About this file

This is a Request for Quotation (RFQ) issued by the Federal Bureau of Investigation's Finance and Facilities Division for brand-name IT hardware to support the Counterterrorism Division's mission workloads. The FBI seeks firm-fixed-price quotations for 15 Sumuri Talino customized forensic workstations featuring Intel Core Ultra 9 285K processors, liquid cooling, 192GB DDR5 memory, four dedicated 1TB Gen4 M.2 NVMe drives, eight 1TB SSDs in RAID 5, NVIDIA RTX PRO 4000 Blackwell 24GB graphics, ARC-1883i RAID controller, specified hot-swap and USB expansion, 1700W power supply, Windows 11 Pro 64-bit, and a three-year standard warranty. The RFQ is restricted to exact brand-name products only; alternate, substitute, or equivalent products will be deemed technically unacceptable. Quotations must be submitted via email to Ricardo Tiggle (Rtiggle@fbi.gov) by September 17, 2026, at 12:00 PM Eastern Time, with questions due by September 15, 2026, at 12:00 PM ET. Quotes must remain valid through September 30, 2026, and delivery is estimated within 30 calendar days after order receipt, FOB Destination.

The Government intends to make one award using a Lowest Price Technically Acceptable (LPTA) methodology, with evaluation based on three equally weighted factors: Technical Acceptability (pass/fail), Price (completeness and reasonableness), and Procurement Risk Assessment (PRA). The anticipated award date is September 25, 2026. All quoted products must be factory-new, genuine OEM products eligible for manufacturer warranty and support valid in the United States; gray-market, used, refurbished, or reconditioned items are prohibited. Vendors must comply with various FAR/JAR provisions, FBI-specific clauses addressing national security risk assessment, contractor risk assessment, electronic invoicing requirements, organizational conflicts of interest, Section 508 accessibility compliance, and restrictions on non-U.S. citizens accessing DOJ IT systems. The RFQ is issued under NAICS code 541519 (IT Value Added Resellers) with a 150-employee small business size standard, and all prospective awardees are subject to PRA approval before contract award, which may include security clearance and supply-chain risk evaluation without disclosure of specific non-approval rationales.

2. Description of Requirement The FBI requires the exact brand-name commercial IT products identified below to support Counterterrorism Division mission workloads, including digital-media exploitation, forensic processing, and approved on-premises artificial intelligence workloads. The brand-name restriction is supported by Attachment 1, Brand Name Justification.

192GB DDR5 memory, four dedicated 1TB Gen4 M.2 NVMe drives, eight 1TB SSDs in RAID 5, NVIDIA RTX PRO 4000 Blackwell 24GB graphics, ARC-1883i RAID, specified hot-swap and USB expansion, 1700W power, Windows 11 Pro 64-bit, specified chassis characteristics, and a three-year standard warranty.

2.1 Brand Name Only

This RFQ is for brand-name-only products. The Government requires the exact manufacturers, products, models, configurations, quantities, warranty/support, and delivery requirements identified in this RFQ and Attachment 1. Alternate, substitute, equivalent, or “or equal” products will not be considered and will be rated Technically Unacceptable for the applicable award group.

Contract holders may furnish the required products as authorized resellers or distributors, provided the products quoted are the exact brand-name products and configurations required. The Government may require evidence of OEM or reseller authorization, warranty/support eligibility, and product authenticity.

3. Quote Submission Instructions There are no separate quote volumes. A vendor needs only submit a complete quote to rtiggle@fbi.gov.

Late Quotations. Quotations received after September 17, 2026, at 12:00 PM Eastern Time will not be considered for award. Vendors are solely responsible for ensuring that their complete quotation is successfully submitted to rtiggle@fbi.gov before the stated deadline. Transmission problems, internal vendor delays, or failure to complete the QRT submission process before the deadline will not excuse a late quotation.

• For every quoted item, identify the exact manufacturer, product/model, manufacturer part number or SKU (when applicable), configuration, quantity, warranty/support, delivery schedule, unit price, and extended price.

• State that the quoted products are the exact brand-name products required by this RFQ and are new, genuine OEM products eligible for the required OEM warranty/support.

• Certify that all quoted items are factory-new and will be delivered with an OEM/manufacturer warranty valid in the United States. The quote shall not include gray-market, used, refurbished, recertified, reconditioned, demo, open-box, previously owned, or previously placed-in-service products.

• Include all shipping, handling, warranty/support, and other charges in the quoted firm-fixed price.

• State any exception, condition, or assumption. An exception to a material RFQ requirement may render the quote technically unacceptable.

• Quotes shall remain valid through September 30, 2026.

The Government is not responsible for locating information necessary to establish technical acceptability that is not contained in, or clearly identified by, the quote. The FBI may verify product configuration, OEM authorization, warranty eligibility, business size, SAM registration, and other award eligibility information prior to award.

4. Evaluation and Basis for Award The Government intends to make one or more Firm-Fixed-Price (FFP) delivery-order awards using a Lowest Price Technically Acceptable (LPTA) methodology. Each award group will be evaluated separately using three evaluation factors: Technical Acceptability, Price, and Procurement Risk Assessment (PRA). The three evaluation factors are of equal importance. A quote must satisfy all applicable requirements under each factor to be eligible for award.

4.1 Factor 1 – Technical Acceptability

Technical acceptability will be evaluated on a Pass/Fail basis. A quote will be rated Technically Acceptable for an award group only if it demonstrates compliance with all mandatory requirements for that group, including the exact required manufacturer/product, configuration, quantity, warranty/support, delivery requirement, and all other material RFQ terms. A quote offering an alternate manufacturer, substitute product, materially different model, materially different configuration, or “or equal” product will be rated Technically Unacceptable.

4.2 Factor 2 – Price

The evaluated price will include all amounts necessary to furnish and deliver the complete requirement including equipment, configuration, warranty/support, shipping, and all other charges. Among technically acceptable quotes for an award, the Government will identify the lowest evaluated price and determine whether the price is fair and reasonable.

4.3 Factor 3 – Procurement Risk Assessment / National Security Eligibility A Procurement Risk Assessment (PRA) is required before award. The PRA is a mandatory national-security and acquisition-risk eligibility determination and is separate from the technical and price evaluation.

For each award group, after determining technical acceptability and evaluated price, the Government intends to submit the lowest-priced technically acceptable prospective awardee for the required PRA. The prospective awardee shall timely provide all information requested by the FBI to complete the PRA, including acquisition-risk, ownership/control, key-management, source, product, supply-chain, and subcontractor information as applicable.

If the Government determines that the prospective awardee, a proposed source, or the equipment offered presents an unacceptable acquisition or national-security risk, that vendor will be ineligible for award for the applicable award group. Consistent with DOJ-06 and FBI-0011, the FBI will not provide the vendor the specific basis for an unacceptable security-risk determination when disclosure would reveal classified, national-security, law-enforcement-sensitive, supply-chain-risk, or other protected information. The Government will then proceed to the next-lowest-priced technically acceptable quote for that award group and submit that prospective awardee for the required PRA. This process may continue in price order until a prospective awardee receives an acceptable PRA determination or the Government determines that no award will be made for that award group.

A vendor that fails to provide information required to complete the PRA within the time established by the Contracting Officer may be determined ineligible for award.

4.4 Single or Multiple Awards

The Government will issue one purchase order, subject to technical acceptability, fair and reasonable pricing, PRA approval, responsibility, and other award eligibility requirements, to the lowest-priced eligible quote.

4.5 Award Without Exchanges

The Government intends to evaluate quotes and make award based on initial submissions. Vendors should therefore submit their most favorable technical and price quote initially. The Government may conduct clarifications or exchanges when determined necessary but is not obligated to do so.

5. Delivery, Acceptance, Product Authenticity, and Invoicing

• Delivery is estimated within 30 calendar days after receipt of order unless a different delivery schedule is accepted in writing by the Contracting Officer.

• FOB Destination. The delivery location will be identified in the awarded delivery order.

• The contractor shall furnish only new, unused, factory-new, genuine OEM products. All products must be sold through an authorized U.S.-based distribution/reseller channel and must be eligible for, and delivered with, the applicable manufacturer warranty and support that are valid and enforceable in the United States. Gray-market, used, refurbished, recertified, reconditioned, demo, open-box, previously owned, or otherwise previously placed-in-service items are prohibited.

• Acceptance will occur after Government inspection and verification that delivered products conform to the awarded order.

• Invoices shall be submitted in accordance with FBI-0023, Federal Bureau of Investigation Electronic Invoicing Requirement.

7. Clauses and Provisions Incorporated in Full Text

7.1 FAR 52.212-1 Instructions to Offerors—Commercial Products and Commercial Services (SEP 2023) As prescribed in FAR 12.301(b)(1), insert the following provision:

Instructions to Offerors—Commercial Products and Commercial Services (Sep 2023)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees, or 150 employees for information technology value-added resellers under NAICS code 541519, if the acquisition—

(1) Is set aside for small business and has a value above the simplified acquisition threshold;

(2) Uses the HUBZone price evaluation preference regardless of dollar value, unless the offeror waives the price evaluation preference; or

(3) Is an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at Federal Acquisition Regulation (FAR) 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of solicitation amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation.

(1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101–29, and copies of Federal specifications, standards, and product descriptions can be downloaded from the ASSIST website at https://assist.dla.mil.

(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained from the address in paragraph (i)(1)(i) of this provision.

(2) Most unclassified Defense specifications and standards may be downloaded from the ASSIST website at https://assist.dla.mil.

(3) Defense documents not available from the ASSIST website may be requested from the Defense Standardization Program Office by—

(i) Using the ASSIST feedback module (https://assist.dla.mil/feedback); or

(ii) Contacting the Defense Standardization Program Office by telephone at 571-767-6688 or email at assisthelp@dla.mil.

(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.

(j) Unique entity identifier. (Applies to all offers that exceed the micro-purchase threshold, and offers at or below the micro-purchase threshold if the solicitation requires the Contractor to be registered in the System for Award Management (SAM).) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “Unique Entity Identifier” followed by the unique entity identifier that identifies the offeror’s name and address. The offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the offeror to establish additional SAM records for identifying alternative EFT accounts (see FAR subpart 32.11) for the same entity. If the offeror does not have a unique entity identifier, it should contact the entity designated at https://www.sam.gov for unique entity identifier establishment directly. The offeror should indicate that it is an offeror for a Government contract when contacting the entity designated for establishing the unique entity identifier.

(k) [Reserved]

(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.

(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(4) A summary of the rationale for award;

(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful offeror.

(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

(End of provision)

ADDENDUM TO FAR 52.212-1

The following solicitation-specific instructions supplement and, where inconsistent, supersede FAR 52.212-1:

1. Submission method. Quotes shall be submitted through the NASA SEWP Quote Request Tool (QRT) by August 20, 2026, at 12:00 PM Eastern Time. No separate quote volumes are required.

2. Quote validity. In lieu of the 30-day default stated at paragraph (c), quotes shall remain valid through September 30, 2026.

3. Brand-name-only restriction. Paragraph (e) does not authorize alternate, substitute, equivalent, or “or equal” products. Only the exact brand-name products and configurations identified in this RFQ are acceptable.

4. Award group structure. Paragraph (h) is supplemented by Section 4.4 of this RFQ. The Government may make one or multiple awards by disclosed award group.

5. Communications. The Government intends to evaluate quotes and make award based on initial submissions. The Government may conduct exchanges, seek clarifications, or request additional information when determined necessary by the Contracting Officer but is not obligated to do so.

6. Late Quotations. For this RFQ, quotations received after the exact date and time specified for receipt of quotations will not be considered for award. The NASA SEWP QRT timestamp will determine timeliness. Vendors bear the risk of transmission and are responsible for allowing sufficient time to complete submission before the deadline.

7.2 FAR 52.212-2 Evaluation—Commercial Products and Commercial Services (NOV 2021) As prescribed in FAR 12.301(c), the Contracting Officer may insert a provision substantially as follows:

Evaluation—Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award one or more delivery orders resulting from this RFQ using a Lowest Price Technically Acceptable (LPTA) methodology. Each award group will be evaluated separately using the following three evaluation factors, which are of equal importance:

Factor 1 – Technical Acceptability.

Factor 2 – Price.

Factor 3 – Procurement Risk Assessment (PRA).

A quote must satisfy all applicable requirements under all three factors to be eligible for award. Technical Acceptability and PRA will be evaluated on a pass/fail basis. Price will be evaluated for completeness, reasonableness, and ranking among otherwise eligible quotes. For each award group, award will be made to the lowest-priced quote that is technically acceptable, receives an acceptable PRA determination, is otherwise eligible for award, and is determined to offer a fair and reasonable price.

(b) Options. There are no options under this RFQ; therefore, the standard option-evaluation language is not applicable.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

7.3 FAR 52.222-90 Addressing DEI Discrimination by Federal Contractors (APR 2026)

(a) Definitions. As used in this clause— Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations; or similar opportunities that are sponsored or established by the contractor or subcontractor.

Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.

(b) In connection with the performance of work under this contract, the Contractor agrees as follows:

(1) The Contractor will not engage in any racially discriminatory DEI activities;

(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;

(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;

(4) The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer; and

(5) The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause.

(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4).

(c) The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States.

(End of clause)

7.4 DOJ-01 Whistleblower Information Distribution (OCT 2021)

The Contractor shall inform its employees in writing, in the predominant native language of the workforce, of employee whistleblower rights and protections under 41 U.S.C. 4712. The Contractor shall include this requirement in subcontracts over the simplified acquisition threshold. Within 45 days of award, the Contractor shall provide confirmation to the Contracting Officer that it has distributed the whistleblower information as required.

(End of clause)

7.5 DOJ-06 National Security Risk Assessment (APR 2014)

Any Offeror responding to this solicitation acknowledges that the Government is required to procure equipment and software from vendors that do not pose an unacceptable risk to national security, either directly or through any subcontractor at any tier, including risks associated with cyber espionage or sabotage and Foreign Ownership, Control, or Influence (FOCI).

By submitting an offer to this solicitation, the Offeror understands and agrees that the Government retains the right to reject any offer or response to this solicitation made by the Offeror, without any further recourse by, or explanation to, the Offeror, if the Government determines the Offeror or the equipment or software offered by the Offeror, in whole or in part, presents an unacceptable risk to national security.

Offerors will be asked to answer and provide information responsive to acquisition-risk questions to assist the Government in assessing whether the acquisition poses a national security risk. All answers shall be reflective of the parent and subsidiary levels of an organization.

Offerors are also required to request, collect, and forward to the Government answers to these acquisition-risk questions from all subcontractors providing any equipment or software in performance of the contract or order. Offerors are responsible for the thoroughness and completeness of each subcontractor's submission. Failure to provide any such requested information may render a quote unacceptable or the vendor ineligible for award.

(End of provision)

7.6 DOJ-07 Prohibition on Access by Non-U.S. Citizens to DOJ IT Systems (MAR 2002) The Department of Justice does not permit the use of Non-U.S. citizens in the performance of this contract or commitment for any position that involves access to or development of any DOJ Information Technology (IT) system. By signing the contract or commitment document, the contractor agrees to this restriction. In those instances where other non-IT requirements contained in the contract or commitment can be met by using Non-U.S. citizens, those requirements shall be clearly described.

(End of clause)

7.7 FBI-0011 Provision for Contractor Risk Assessment (OCT 2024) The Government intends to secure services or purchase supplies from firms which are not deemed to be an acquisition risk. The Government reserves the right to contract with such Offerors under appropriate arrangements, when it determines that such contract will be in the best interest of the Government.

Offerors selected for PRA review are required to answer the acquisition-risk questions requested by the FBI. All answers are to be reflective of the parent and subsidiary levels of an organization. Offerors are responsible for the thoroughness and completeness of any required subcontractor submission.

Responses shall specify, where necessary, the identity, nature, degree, and impact of any Foreign Ownership, Control, or Influence (FOCI) on the organization or its activities, or the organization or activities of a subcontractor.

The Offeror shall submit, when requested, a Key Management Personnel Listing (KMPL) and FBI supplemental acquisition-risk questionnaire. The KMPL shall identify corporate management personnel by full legal name, position, date/place of birth, and citizenship status.

Any Offeror responding to this RFQ acknowledges the Government's requirement to secure services or equipment from firms which are not an acquisition risk; are not under FOCI; or where any FOCI, in the opinion of the Government, does not adversely impact national security or security requirements.

The Offeror understands and agrees that the Government retains the right to reject any response to this RFQ made by the Offeror, without any further recourse by or explanation to the Offeror, if the acquisition risk for that Offeror is determined by the Government to be an unacceptable security risk.

The risk-assessment process will vary depending on the acquisition type and proposed source, available risk-mitigation measures, and the information/justification provided by the Offeror. Risk assessments will be made on a case-by-case basis.

If an unacceptable security risk is determined, the Government retains the right to reject the source or require appropriate risk-mitigation measures. If a source is not approved, classified, national-security, law-enforcement-sensitive, supply-chain-risk, or other protected information will not be disclosed to the Offeror as part of the Government's rationale for non-approval.

The Offeror may not seek reimbursement from the Government for costs associated with responding to this RFQ or a PRA request as a result of a non-approval decision.

The FBI requires that contractors shall not divulge, publish, or disclose information or produce material related to the contract award, or acquired in or derived from the performance of their duties without prior written consent of the FBI.

For purposes of this clause, “Information” includes, but is not limited to, written or spoken language or recordings made public, including websites or social-media platforms; publications, studies, books, and theses; photographs and videos/films; and public announcements and press releases describing any part of the subject matter of this order or any phase of any program hereunder, except to the extent such information is already known to the Contractor prior to commencement of the order or is required by law, regulation, subpoena, Government order, or judicial order to be disclosed, including the Freedom of Information Act.

No release of information shall be made without prior written consent of the FBI Office of Public Affairs and/or the Contracting Officer. 7.12 FBI-0030 Organizational Conflict of Interest (OCT 2024)

8. FBI Addendum to Evaluation – PRA Sequencing For clarity, the PRA process does not change the disclosed LPTA evaluation methodology. Technical acceptability and price will first be evaluated for each award group. The PRA is then applied as a mandatory preaward eligibility/security gate to the apparent lowest-priced technically acceptable prospective awardee for that group.

If the apparent successful vendor does not receive an acceptable PRA determination, that vendor will not be eligible for award for the applicable group, and the FBI will evaluate the next-lowest-priced technically acceptable vendor for PRA eligibility. The FBI may repeat this process in ascending evaluated-price order. The FBI will not disclose classified or protected national-security, law-enforcement-sensitive, or supply-chain-risk information underlying an adverse PRA determination.
