FULL AND OPEN COMPETITION
Attachment M – J&A Guide & Template Version 2.6 Page 2
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304 (A) (X)
Requisition Number: SHOP-PR-24-001479
Date: April 1, 2024
Estimated Contract Dollar Value: $xxxxx
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Professional Services Acquisition Unit (PSAU), has prepared this justification for other than full and open competition for Shaw Shooting to provide advanced firearms training on behalf of the Hostage Rescue Team, Critical Incident Response Group.
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
It is the intent of the PSAU, Finance Division, to acquire a firm fixed price contract for $xxxxx.
The period of performance will be a base plus four option years.
3. A description of the supplies or services required to meet the agency’s needs.
The FBI Hostage Rescue Team (HRT) is seeking a contract for multi-day advanced tactical firearms courses. The estimated cost is $xxxxx per year for 5 years.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1)(or 10 USC 2304(c) (1)) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302- 1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
The training offered at Shaw Shooting was created while collaborating with law enforcement and military special operations personnel over many years. Drawing upon this
Attachment M – J&A Guide & Template Version 2.6 Page 3 background, combined with their nationally recognized achievements in competitive shooting, they have developed a distinctive curriculum focusing on firearms safety, handling, and deployment during high-risk law enforcement operations. The venue offers unparalleled training support to HRT Operators by providing an environment that authentically replicates operational scenarios, including movement and challenges encountered in their area of responsibility, both during daylight and low-light conditions.
Furthermore, Shaw Shooting Institute offers comprehensive on-site support, including lodging, meals, and secure storage for sensitive items, a feature that sets it apart from similar facilities. The remote location of Shaw Shooting ensures that HRT can conduct their training discreetly and privately, enhancing the effectiveness and confidentiality of their exercises. There is no other vendor who is capable of offering training that meets the unique qualifications.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
CIRG/HRT has done numerous online searches and various discussions to identify companies that meet its training objectives outlined for this requirement. Due to the Market Research completed, an RFI was not posted on SAM.gov as it was deemed unnecessary. A Notice of Intent to Sole Source Award will be posted on SAM.gov before award. Any responses will be documented properly.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated dollar amount of the contract is $xxxxx. This is based on informal conversations with other government partners that have successfully utilized the training facility. Once a quote is received from the vendor, the Contracting Officer will conduct a price analysis to determine whether the price is fair and reasonable or not.
8. A description of the market research conducted and the results.
Members of HRT held discussions with several vendors that hold tactical firearm training. The goal of these discussions was to determine whether or not these venues had the facilities to meet the requirements that are in line with the tactical firearms program. Upon completion of these discussions, HRT members met with fellow Government agencies to discuss the differences between the venues, their experiences with each vendor and which companies
Attachment M – J&A Guide & Template Version 2.6 Page 4 were actually capable of meeting the requirements. Lastly, HRT gathered all of the information and completed internet searches to thoroughly look into each vendor and their capabilities.
9. Any other facts supporting the use of other than full and open competition.
Shaw Shooting’s range facility offers ranges that allow operators to shoot under duress, in low light/no light, and inside and outside of vehicles. This capability provides operators the ability to build upon their previous firearms training by utilizing realistic ranges in a dynamic environment in both daylight and low/no-light conditions. The vendor provides an application of training within their facility that meets the requirements for HRT’s advanced firearms training. Additionally, the training will focus on specific operator firearm fundamentals when operating in a low visibility tactical surveillance capacity. After receiving training at Shaw Shooting, HRT operators will have furthered their firearms capability in mission critical conditions. These facts, combined with the on-site lodging and secure storage which Shaw Shooting provides, make this facility the only place to provide HRT with this set of skills training.
10. A listing of any sources that expressed a written interest in the acquisition.
Since the procurement was not advertised for this current base plus four contract, no other companies have expressed an interest either orally or in writing. After the Notice of Intent is posted, the Contracting Officer will document any responses that are received.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
Members of HRT will continue to research various facilities across the United States. They will continually hold discussions with other Law Enforcement Agencies to determine if other vendors are now capable. HRT Operators will continue to review this information to try and remove or overcome any barriers to competition.
