, Tanzania, and Uganda. Rapid response includes the ability to quickly plan and deploy Police Contributing Countries (PCCs) within 30 days after the adoption of Security Council resolution and sustain the police for six months. This deployment can include Formed Police Units (FPUs), Individual Police Officers (IPOs), and police support staff. As part of APRRP, INL will focus on build-ing the police peacekeeping capabilities necessary to assist APRRP partners in developing their own capacity so that they are capable of quickly deploying high quality police peacekeepers and independently sustaining them in-mission.

CLIN 1005 –Training to Operate Generator (QTY: 1 Each)

If this option is executed by the Government the vendor shall provide basic training on the operations and maintenance of the de-livered equipment. Each training session will be directed by the COR once equipment is in country. Training will be conducted in Senegal and Rwanda. Participants must demonstrate knowledge of handling, operating, and maintaining the equipment and INL points of contact will observe and confirm the completion of training as part of the receiving acceptance for payment of services.

TYPE OF CONTRACT

This is a firm-fixed price, single award contract, with the optional quantities. No additional sums will be payable on account of any escalation in the cost of materials, equipment or labor, or because of the Contractor’s failure to properly estimate or accurately predict these prices or difficulty of achieving the results required by this contract. Nor will the contract price be adjusted on account of fluctu-ations in the currency exchange rates.

SET-ASIDE

This requirement is being posted as a Total Small Business Set-Aside in accordance with (IAW) FAR Subpart 19.5, Set-Asides for Small Business. Although all small business sources are encouraged to participate, the order of precedence for this set-aside shall be HUBZone, Service Disabled Veteran Owned Small Business (SDVOSB), Woman Owned Small Business (WOSB) and then all other small business designations. The “rule of two” will be applicable and award will be based on “Fair Market Pricing.” As an example, if quotes are received in the order of precedence that is not considered to be at a fair market price, the next socio-economic category will be considered.

ACQUISITION METHOD

This request for quotations uses procedures under FAR Part 12 and 13.

EFFECTIVE PERIOD OF CONTRACT

This contract shall be effective on the date of the Contracting Officer's signature and shall remain valid until all commodities are re-ceived, inspected and accepted by the Government.

SUPPLIES AND PRICES

The Contractor shall provide to the U.S. Government the new products as described in the specifications for the stated firm fixed price. Further, the Contractor shall properly perform the pre-delivery inspection on the products and deliver them to the location set forth under Place of Delivery, of this contract. The firm fixed price shall include the products pre-delivery inspection, certificates of origin, operator’s manuals, warranty certificates and any other documentation mandated by the Government.

TRAVEL

The Contractor will be responsible for all logistics (travel, lodging, transport, sustenance, etc.) for its personnel. INL will not be re-sponsible for direct or indirect support for the travel, lodging, transport, sustenance or any other needs for Contractor personnel. The vendor is responsible for travel arrangements to include, but not limited to: airfare, lodging, transportation, meals & incidental ex-penses, visas fees, required immunizations, and any other items directly related to the trainer’s ability to complete the assignment.

VISAS AND RENEWALS

The Offeror shall ensure that all personnel have valid passports with appropriate visas prior to deployment, and shall ensure timely re-newals of visas and passports. The USG will not provide support or facilitation for obtaining passports and visas.

SECTION 3

INSTRUCTIONS, EVALUATION FACTORS AND METHODOLOGY

Quote submitted in response to this RFQ shall include the following information:

• Product information that demonstrates compliance with all specifications in Section 2

• Itemization of all products and services offered

• Description of special features, testing procedures and any value-added services

• Delivery schedule

• Shipping Services terms and conditions

• Payment terms

• Firm fixed prices for all offered items and services

• Standard warranty offered

SOLICITATION CONSIDERATIONS

The seller certifies that it is an authorized distributer of the similar product being sold to the Department of State and that it has the certification/specialization level required by the manufacturer, to support both the product sale and product pricing, in accordance with applicable manufacturer certification/specialization requirements. Unless otherwise specified, Seller warrants that the products are new and in their original box(es).

The Seller confirms to have sourced all products submitted in this Quote from manufacturer-approved channels for Federal sales, in accordance with all applicable laws and manufacturer’s current applicable policies at the time of purchase. Seller must be able to sup-port both the product sale and product pricing, in accordance with applicable manufacturer certification / specialization requirements.

Pursuant to the Trade Agreements Act (19 U.S.C. 2512(a)) (TAA), Federal acquisitions of supplies may be made only from offerors that will supply products of an eligible country under any of the free trade agreements entered into pursuant to the TAA. An article is considered a product of a country only if it is wholly a product of that country or if it has been, substantially transformed, in that coun-try into a new and different article of commerce with a name, character, or use distinct from that of the original article(s). The Contractor and its employees shall exercise the utmost discretion concerning all matters relating to their duties and functions.

They shall not communicate to any person any information known to them by reason of their performance of services under this con-tract, which has not been made public, except in the necessary performance of their duties or upon written authorization of the Con-tracting Officer.

All documents and records (including photographs) generated during the performance of work under this contract shall be for the sole use and become the exclusive property of the U.S Government. Furthermore, no article, book, pamphlet, email, recording, broadcast, speech television appearance, film or photograph concerning any aspect of work performed under this contract shall be published or disseminated through any media without the prior written authorization of the Contracting Officer. These obligations do no cease upon the expiration or termination of this contract. The Contractor shall include the substance of this provision in all contracts of em-ployment and in all subcontracts hereunder.

D-004 PACKING LIST(S)

A packing list or other suitable shipping document shall accompany each shipment and shall include the follow-ing information:

(a) Name and address of consignor;

(b) Name and address of consignee;

(c) Government contract number (and delivery order number, if used);

(d) Government bill of lading number covering the shipment, if any; and

(e) Description of the items shipped, including item number, quantity, number of containers, and package num-ber, if any.

D-005 WARRANTY NOTIFICATION

In accordance with FAR 46.706(b)(5), the Contractor shall stamp or mark the supplies delivered, or otherwise furnish notice with the supplies, of the existence of a warranty, if any. Sufficient information shall be presented for supply personnel and users to identify warranted supplies. Warranty information shall include the terms and duration of the warranty and the name and telephone number of the Contracting Officer to be notified if the sup-plies are found to be defective.

52.212-3 Offeror Representations and Certifications--Commercial Items (Mar 2015)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual repres-entations and certification electronically via the System for Award Management (SAM) website accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifica-tions electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision.

(a) Definitions. As used in this provision--

"Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business con-cern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service--

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accom-plished by process or penalties.

"Highest-level owner" means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

"Immediate owner" means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employ-ees.

"Inverted domestic corporation", means a foreign incorporated entity that meets the definition of an inverted do-mestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C.

395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except--

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

"Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government.
