Period of Performance: August 22, 2024 through September 21, 2024.
4. Authority:
Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or
Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).
5. Rationale/explanation to support cited authority: An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:
This contemplated FSS Task Order will provide critical patient care services from an established clinical staffing firm. Ghost Rx, Inc., a verified SDVOSB, is currently providing these critical services for VISN 10 under task orders for VA facilities in Ohio, Michigan, and Indiana as well as other VA Medical Centers. Ghost possesses the capability to respond quickly to Cleveland VA Medical Center’s need. FSS pricing has already been determined fair and reasonable, and is below other current, open market contract pricing identified.
The Cleveland VA Medical Center was recently award a long-term contract for Registered Nurse (RN) services contract with Millbrook Inc that will go into effect 08/22/2024. To ensure there are no gaps in coverage, The Cleveland VAMC requires an emergency 1-month task order to Ghost RX to continue contracted RN services until Millbrook is able to onboard their RNs. The requested emergency extension will ensure that direct patient care services are not adversely impacted and it will allow the Cleveland VA Medical Centers new vendor the time required to onboard new contracted RNs which typically takes between one (1) and two (2) months. Immediate supplemental RN staffing is necessary to provide life-saving care to Veterans.
6. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
