About this file

This is a Single Source Justification Memorandum for a federal procurement by the U.S. Department of the Interior, Bureau of Land Management (BLM), Oregon State Office.

The BLM seeks to procure a new tilt horse chute for the Burns District Wild Horse and Burro (WH&B) Corral from Flying W, Inc., located at 922 W Russworm Dr., Watonga, Oklahoma, under a firm fixed price commercial supply contract. The current chute at the facility is unsafe due to structural, gate, and mechanical failures and is no longer suitable for restraining wild horses and burros during necessary medical procedures and hoof trimming. The tilt chute is essential for ensuring safe animal handling and protecting employees, veterinarians, and farriers working at the corral. Flying W, Inc. is identified as the only known manufacturer, distributor, and installer of horse-specific tilt chutes; other livestock chutes available on the market are designed for cattle or sheep and lack the specialized anatomical design required for safe equine restraint. Market research confirmed that horse-specific tilt chutes are not available through mandatory or established federal supply sources. The contracting officer determined that Flying W's chutes are competitively priced within the range of bovine-specific tilt chutes and represent the best value for the government's needs. The procurement is authorized under FAR 12.102 (Restricting Competition) and will utilize simplified procedures under FAR subpart 12.201-1 in accordance with 41 U.S.C. 1901.

Memorandum

To: Contract File

From: Tiffany Eslinger, Contracting Officer

Subject: Single Source Documentation

In accordance with FAR subpart 12.202(a), this memorandum justifies soliciting a single source procurement herein.

1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY.

U.S. Department of the Interior (DOI), Office of Acquisition and Property Management (PAM), Bureau of Land Management (BLM) Programs- Oregon/Washington

2. NATURE/DESCRIPTION OF THE ACTION BEING APPROVED.

The DOI will solicit the purchase of a new, tilt, horse chute for the Burns District BLM Wild Horse and Burro (WH&B) Corral as a single source procurement to Flying W, Inc, 922 W Russworm Dr., Watonga, OK, to be issued as a firm fixed price commercial supply contract.

3. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S

NEEDS (INCLUDING THE ESTIMATED VALUE).

The Government requires a new tilt horse chute at the Burns WH&B Corrals. The current chute at the corrals is currently unsafe to use due to structural, gate, and mechanical failures. The chute is necessary to perform medical procedures and hoof trimming to horse and burro that are not yet tamed and able to be worked by hand. The chute is critical for the safe treatment of the animals kept at the corrals.

4. AUTHORITY AND SUPPORTING RATIONALE AND, IF APPLICABLE, A DEMONSTRATION

OF THE PROPOSED CONTRACOR’S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED

SUPPLY OR SERVICE.

The authority permitting the single source consideration is FAR 12.102) Restricting Competition. Flying W, Inc is the only known source who manufactures, distributes, and installs equine tilt and squeeze chutes. The tilt chute is specifically made to ensure the safety of horses and burros as they are restrained in the chute. Other livestock chutes available on the market are structurally created for either cows or sheep, whose anatomy is different from a wild horse or burro. The design of Flying W’s chute allows for the safe restraint of horses and burros without unnecessary stress or injury. The procedures in FAR subpart 12.201-1 Simplified Procedures will be used in accordance with 41 U.S.C. 1901.

5. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ORDER REPRESENTS THE

BEST VALUE.

Flying W, Inc is currently the only manufacturer, distributer, and installer of horse-specific tilt chutes.

They are a small business. The chutes are within the average cost for other bovine-specific tilt chutes, which range from The maintenance and care of wild horses and burros are a priority for the Bureau of Land Management. The use of a tilt trailer for horses assists greatly when trying to provide medical care or hoof treatments to horses and burros that have not been trained. This chute will allow for safe handling of the animals and for the safety of the employees, veterinarians, and farriers that work with them. The chute currently in use at the Burns Corral is severely damaged and maintenance and repairs have done little to allow the safe usage of the chute. Replacement is vital to the continuation of safe treatment of the animals at the corral. Based on the documentation herein, it is determined that the contract represents the best value.

6. DESCRIPTION OF MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND

THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT

CONDUCTED.

Market research indicates that there is currently only one manufacturer, distributor, and installer of horse-specific tilt chutes. These chutes are not available through mandatory or established sources.

7. ANY OTHER FACTS SUPPORTING JUSTIFICATION.

None.

8. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR

OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION

FOR THE SUPPLIES OR SERIVCES IS MADE.

None.

CONTRACTING OFFICER CERTIFICATION

I certify that this justification is accurate and complete to the best of my knowledge and belief. I determine the circumstances of the contract action deem only one source reasonably available.
