About this file

This document is a Single Source Justification for a Special Acquisition Procedure (SAP) under the Simplified Acquisition Threshold (SAT) issued by the Department of Veterans Affairs. The procurement involves replacing damaged stormwater discharge piping on the east side of the Omaha VA Medical Center campus. The existing corrugated metal piping has corroded, causing erosion along the east property line and risking further property damage. Covenant Construction, the current contractor for a Design-Build project, is being sole-sourced to complete this work because they designed the original system and can integrate the new pipes most effectively.

The justification document details that the proposed work includes repairing a damaged retaining wall and will be completed as part of ongoing stormwater detention improvements. The acquisition is valued under $250,000 and follows Federal Acquisition Regulation (FAR) 13.106-1 guidelines for single-source awards. The contracting activity is VISN 23, Nebraska Western Iowa Healthcare System, with the funding request identified as 636-25-4-5058-0221. The document is revision 01, with an effective date of 11/15/2024, and includes a certification by the Contracting Officer, Derek Fore, affirming the accuracy and completeness of the justification.

Single Source Justification for SAP under the SAT

Revision: 01 Effective Date: 11/15/2024 Page 1 of 2 Acquisition ID# 36C263-25-AP-4120

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C263-25-AP-4120

1. Contracting Activity: Department of Veterans Affairs, VISN 23, Nebraska

Western Iowa Healthcare System, Omaha Medical Center. Funding Request (2237) 636-25-4-5058-0221.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Replace damaged stormwater discharge piping on the east side of the Omaha VAMC campus. Discharge piping exits VA property at two locations on the east side of Lot 2. Existing corrugated metal piping has corroded to the point that erosion along the east property line has damaged an existing retaining wall and poses continued risk to further VA property damage. These pipes will be replaced as part of on-going work to improve stormwater detention and release.

While not included in the original scope, these pipes are directly related to the overall scope of the existing contract and work can be completed by the current contractor at significant cost savings to the VA. Work includes repairing the damaged retaining wall. The estimated cost of this work is .

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This is a Design-Build project in which Covenant Construction has designed and is building the entire system. The drainage pipes for the system were not a part of the scope of work and the design was tie into the existing pipes per the Original Scope of Work. Because Coverant Construction has designed the system and are currently install the system they are the only responsible contractor to take corrective action to replace the pipes with a system that will work with their design IAW FAR 6.302-1.

4. Description of market research conducted and results or statement why it was not conducted: Market research was conducted during the procurement of the original solicitation. The new components must tie into a design, made by the current contractor, to make the system fully operational. If the design was 100%, completed by an AE firm, and time permitted there may still not have been adequate competition for this type of procurement.

5. Contracting Officer's Certification: Purchase is approved in accordance with

FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
