Section C: Justification for Soliciting from a Single Source or Brand Name
(1) Maintenance of the railway roadbed and the railroad crossing is a unique service. The Japanese Railway Business Law ("Tetsudo Jigyo-ho," Japanese Law No. 65) has given technical responsibility for the maintenance and safety of the main lines and connecting sidetracks to the owner of the main rail lines. The owner of the Hachiko Line and this particular crossing is JR East. JR East was established 01 Apr 1987 as a result of the privatization of the Japan National Railways (JNR) controlled under the Government of Japan. At that time, seven (7) companies - six (6) Passenger railway companies including JR East and Japan Freight Railway Company, which handles the freight exclusively - were formed from the privatization.
(2)Requiring Activity, 374th Civil Engineer Squadron requests that JR East is the only responsible company that can provide services properly for this requirement (See Attachment 1, RA Sole Source Justification). The 374th Contracting Squadron believes that the award to any other sources would result in noncompliance with the applicable local Japanese law and unacceptable delays in fulfilling the U.S. Government's requirements. It is unknown if the applicable law would be modified for other entities to be allowed to perform the services. The delay in awarding the follow-on contract would affect the operation and traffic around railroad crossing No.3 at Yokota Air Base.
