JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

NATIONAL NUCLEAR SECURITY ADMINISTRATION

OFFICE OF INFORMATION MANAGEMENT AND CHIEF INFORMATION OFFICER TASK

ORDER DE-DT0011585

May 31, 2017

I. AGENCY AND CONTRACTING ACTIVITY

The Office of Information Management and Chief Information Officer (NA-IM) of the U.S.

Department of Energy (DOE), National Nuclear Security Administration (NNSA) plans to contract for Information Technology (IT) Support Services by using an exception to fair opportunity. The contracting activity is the National Nuclear Security Administration (NNSA) Non-M&O Contracting Operations Division, Services Acquisition Branch, Field Program Section, Field Support Team (NA-APM-124.2).

II. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED

This action is to modify an existing Task Order with Chenega Government Consulting, LLC.

The time and materials Task Order, DE-DT0011585, was awarded to Chenega Government Consulting, LLC, 3000 C Street Suite 301, Anchorage, AK 99503-3975 for NA-IM, on July 1, 2016, under the 8(a) STARS II Government-Wide Acquisition Contract (GWAC) with a ceiling price of $5,434,401.99.

The need for the extension of services on DE-DT0011585 with Chenega Government Consulting results from multiple GAO protests of the NNSA’s award of task orders under the IT Infrastructure and Cyber Security (IICS) Blanket Purchase Agreements (BPAs). NNSA awarded task order BPA DE-BP0004824 under one of the BPAs on January 14, 2016. Subsequently, NNSA received a U.S. Government Accountability Office (GAO) protest related to the award. On May 2, 2016, the GAO sustained the protest and the NNSA implemented corrective action and complied with the GAO recommendation by determining that the Original RFQ did not reflect the Government’s current, actual requirements.

On September 6, 2016 Request for Quotation (RFQ) DE-SOL-0010157 was issued under the (IICS) BPA to implement corrective action and comply with the GAO recommendation. RFQ DE- SOL-0010157 closed on September 21, 2016. NNSA awarded task order DE-BP0005594 under one of the BPAs on March 8, 2017. Subsequently, NNSA received a GAO protest related to the award on March 17, 2017, which may take up to 100 days to resolve. A GAO decision is expected no later than June 26, 2017. Until this matter is resolved, Task Order DE-DT0011585 with Chenega Government Consulting will need to be extended to ensure that the NNSA continues to receive these services.

The requirement with Chenega Government Consulting was initially awarded in April of 2015.

There have been multiple extensions to ensure continuity of services until performance of the new task order under the BPA can begin.

Services for an additional six-months will be added as separate Options and Time and Materials Contract Line Items for Labor, NMGRT, ODC and CAF as follows:

Option Period 6, (two-month base period for June 1, 2017 – July 31, 2017) CLIN 00025 (Labor); CLIN 00026 (NMGRT); CLIN 00027 (ODC); CLIN 00028 (CAF)

Option Period 7 (three-month option period for August 1, 2017 – October 31, 2017), CLIN 00029 (Labor); CLIN 00030 (NMGRT); CLIN 00031 (ODC); CLIN 00032 (CAF)

Option Period 8 (one-month option period for November 1, 2017 – November 30, 2017) CLIN 00033 (Labor); CLIN 00034 (NMGRT); CLIN 00035 (ODC); CLIN 00036 (CAF).

III. DESCRIPTION OF SERVICES

Under Task Order DE-DT0011585, Chenega provides information technology services to support the NNSA Office of the Chief Information Officer (OCIO). This work consists of a technical operating environment with:

• Operations Management and Business Support

• Conference and Collaborative Technologies

• Software Engineering

• User Support (Tier 1 and 2)

• Secure Operations

• IT Engineering Support for the New NNSA Albuquerque Complex Building

The price associated with the additional information technology services for the full six-month period is $2,847,504.94 and the ceiling will increase from $5,434,401.99 to $8,281,906.93 as a result of the modification.

IV. EXCEPTION TO FAIR OPPORTUNITY

The authority permitting limited sources as implemented by the Federal Acquisition Regulation (FAR) is Subpart 16.505(b)(2)(i)(C) – The new work is a logical follow on to an original order, and the order was placed in accordance with the fair opportunity process and must not have been issued under sole source or limited sources procedures.

V. JUSTIFICATION FOR USING THE EXCEPTION

Chenega currently provides information technology support to the NNSA OCIO under Task Order DE-DT0011585 and is the only contractor that can continue to provide the required services within the timeframe required. Chenega’s task order expires on May 31, 2017, and the OCIO requires continued support for up to an additional six months until the protest of award DE-BP0005594 for information technology support is resolved. Extending Chenega Task Order DE-DT0011585 is the most economic and efficient method to obtain the required information technology support services because Chenega is currently in place at the various NNSA OCIO locations (Albuquerque, NM, Las Vegas, NV and Washington, DC) and has been performing the work scope since April 2015 under Task Order DE-DT0008965 and DE-DT0010405 June 30, 2016 both were six month bridge contracts. The task order under DE-DT0011585 was completed under the GSA’s Alliance Small Business (ASB) Government-wide Acquisition Contracting (GWAC) in 2016 and all awardees were given a fair opportunity to be considered for the original order, therefore, transferring the required support to another contractor for up to six months would result in duplicative costs incurred by the NNSA for contract transition, and could potentially result in a gap in service. Extending the task order ensures continuity of the critical information technology support services. This modification is a logical follow-on in that it is a continuation of the current information technology work scope that Chenega currently performs.

Under this action, Chenega will continue to perform the current information technology support tasks within the Task Order’s Performance Work Statement (PWS).

VI. CONTRACTING OFFICER DETERMINATION OF BEST VALUE

The Contracting Officer has determined that the price is fair and reasonable based on proposal analysis techniques utilized under FAR 15.404-1. In accordance with FAR 15.404-1(c)(2)(i)(D), the Government relied on the GSA negotiated fully burdened labor rates that were determined fair and reasonable.

VII. MARKET RESEARCH

No market research was conducted. As stated previously, this is a bridge contract to ensure continuity of services until a protest is resolved.

VII. OTHER FACTS

None.

VIII. STEPS TO FOSTER COMPETITION

The follow-on Order RFQ was released and competed under the IT Infrastructure and Cyber Security (IICS) Blanket Purchase Agreement (BPA), and the resulting order, DE-BP0005594 was awarded on March 8, 2017; however, performance of the follow-on Task Order is stayed until the protest is resolved.
