UNITED STATES MARINE CORPS

MARINE CORPS LOGISTICS COMMAND

814 RADFORD BOULEVARD

ALBANY, GEORGIA 31704-0301

MCLC J&A No. 15038

JUSTIFICATION AND APPROVAL FOR

USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Marine Corps Logistics Command Contracts Department (Code MSCD) Albany, GA 31704-0270

2. Description of Action Being Approved.

Award of a contract for commercial supplies on a sole source basis to King Nutronics Corporation, of Woodland Hills CA. The action is in support of Marine Corps Logistics Command, Production Plant Barstow’s Test Measurement & Diagnostic Equipment Division (TMDE).

3. Description of Supplies/Services.

King Nutronics P/N 3689A Precision Pressure Standard with Barometer, (2 Ea.), NSN 4925-01-368- 2092; King Nutronics P/N 3666-10K-3 Automatic Precision Calibration System, C-Model, Strain Gauge, (1 Ea.), NSN 6695-01-387-4127. These supplies are used to test and verify the accuracy of Marine Corps electronic test equipment. Current year Navy Working Capital Funds will be used to purchase the supplies, with an estimated total of $273,668. Delivery is estimated at 120 days after award.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The Statutory Authority permitting other than full and open competition is 10 U.S.C. Section 2304 (c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 Only One Responsible Source and No Other Supplies will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

The King Nutronics Models 3689A and 3666-10K-3 standards are electronic test systems specifically called out by calibration manuals Navair 17-20MP-06, Navair17-20MP-119, Navair17-20MP-15, Navair17-20MP-17, and Navair17-20MP-75 used by the TMDE for testing of various Navy and Marine Corps electronic assets. No alternate standards are listed in the procedure manuals. The 3666-10K-3 is one of the primary pressure standards required for pressure calibrations, and the 3689A is one of the required higher accuracy pressure standards required for more accurate equipment, as well as for the calibration of the 3666-10K-3. King Nutronics Corporation, is the Original Equipment Manufacturer (OEM) of the Precision Pressure Standard with Barometer & Automatic Precision Calibration Systems. No substitute pressure standards are acceptable.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible

A Notice of Intent to purchase these Standards was posted on beta.Sam.gov on December 16, 2020, and no other interested sources responded. Market research indicated that the United States Navy (USN) synopsized requirements for these and other standards via FEDBIZOPS in July 2005. King Nutronics Corporation was found to be the only responsible source for the required standards. Additionally, all recent as well as past market research verifies that King Nutronics Corporation is the only source for the required standards. USN procurement action N64267-19-D-0003 purchased these standards directly from King Nutronics Corporation on a sole source basis.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer determined the anticipated cost/price to the Government of the required units covered by this J&A to be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, Marine Corps Logistics Command Contracts Department has no plans at this time to compete future contracts for the type of supplies covered by this J & A. If another potential supply source emerges, the Command will assess whether competition for future requirements is feasible.
