About this file
This document is a justification for a sole source procurement under $250,000. The Centers for Disease Control and Prevention seeks to acquire a one-year service contract, with two option years, from AB SCIEX LLC for the maintenance of an AB-SCIEX MDQ Capillary System. The estimated value is $34,410.16. The system is a fully programmable and automated quantitative instrument critical to the Biotechnology Core Facility's standard laboratory operations and public health emergency response. It is used for quick quality control analysis of all synthetic DNA manufactured at the core facility. Only AB SCIEX can provide original equipment manufacturer parts and trained service engineers with experience on this proprietary system, ensuring dependable operation. No other vendors were considered capable of maintaining the system to original performance levels.

3. Is the requirement on GSA Schedule? ☐ Yes ☒ No
If yes, provide schedule number: Click here to enter text.
D. Justification:
☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
☐ Urgency
☐ Exclusive licensing agreements/Proprietary data
☐ Brand name required
☐ Industrial mobilization
☒ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)
☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
☐ Urgency
☐ Only One Source
☐ Logical Follow Up
☐ Brand name required
1. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
This service maintains the operational readiness of a critical laboratory instrument.
The instrument participates in standard laboratory operations as well as public health emergencies and requires regular maintenance and parts for consistent operation.
The P/ACE MDQ Plus Capillary Electrophoresis System from AB SCIEX is a fully programmable and automated quantitative system for the separation of charged and polar analytes in a mixture. Innovative system design ensures dependable operation and durability.
This system is being used for a quick QC analysis of all synthetic DNA molecules manufactured at the core facility utilized for outbreaks, kits and regular use.
Original equipment warranty information states that the manufacturer does not ensure performance at original levels if genuine manufacturer parts or manufacturer trained technicians provide service.
Rev. 5/14/19
b. What other products/services were considered and why did they not meet the need?
We had it under contract with another vendor, but due to shortage of purchasing parts from outside, we will need to go back to the original vendor. So, no other products were considered because the instrument is a highly specialized platform that can only be maintained by the original manufacture, with original parts, and all other third parties do not use original OEM..
2. Program Office efforts to seek potential offerors:
None. The vendor that was covering it, has opted out as it is difficult for them to maintain it without the original parts and very few of the engineers have knowledge of the machine. AB SCIEX is the manufacturer and the only vendor of the P/ACE MDQ Capillary Electrophoresis System, therefore no other vendor can provide this service. There are no other sources of experienced service engineers and original proprietary replacement parts available for this instrument. WE already also have 2 more of the AB SCIEX machines covered by them and are satisfied with their service.
