4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Sikorsky is the prime contractor for the Low Rate Initial Production (LRIP) CH-53K Heavy Lift Helicopter and is the Original Equipment Manufacturer (OEM) for the CFTD-1 and CMT device. Sikorsky is the only contractor that has design specifications and owns the drawings required to manufacture these training device-specific required support materials for the CFTD and CMT. To procure these materials from any other vendor would involve additional work required to re-design and manufacture these support materials, which would not only result in duplicative costs to the Government, but also would cause significant schedule slippage and trainer down time adversely impacting the ability for pilots to perform required training missions. These support materials were not procured previously, because the materials required could not yet be identified based on the phase of the program. As a result, of the PISC, the Government is now able to determine the remainder of the initial support material needed in support of this effort and has secured sufficient RDT&E funding to acquire the spares. It is critical the support materials are procured at this time as the CFTD-1 has been fielded without these critical support materials. The CFTD-1 is currently operating at risk. Failure of these components will result in rendering the training device inoperable.

Ensuring adequate initial support materials are acquired and available to maintain and sustain the trainer while fielded is critical in fulfilling training requirements. In the event of a needed repair, the absence of these support materials would negatively affect the sustainment of the training assets resulting in limited or non-productive training, thereby adversely impacting students’ operational readiness.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In compliance with PGI 206.302-1, a Request for Information (RFI) was posted on the Federal Business Opportunities website (now www.sam.gov) on 2 November 2017 to determine if any other contractor could provide these support items. No responses were received. In accordance with FAR 5.201, a synopsis for CH-53K Training Systems was posted to the Federal Business Opportunities website (www.FBO.gov) on 18 April 2019 and after remaining open for 15 days, no responses were received. Since that time, the quantities for each part number have increased by one, but the parts required for this effort have not changed. Since the spare parts needed for this effort remain the same as the previous two (2) posted synopses, both of which closed with no responses, posting a new synopsis likely would not achieve a different outcome.

7. Determination of Fair and Reasonable Cost.

The negotiation and establishment of a fair and reasonable price will be conducted in accordance with FAR

15.4. As stated in FAR 15.402(a), the Contracting Officer shall ensure that all materials ordered are procured from responsible sources at a fair and reasonable price. The Contractor shall submit a formal proposal with other than certified cost or pricing data. A Technical Evaluation will be performed by technical analysts and the contract specialist. The Contracting Officer will use price analysis as the basis for negotiating a fair and reasonable price for the materials covered by this J&A.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in paragraph 5, Sikorsky is the only contractor that can meet the current requirement for these support items. The lack of responses to the sources sought notice affirms the Government’s position. The CH-53K program is taking initiative to remove the barriers of competition at the training system level. In the near term, future acquisition of spares for the CFTD device(s) and upgrade(s) will be included as part of any training device. Additionally, the Government intends to assess the feasibility of procuring support items from vendors other than Sikorsky for future CH-53K CFTD upgrades. Should alternative items emerge, NAWCTSD will assess whether competition for future requirements is feasible.
