FEDERAL BUREAU OF INVESTIGATION

FINANCE DIVISION | PROCUREMENT SECTION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN

COMPETITION

Requisition Number: SHOP-PR-24-000033 Version 2.2 Page 1

FAR 6.302-1, “ONLY ONE RESPONSIBLE SOURCE AND NO OTHER SUPPLIES OR SERVICES WILL

SATISFY AGENCY REQUIREMENTS”

(Simplified Acquisition <$250K)

Requisition Number: SHOP-PR-24-000033

Date: 13 December 2023

Estimated Contract Dollar Value: _________

1. Identification of the agency and the contracting activity.

The Federal Bureau of Investigation (FBI), Procurement Section (PS), National Acquisition Programs Unit (NAPU) has prepared this justification for other than full and open competition on behalf of the Laboratory Division (LD), Terrorist Explosive Device Analytical Center (TEDAC) Section, TEDAC Improvised Explosives Detection and Synthesis Center (TIEDS) Unit.

2. Nature and/or description of the action being approved.

In accordance with a statutory exception to the fair opportunity process, the FBI contemplates the award of a one-time, sole-source, cost-plus-fixed fee contract (CPFF) to The Johns Hopkins University Applied Physics Laboratory, LLC (JHU/APL), [CAGE Code 88898], 11100 Johns Hopkins Road, Laurel, Maryland, 20723 for two (2) Body Phantom (BP) mannequins.

3. A complete description of the supplies and/or services required to meet the agency’s needs. Provide the estimated total value to complete the work (including any options, if any).

In Fiscal Year (FY) 2012, the U.S. Department of Homeland Security (DHS), Transportation Security Administration (TSA) tasked the JHU/APL with designing and fabricating male and female Body Phantoms. Body Phantoms (BP) are mannequins designed as surrogates for human subjects that elicit a comparable detection response when scanned in active millimeter wave (MMW) Advanced Imaging Technology (AIT) systems. The first MMW BP units were specially designed in a fixed pose, arms up configuration for use with fielded L3 (now Leidos) ProVision ATD and ProVision-2 AIT systems operating in the 24-30 GHz frequency range.

DHS market research identified several common deficiencies of commercial off-the-shelf (COTS) products. Some were anatomically inaccurate or incomplete in their representation of the

Requisition Number: SHOP-PR-24-000033 Version 2.2 Page 2 human body. Others were not free standing or were too heavy. In all cases, however, it was found that none were customized for the unique frequency ranges and penetration depth capabilities of AIT systems. As a result, it was determined that no suitable phantoms existed.

The DHS Science and Technology Directorate (S&T), Transportation Security Laboratory (TSL) supports the maturation, evaluation, and certification of explosives detection technologies. TSL helps the detection equipment industry meet performance requirements established by the Transportation Security Administration (TSA) and other Homeland Security Enterprise (HSE) stakeholders. Two (2) satellite facilities at the Tyndall Reactive Materials Group (TRMG) located in Panama City, FL, and the FBI’s TIEDS Center in Huntsville, AL provide TSL with the capability and flexibility to quickly respond to emerging threats.

The Body Phantom (BP) mannequin can only be purchased through the Johns Hopkins University Applied Physics Laboratory (JHU/APL). The BP is designed for each AIT technology (XRB and MMW). BPs are needed for acquisition testing of AIT used in airport passenger screening. BPs allow for many trials to be performed over extended testing periods compared with human test subjects. The BP will enable testing with sensitive, live explosives at the TIEDS Center in Huntsville, AL. The BP appears sufficiently human to Automated Target Recognition (ATR) algorithms used in AITs. The unique construction of this mannequin is limited to only one

(1) manufacturer.

The vendor shall provide one (1) male Leidos BP unit and one (1) female Leidos BP unit to the TIEDS Center suitable for use with Leidos ProVision ATD and ProVision 2 AIT systems. This will involve 3D printing of the BP using existing computer aided design (CAD) models, (includes current Provision arms up pose). Leveraging recent improvements, this BP unit will also be lighter and easier to handle than previous versions. The body phantom components will be additive manufactured (i.e., 3D printed) and assembled. A special paint coating formulation that has been designed for the 24 to 30 GHz active millimeter wave frequency band will then be applied and allowed to cure.

Commissioning testing of the assembled and painted unit will then be performed to verify no defects. It is understood that commissioning testing will be done at the TSA Systems Integration Facility (TSIF) in Arlington, VA prior to delivery of the unit to TIEDS in Huntsville, AL.

The period of performance (POP) is five (5) months, which is primarily being driven by paint coating material availability.

4. Identification of the exception to fair opportunity and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited.

For purposes of this acquisition, the statutory authority permitting other than full and open competition is delineated at 41 U.S.C. 3304 (a) (1) and implemented at FAR Part 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.”

The BP is solely manufactured by the John Hopkins University Applied Physics Laboratory (JHU/APL). There are no authorized third-party resellers.

In partnership with the Transportation Security Administration (TSA), the TIEDS Center will continue testing Advance Imaging Technology (AIT) systems for explosives and prohibited objects. The JHU/APL has designed and constructed the BP to meet current sensitive security information requirements.

The BP is adapt to the requirements imposed by the AIT 2 System, (e.g. passenger rotation during scan).

The body phantom components will be additive manufactured (i.e., 3D printed), and assembled. A special paint coating formulation that has been designed for the 24 to 30 GHz active millimeter wave frequency band will then be applied and allowed to cure. The unique construction of this item is limited to one (1) manufacturer.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

The JHU/APL is the sole manufacturer and distributor of the Body Phantom (BP) mannequin.

The TSA uses Millimeter Wave Technology Passenger Inspection Systems also known as Advanced Imaging Technology (AIT) at all major U.S. airport checkpoints. Having these two (2) BPs at the FBI’s TIEDS Center simplifies the logistics and shortens the timeframe required to set up and perform AIT Testing and Evaluation (T&E) requested by both the TSL and the TSA.

The mission of the Joint FBI – TSA S&T TIEDS Detection Technology Center in Huntsville, AL is to ensure current and emerging technologies can reliably detect explosives and other threats concealed on a passenger’s body. While at the same time, ensuring that next generation systems can detect the ever-increasing array of homemade explosive threats.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under 5.202 applies.

The FBI will publicize the notice of intent to award a sole-source contract on the SAM.gov website. This announcement will give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of technical capabilities and cost information.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The contracting officer will determine, after considering the level of effort and the mix of skills available for the tasks needed, that the proposed contract action will be fair and reasonable for the FBI.

8. A description of the market research conducted and the results.

Market research revealed that the Johns Hopkins University Applied Physics Laboratory (JHU/APL) is the only manufacturer and reseller of the Body Phantom (BP) mannequin.

Prior to BP development, the JHU/APL polled the body phantom/mannequin industry to understand existing units, materials used, and configurations, as well as to identify commercial off-the-shelf candidates that could be modified or used for structure. The JHU/APL also consulted with AIT manufacturers to develop an understanding of ATR algorithms to ensure that gaps/joints between phantom parts would not cause false alarms, to understand ATR sensitivity to pose, as well as the penetration depth of active MMW systems.

The FBI’s market research was limited to the special unique specifications required by Transportation Security Administration (TSA) of sensitive security requirements. The JHU/APL Body Phantom (BP) mannequin meets the testing standards of the TSA. The configuration/construction of this BP is proprietary technology.

9. Any other facts supporting the use of other than full and open competition.

See section 5 above.

Requisition Number: SHOP-PR-24-000033 Version 2.2 Page 5

10. A listing of any sources that expressed a written interest in the acquisition.

A synopsis will be posted on the SAM.gov website. This synopsis will give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of technical capabilities and cost information.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition if subsequent acquisitions are anticipated.

The FBI will continue to conduct market surveys and research available through industry shows and technology releases in the form of papers and journals on subsequent acquisitions.
