4. Market research was performed reviewing Dynamic Small Business Search (DSBS) and
System for Award Management (SAM) databases using North American Industry Classification System (NAICS) Code (811310) and Federal Service Code (FSC) J066, looking for any company that could provide this Service. A review of 8(a), HUBZone, Service Disabled Veteran Owned Business, and Women Owned Small Business was conducted in search of a company that could provide this Service. Instron is the Original Equipment Manufacturer for the Tensile Tester Systems. Instron owns all data rights to their technology. Instron is the only known source that has the required parts (software/hardware/electronic/electrical) and access to proprietary data to perform the required maintenance on this equipment. Certified Instron service technicians are the only qualified contractors to perform service on the Tensile Tester Systems.
There is no other contractor authorized as an OEM maintenance and repair facility. Only the OEM (Instron) is capable to Calibrate and perform Maintenance on the Tensile Tester Systems using their unique and proprietary software in a cost effective manner. These searches yielded only one company capable of providing the required service to support the warfighter.
5. In the future, to prevent future sole source acquisitions of this service we will continue to search the market for acceptable repair technicians. Requiring Activity will also work with Instron to see how much it will cost to obtain the data rights for the equipment. Having the data rights could make this repair organic in the future.
6. I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
