LSJ 1
Limited Sources Justification (LSJ) REVISED For orders or BPAs exceeding the Simplified Acquisition Threshold
This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.
1. Agency and Contracting Activity.
The Department of Homeland Security (DHS) - Federal Emergency Management Agency (FEMA) - Region 6 - Texas Recovery Office, Austin under presidentially declared disaster (DR) DR-4332-TX proposes to award an order (extend service) pursuant to FAR 8.405-6 (a)(1)(C).
2. Nature and/or description of the action being approved.
Region 6 – Texas Recovery Office intends to extend level II armed guard security services one (1) month allowing a continuity of services required for disaster recovery operations.
This task order service extension is a logical follow-on to the original Federal Supply Schedule (FSS) order that was placed with the applicable ordering procedures. The original order was issued in a competitive environment and was not a sole-source or limited- source action. A logical follow-on contract for one (1) month will allow time to solicit a new contract for security services, as the current order expires May 31, 2021.
3. Description of Supplies/Services.
This requirement is for level II armed guard security services in support of DR-4332- TX at Austin and Houston locations. The estimate value of additional one-month service is approximately $128,691.30. There is an on-going armed guard security services requirement for all locations supporting the recovery efforts of presidentially declared disaster DR-4332-TX.
4. Authority and supporting rationale.
FAR 8.405-6 (a)(1)(c). In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole- source or limited-sources procedures.
This revised limited source justification provides an additional month of continuity service to adequately solicit and award another task order. The notification posting and justification will meet the synopsis requirements of FAR Part 5 and Part 8.405-6.

The one-month service allows the agency to complete the necessary background investigations and other administrative matters as part of FEMA security vetting process requirements.
Security guard service is essential for all FEMA office/facility locations which will remain fully operational to support our state, local, tribe and territorial partners.
Region 6 – Texas Recovery Office intends to post this justification Beta.SAM.gov (FBO) and ordering activity web site (if applicable) pursuant to FAR 8.405-6(b)(3)(i)(B).
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. The rate of $44.70 per hour was determined to be fair and reasonable through competition in the original order. The rate per hour will remain the same for the additional one-month of service.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Market Research was conducted using historical data and wage determination records.
Wage determinations were analyzed and there have been no significant changes to the prevailing wages under the Service Contract Act. The rate of $44.70 per hour was determined to be fair and reasonable.
7. Any other facts supporting the justification.
None
8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited sources) before any subsequent acquisition for the supplies or services is made. Include a statement of actions taken or that will be taken to increase competition for future acquisitions of the same item/service (e.g., the government intends to revise overly restrictive technical specifications, acquire data rights, or pursue some other means to increase future competition). Posting requirements may also be addressed here or in #9 below.
