About this file

This is a Single Source Justification (Simplified Acquisition) document for a $41,214.42 Blanket Purchase Agreement (BPA) for the 99th Civil Engineering Squadron at Nellis Air Force Base. The requirement is for 10GB data per month for satellite connection to support six telephones and internet connectivity for the Nellis Air Force Mobile Command Post.

The justification explains that NIC4 (which acquired the original supplier KnightSky in November 2021) is the only company able to maintain and modify the existing proprietary equipment and network. The maintenance agreement stipulates that any modifications or services by other vendors would void the contract. The document, signed by Contracting Officer Rachel N. Tilley on December 9, 2024, notes that the only way to avoid future sole source awards would be to purchase entirely new equipment compatible with multiple networks. The justification is supported under FAR 13.106-1(b)(1) as only a single source is reasonably available.

Section A: General Contract Information

Is this a Bridge Action as defined in the AF Bridge Action Reduction Plan? Yes No

Contracting Activity: 99th Contracting Squadron (99 CONS)

Project/Program Name: 99 CES NIC4 BPA

Purchase Request / Local ID Number: BPA

Estimated Contract Cost (including Options): $41,214.42

Section B: Description of the Supplies/Services Required

99th Civil Engineering Squadron requires 10GB data per month for satellite connection for six (6) telephones and Internet connectivity.

Section C: Justification for Soliciting from a Single Source or Brand Name

The Nellis Air Force Mobile Command Post has satellite communication installed and configured to operate on NIC4 proprietary network, the original supplier for the contract was KnightSky, which was acquired by NIC4 in November 2021. Under the maintenance agreement, any modifications, adjustments, repairs, or service provided by anyone other than NIC4 will terminate the maintenance contract. On 2 December 2024, Mr. Brian Skurka (Director of Business Development for NIC4) confirmed NIC4 is the only company able to maintain and modify the existing proprietary equipment.

Section D: Efforts to Obtain Competition

The equipment will not operate with any other network. The equipment and services provided are proprietary in nature. No other vendor would be able to provide service for this requirement. Until there are changes to the installed equipment, or NIC4 authorizes additional retailers to provide service and maintenance, this will remain a sole sourced requirement.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

The only option to preclude a future single source award would be to purchase all new equipment with the capability to operate with various networks.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
