About this file

This is a Single Source Determination document for a professional service contract between NOAA Fisheries and the Alaska Department of Fish and Game (ADF&G). The contract involves tracking daily use of Recreational Quota Entry (RQE) charter halibut stamps on charter vessel electronic logbooks. NOAA Fisheries requires ADF&G to modify their existing electronic logbook platform to document charter halibut stamp usage, collect logbook data, and share specific trip-related information such as date, business registration number, vessel details, and number of stamps validated.

The sole source justification is based on ADF&G's unique capability to execute these services, stemming from their existing electronic logbook platform required under State of Alaska regulations and a pre-existing data sharing agreement with NOAA Fisheries. The contract is being awarded under Simplified Acquisition Procedures with a one-year performance period and an optional follow-on year. Approximately 200,000 electronic charter halibut stamps will be purchased annually by charter operators, with ADF&G responsible for collecting and sharing validated usage data to support the RQE halibut stamp program.

SINGLE SOURCE DETERMINATION USING

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

(AUTHORITY: FAR 13.106-1(b)(1))

1. Agency and contracting activity.

Department of Commerce, NOAA Acquisition and Grants Office (AGO), Fisheries OMB Field Delegates and the Alaska Region

2. Description of supplies or services required to meet agency needs (including the estimated value).

Professional services to track the daily use of Recreational Quota Entry (RQE) charter halibut stamps on charter vessel logbooks.

3. Identification of the single source or the brand name to be solicited.

Alaska Department of Fish and Game (ADF&G)

Bonnie N. Jensen, Director Division of Admin Services Phone: 907-465-3497 Email: bonnie.jensen@alaska.gov

4. Supporting rationale. Only one source is reasonably available as detailed below:

Only one source is capable – In 2018, NOAA Fisheries implemented regulations that authorizes the non-profit Recreational Quota Entity (RQE) to work on behalf of the Alaska charter (i.e. guided sport) halibut businesses by purchasing a portion of the halibut quota that is currently allocated to the Alaska commercial fishery.

In 2023, U.S. Congress amended the Magnuson Stevens Act to authorize NOAA Fisheries to develop regulations necessary for the collection of fees from charter vessel operators to fund the RQE for its purchases of halibut quota from the commercial fishery. As a result, NOAA Fisheries will issue electronic stamps to charter operations, but requires ADF&G to track the daily use of charter halibut stamps on charter vessel logbooks and subsequently share this data with the agency.

ADF&G is the only entity able to execute the desired services, which are needed to fully implement the RQE halibut stamp program. ADF&G already has an electronic logbook platform that is required under State of Alaska regulations for all saltwater charter operators. The logbook can be easily adapted to document the use of charter halibut stamps. NOAA Fisheries and ADF&G already have a data sharing agreement currently in place, which will facilitate many of the protocols of ADF&G’s sharing of the logbook data with NOAA Fisheries. No other agency or vendor is in a position to effectively and efficiently deliver this service to NOAA Fisheries.

5. Market Research.

Market research is not applicable, as there is no other entity with the ability provide the desired service.
