VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C262-20-AP-6185

1. Contracting Activity: The Department of Veterans Affairs, VISN 22, Network Contracting Office 22

(NCO 22) in Long Beach, CA, seeks to procure the services listed in purchase request 691-21-1-5090- 0005 for the VA Greater Los Angeles Healthcare Center (VALAHCS), VA Sepulveda Ambulatory Care Center (VASACC) in North Hills, CA.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

EMERGENCY SERVICE to REPLACE Boiler #1 Burner Element & Ceramic Insulation as a result of flame failure from a safety shutdown. Repair by replacement is needed to return essential steam and hot water services to Sepulveda campus and eliminate health and safety hazards to patients and staff.

This is a VHA Directive 1810 requirement. Estimated services cost is $16,269.50 USD.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

EMERGENCY: Circumstances of contract action deem only one source reasonably available due to urgency, critical / unique nature of requirement, and time constraints per FAR 13.106-1(b), and no other supplies or services will satisfy agency requirements. Additionally, following established competitive procedures would result in unacceptable delays.

4. Description of market research conducted and results or statement why it was not conducted:

Market Research (MR) was not performed due to urgency, critical / unique nature of requirement and time constraints. However, a VIP query identified 979 National and 76 California registered SDVOSB / VOSB vendors capable of performing under NAICS 238220 – Heating, Plumbing, and Air Conditioning Contractors. Conclusion – recommend single / sole source procurement action to POWERHOUSE COMBUSTION & MECHANICAL CORPORATION [DUNS 968387790], a SAM registered Small Business vendor.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3. See the

S19 Open Market (FAR13) Award Documentation Form with Abstract to document price reasonableness.
