Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the Simplified Acquisition Threshold

1. Contracting Activity: Department of Veterans Affairs (VA), Network Contracting

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This procurement will be a 6 month bridge contract for hazardous waste disposal and emergency spill response for the Veteran Affairs Palo Alto Health Care System (VAPAHCS) in FAR 12 Acquisition of Commercial Products and Commercial Services. Specifically in FAR 12.102(a) Restricting competition, acquisitions below the simplified acquisition threshold (SAT) must document the decision that only one source is available. Contractor will be providing hazardous waste removal from various locations within VAPAHCS, as well as providing 24 hour emergency spill response when necessary during a 6 month period while a long term contract is awarded. The proposed contractor is Environmental Logistics Inc.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The current awarded contract with Environmental Logistics has reached its ceiling limit during its third order period with two remaining years left on the contract. Due to the necessity of these services it was recommended by NCO procurement analyst that a new long term contract be awarded. At this time the current task order is set to end August 14, to avoid any lapse in services or any unauthorized commitments a bridge contract will be awarded while the long term contract is solicited and awarded. Environmental Logistics as the current contractor will continue to provide hazardous Waste removal, transportation, storage, treatment and disposal in addition to emergency spill response.
4. Description of market research conducted and results or statement why it was not conducted:
Minimal market research was conducted. As this will be a sole source a notice of intent to sole source was posted to SAM.gov on July 21, 2026.A search of SBA was conducted, to show that Environmental Logistics is a small business under the NAICS. Maintaining these services is critical to environmental safety at VA facilities.
