Use of a Single Source Below the Simplified Acquisition Threshold (SAT)

FOR OFFICIAL USE ONLY

4 Jan 2021 FOR OFFICIAL USE ONLY Page 1 of 2

Section A: General Contract Information

Is this a Bridge Action as defined in the AF Bridge Action Reduction Plan? Yes No

Contracting Activity: 27th Special Operations Contracting Squadron (27 SOCONS/PKA)

Project/Program Name: TCV Bomb Containment Vessel Repair, model MECV-5L/B3

Purchase Request / Local ID Number: F1L3J20346AW01

Estimated Contract Cost (including Options): $6,500.00

Section B: Description of the Supplies/Services Required

The 27th Civil Engineer Squadron/EOD at Cannon Air Force Base (CAFB), New Mexico (NM) is requesting a one (1) day diagnostic and repair service for one (1) malfunctioning Total Containment Vessel (TCV), model MECV-5L/B3. This service will be a sole source to Dynasafe US, LLC. (CAGE Code: 72GU1), the sole manufacturer of this item. The contractor shall provide all management, tools, specialized equipment, supplies, and labor necessary to repair the TCV in accordance with (IAW) the Statement of Work (SOW) and other contract documents.

The bomb containment vessel is used to mitigate injury or damage to people and property by containing the effects of explosive, chemical or biological substances (bombs). It is certified to certain explosive containment levels by the DoD Explosive Safety Board (DDESB) when in operational status and therefore needs to be assessed and repaired back to serviceable conditions.

This action will be awarded as a new firm-fixed-price type, non-personal service contract using fiscal year (FY) 2021 O&M funds (3400).

Section C: Rationale for Soliciting from a Single Source or Brand Name

The Government intends to award a single source contract to Dynasafe US, LLC. (CAGE: 72GU1).

IAW FAR 6.302-1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements and FAR 13.106-1(b)(1) Soliciting from a single source for purchases not exceeding the simplified acquisition threshold, Dynasafe is the sole manufacturer and only vendor that can meet the requirement for Bomb Containment Vessel repair at CAFB.

Dynasafe is the sole manufacturer of the TCV model number MECV 5L/3B and provided the Government a signed letter stating that they are the only company authorized to perform diagnostic, damage assessment, and repair of the TCV model number

MECV5L/3B.

In order to ensure proper and safe use, service and training on Dynasafe equipment must only be performed by authorized and certified Dynasafe personnel who are well versed in the technology and current practices. Any repairs or alterations done by an individual other than a certified Dynasafe representative could alter the structural integrity or systems operations of the TCV.

The cost to replace the TCV is $350,000.00 for the lowest priced TCV with Dynasafe and at this time, it is cost prohibitive to replace the TCV versus repairing it.

The Contracting Officer determines the technical repair requirements of this mission critical EOD equipment, and the supporting documentation and research, justify the single source acquisition.

Section D: Efforts to Obtain Competition

FOR OFFICIAL USE ONLY

4 Jan 2021 FOR OFFICIAL USE ONLY Page 2 of 2

A sources sought was posted on beta.sam.gov from 5 February 2021 to 12 February 2021. No other vendors expressed interest in this requirement.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

Further market research will be completed throughout the lifetime of this item to make sure that no updates or changes occur in the availability of this requirement in the open market. The customer will provide feedback to the Air Force Installation and Mission Support Center (IMSC) and the Air Force Civil Engineer Center (AFCEC) to look for "bomb squad" equipment that has competition so as to preclude sole source needs in the future.

Additionally, increasing training of the EOD personnel on the owner's manual and additional information to boost proper preventative maintenance will reduce future needs for maintenance and repair by Dynasafe.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
