About this file
This document is a Single Source Determination under the Simplified Acquisition Procedures (SAP) for the National Oceanic and Atmospheric Administration (NOAA) to sole source a contract with ATS Scientific Products for repair and maintenance of a VirTis benchtop lyophilizer. The lyophilizer is critical equipment used by NOAA's Southwest Fisheries Science Center (SWFSC) for stable isotope analyses and biochemical assays. As the original equipment manufacturer (OEM) certified service provider, ATS Scientific Products is the only vendor capable of effectively repairing and servicing this discontinued lyophilizer model due to their proprietary technical expertise and access to necessary parts and tools. Failure to secure these repair services would critically impact the SWFSC's ongoing and future research activities. The government conducted a market research and found no alternative vendors that could meet the technical requirements within the required timeframe. While this is a sole source procurement not open to competition, the government will consider capability statements from any potential offerors that believe they can fully meet the requirements.

SINGLE SOURCE DETERMINATION
USING SIMPLIFIED ACQUISITION PROCEDURES (SAP)
FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION
THRESHOLD
(AUTHORITY: FAR 13.106-1(b)(1))
1. Agency and Contracting Activity Department of Commerce, NOAA Acquisition and Grants Office (AGO), Western Acquisition Division, and the Southwest Fisheries Science Center (SWFSC).
2. Description of Supplies or Services Required to Meet Agency Needs The Southwest Fisheries Science Center requires a one-time service visit from ATS Scientific Products to repair and maintain the VirTis benchtop lyophilizer, which is critical for stable isotope analyses and biochemical assays conducted by the Marine Turtle Ecology and Assessment Program. The lyophilizer is currently non-operational due to a suspected pressure breach, and immediate repairs are necessary to regain functionality.
3. Identification of the Single Source to be Solicited ATS Scientific Products (SP Industries Inc.)
UEI: JVB1PLPHU3J6
NAICS: 334513
Business Size: Not a Small Business SAM Status: Active
4. Supporting Rationale Only one source is reasonably available. ATS Scientific Products is the sole provider uniquely qualified to service and repair the VirTis benchtop lyophilizer due to their in-depth knowledge of the equipment's manufacturing and operational systems. As the original equipment manufacturer (OEM) certified service provider, ATS Scientific Products has exclusive access to the proprietary parts, tools, and technical expertise required for effective repair and maintenance as the VirTis benchtop lyophilizer is a discontinued model and replacement parts are largely unavailable. The lyophilizer is essential for the SWFSC’s research activities, and no other vendor can offer the necessary services without risking delays, potential damage to the equipment, or compromising the quality of research data. Failure to secure this service would critically impact ongoing and future scientific investigations at the SWFSC.
5. Market Research Market research was conducted including all required sources of services and a search of the internet for potential businesses, registered with SAM.gov, that can perform service to this specific piece of equipment. It was found that ATS Scientific Products is the only apparent capable vendor with the specialized knowledge, OEM certification, and capability to service the VirTis benchtop lyophilizer. No alternative vendors were identified that could meet the specific technical requirements and provide the necessary repair services within the required timeframe.
