Justification for Single Source (Brand-Name) Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C250-23-AP-2096

1. Contracting Activity: Department of Veterans Affairs, VISN 10, John D. Dingell VA Medical Center, 4646 John R Street, Detroit, MI 48201/Network Contracting Office 10, Battle Creek VAMC 2237: 553-23-2-3063-0032

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: John D.

Dingell VA Medical Center Housekeeping requires three (3) Square Scrub Model EBG-20/C PIVOT machines and four (4) Square Scrub Model EBG-28 PIVOT with HEPA Dry Vac Kit machines.

The estimated amount of this procurement is $41,400.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: While there are other floor scrubbers of similar design, the Square Scrub floor scrubbers were the only products found capable of stripping floors without a chemical stripper and which contained a built-in HEPA vac. These features are important when stripping floors in the inpatient wards due to many of these patients having respiratory issues or sensitivity to certain smells.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted through SBA VetCert, DSBS, AbilityOne, UNICOR, GSA Advantage, and a sources sought notice (36C25023Q0627) published on SAM.gov. While several vendors list these items on GSA Advantage, it was found that the OEM, Square Scrub, had recently increased pricing and those price increases had not yet been incorporated into distributor GSA contracts, therefore none were able to currently quote these items. One small business and one SDVOSB distributor was located in the open market. The VA “Rule of Two” was not satisfied, but the procurement can be set-aside for small business in the open market.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
