About this file

This Justification and Approval (J&A) document outlines a non-competitive acquisition for critical ship repair services for USS PINCKNEY (DDG-91) in Singapore. The Department of the Navy, specifically NAVSUP Fleet Logistics Center Yokosuka Site Singapore, will limit competition to eight Master Ship Repair Agreement (MSRA) and Agreement for Boat Repair (ABR) holders due to urgent maintenance requirements. The proposed firm-fixed price contract is for ship repairs including condenser cleaning, pump replacement/overhaul, lagging, and preservation, necessary to maintain the ship's operational and mission capabilities during its 7th Fleet deployment.

The acquisition is being conducted under 10 U.S.C. 3204(a)(2) and FAR 6.302-2 for Unusual and Compelling Urgency, with a Period of Performance in 2026. The repairs are deemed mission-critical, with any delays potentially jeopardizing the ship's deployment and Navy operations in the INDOPACOM Area of Responsibility. The contract will be funded by FY26 Operations and Maintenance, Navy funding, and the non-commercial, OEM-specific parts are required to ensure interoperability and safety aboard Navy vessels. The Contracting Officer will determine price fairness and limit solicitation to pre-qualified local firms to ensure rapid execution of the required maintenance.

JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN

COMPETITON

1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: The requesting activity is Ship Repair Facility Detachment Singapore; the contracting activity is the Department of the Navy, NAVSUP Fleet Logistics Center Yokosuka (FLCY) Site Singapore.

2. NATURE/DESCRIPTION OF CONTRACT ACTION: This acquisition is conducted under the authority of 10 U.S.C. 3204(a)(2), as implemented by FAR 6.302-2, Unusual and Compelling Urgency.

This Justification and Approval authorizes limiting competition to Master Ship Repair Agreement (MSRA) and Agreement for Boat Repair (ABR) holders. The anticipated contract type is a Firm-Fixed Price contract, with Period of Performance (POP) being 2026 – 2026. .

3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The proposed acquisition, SING-007-26 is for ship repairs to include but not limited to: condenser cleaning, pump replacement/overhaul, lagging and preservation for USS PINCKNEY (DDG-91) for the accomplishment of Continuous Maintenance Availability (CMAV) on mission or safety essential items necessary to continue on its deployment. The Period of Performance (POP) is 2026 – 2026 and the place of performance is in Singapore. Due to the compelling urgency of these repairs that are essential to maintain the safety, operational and mission capability requirements of the USS PINCKNEY (DDG-91) currently on deployment to the 7th Fleet and in need of critical repairs IOT meet her current missions.

This contract will be funded with FY26 Operations and Maintenance, Navy funding.

4. IDENTIFICATION OF THE JUSTIFICATION RATIONALE AND/OR DEMONSTRATION OF

CONTRACTOR’S UNIQUE QUALIFICATIONS: The statutory authority which permits restricting full and open competition consideration is 10 U.S.C.3204(a)(2), as implemented by FAR 6.302-2, Unusual and Compelling Urgency.

USS PINCKNEY (DDG-91) is currently on deployment to the 7th Fleet and is in need of critical emergent repairs. Pursuant to its operational tasking, the ship is heading to Singapore and will be made available to conduct a Continuous Maintenance Availability (CMAV) there to execute these mission-critical repairs.

Any delays in contract award will potentially delay the USS PINCKNEY (DDG-91) deployment and jeopardize the mission capability of the Navy Fleet in the 7th Fleet.

This justification restricts consideration to Master Ship Repair Agreement (MSRA) and Agreement for Boat Repair (ABR) holders. Shipboard repair work is complex and demanding. The type of work that comprises ship repair, and the conditions under which it is performed, require ship repair companies that are fully capable of conducting all aspects of shipboard work. MSRA and ABR holders have been evaluated to possess the organization and facilities to perform the ship repair work satisfactorily in accordance with NAVSUPFLCYINST4280.20M dated 28 Nov 2023.

MSRA/ABR holders have the managerial capabilities, financial status, production capacity, quality management system, capabilities, and experience to accomplish the requirements of this work package; and MSRA/ABR are location or region-specific agreement vehicles issued to firms that have the facilities, management, organization and production capabilities to perform an entire complex repair and alteration package in the area.

The period of performance is 2026 – 2026. The full requirement package was sent to FLCY Site Singapore on The short turnaround for processing the award was less than the standard NAVSUP PALT of 180 days as required for acquisitions above the Simplified Acquisition Threshold (SAT) for ship repair. Delay in the performance of the necessary repair work would endanger USS PINCKNEY (DDG-91) personnel and material, and operational availability of the ship. MSRA / ABR holders are the only known sources capable of accomplishing the requirements and possessing the necessary materials within the time required.

The Contracting Officer recommends an exception to full and open competition for this requirement under the authority of FAR 6.302-2, Unusual and Compelling Urgency. Providing full and open competition would cause unacceptable delay in the execution of mission-critical ship repair and maintenance services.

Such delay would jeopardize the readiness and operational commitments of the supported unit, directly impacting Navy operations in the U.S. INDOPACOM Area of Responsibility. Immediate award and commencement of work are required to meet the Period of Performance (POP).

5. DETERMINATION OF THE BEST VALUE: The FLCY – Site Singapore Contracting Officer will determine, using the procedures in FAR 15.4, that the price negotiated for this acquisition is fair and reasonable prior to contract award.

6. DESCRIPTION OF MARKET RESEARCH: In accordance with Navy policy, only contractors holding Master Ship Repair Agreements (MSRA) or Agreements for Boat Repair (ABR) are authorized to perform this type of work. These firms have undergone rigorous pre-screening, qualification, and certification to verify compliance with technical, safety, quality, and security standards unique to U.S. Navy vessels.

There is insufficient time to qualify any new vendors before the required start date, and attempting to do so would introduce significant operational risk.

Given the urgent nature of this requirement and the geographic limitations of performance, the Contracting Officer will limit competition to the eight (8) MSRA/ABR holders located in Singapore who have demonstrated capability, local presence, and compliance with Navy technical and security standards.

Soliciting only these pre-qualified local firms represents the maximum practicable competition under the circumstances.

Additionally, the requiring activity certifies that the materials and components required for this effort are non-commercial, OEM-specific parts in direct support of the Expeditionary Staging Base (ESB). These components are not available as commercial off-the-shelf (COTS) items and must conform to OEM specifications to ensure interoperability and safety aboard Navy vessels.

7. ANY OTHER SUPPORTING FACTS: Under the authority of FAR 6.302-2 Unusual and Compelling Urgency, the Government may solicit and negotiate with only as many sources as practicable to fill the need as quickly as possible. Accordingly, limiting solicitation to the eight Singapore-based MSRA/ABR holders is justified, reasonable, and necessary to meet mission requirements without delay, ensuring uninterrupted fleet support while achieving the best value practicable for the Government under the authority of FAR 6.302-2

8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: All future requirements will be handled on a case-by-case basis.

9. CONTRACTING POINT OF CONTACT: The point of contact at Fleet Logistics Center Yokosuka -y email at
