Section B: Description of the Supplies/Services Required
The United States Air Force Academy (USAFA)medical group has requested that four pharmacy locations be added to the recently awarded bio-hazardous contract for the proper storage, removal and disposition of pharmaceutical Hazardous Drug (HD) waste. These additional sites are requested in an effort to meet recent changes from the Environmental Protection Agency (EPA) and the United States Pharmaceutical Convention (USP) 800 mandates. On 1 October 2020 the USAFA awarded a contract (FA700020C0001) for medical waste to be stored, removed, and properly disposed of IAW 49 CFR 173 and 49 CFR 178. The contact was competitively awarded to Healthcare Medical Waste Services, LLC with a one year base period with four one year option periods. This contract includes five various locations where medical waste is stored until removed and properly disposed of in accordance with the Performance Work Statement (PWS).
Section C: Justification for Soliciting from a Single Source or Brand Name
In this instance the delay that would be caused by competing this requirement and issuing a new contract would result in noncompliance and potential fines for the medical facilities on the USAFA. Government operations at USAFA are currently curtailed to mission essential activities as a result of the COVID-19 pandemic. Healthcare Medical Waste Services, LLC is currently vetted and approved to operate under these conditions. Given the impact on operations caused by the COVID-19 pandemic the incumbent contractor is the only small business contractor with established service routine/schedule that can provide the required services on an ongoing basis without unacceptable delay and mission impact.
The Contracting Officer recognizes the obligation under CICA to solicit offers from as many potential sources as is practicable, however, taking into consideration the mission-critical need for continuity of these mission essential services in this time of pandemic uncertainty the incumbent; a small business is postured to fill the increased requirement. If the requirement were to be solicited and awarded to another business it would increase costs to the government that are not expected to be recovered through competition at this time. Cost associated with such a turnover would potentially include items such as: All new employees would need to be vetted with badges and passes; routes and procedures learned, and disposal containers delivered.
Section D: Efforts to Obtain Competition
The current operating conditions and urgency necessitate this sole source action for a contract modification at this time. However, it is the intent of 10 CONS to resolicit for an all-encompassing disposal service contract with a start date of 1 Oct 2020.

Section E: Steps to Preclude Future Single Source or Brand Name Awards
Market Research for a follow-on contract has begun. The intent is to maintain the same competitive procedures used less than 8 months ago that resulted in award of these services. A competitive, 100% small business set-aside, combined synopsis/solicitation Request for Quote (RFQ) will be posted to Beta.Sam. The immediate need for service that has risen as a result of the EPA requirement does not constitute a lack of advance planning on the part of the government.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
