VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
VHAPM Part 813.106 Page 1 of 1 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C262-20-AP-4422
1. Contracting Activity: The Department of Veterans Affairs, VISN 22, Network Contracting Office 22 (NCO 22) in Long Beach, CA, seeks to procure the services listed in purchase request 664-20-4-5082- 0337 for the VA San Diego Healthcare System (VASDHCS) in San Diego, CA.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
SERVICE to REPLACE A/C #33 CHW & HHW Coils & 50HP Blower Motor. Repairs are needed as A/C #33 provides critical environmental controls for the Research Department animal colony. Estimated services cost is $173,310.00 USD.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This is a replacement contract for previously awarded 36C26219P0637 that was subsequently cancelled due to Government (VA) inability to provide temporary environmental controls to the Research Department animal colony. With time and circumstance, additional failures within A/C #33 require increase in initial scope to include 50HP blower motor replacement. The Southern California region is experiencing an unprecedented heatwave which has created dangerous conditions for those vulnerable and in need of environmental climate controls. The area serviced by A/C #33 must remain operational to preclude the harmful effects of heat to the animal colony. Additionally, the wildfires in the region have created unhealthy air quality conditions which preclude the use of open-air ventilation to cool, recirculate or exchange air in buildings.
Circumstances of contract action deem only one source reasonably available due to urgency, critical / unique nature of requirement, and time constraints per FAR 13.106-1(b). Additionally, following established competitive procedures to compete or recompete would result in unacceptable delays.
4. Description of market research conducted and results or statement why it was not conducted:
Market Research (MR) was limited to contacting vendors who had provided similar services in the past and who were immediately available to perform required services due to urgency of requirement and time constraints. However, a VIP query identified 970 National and 75 California registered SDVOSB / VOSB vendors capable of performing under NAICS 238220 – Plumbing, Heating, and Air Conditioning Contractors. Conclusion – recommend single / sole source procurement action to SUSTAINABILITY TECHNOLOGIES, INC. dba ASTRO BUILDING SERVICES [DUNS 036908992], a SAM and VIP registered SDVOSB vendor.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. (COs are required to make a determination of price reasonableness IAW FAR 13.106-3.)
