About this file
This is a Justification and Approval (J&A) document for a sole-source contract award by the Federal Bureau of Investigation (FBI) to procure marina boat slip rental services.
The FBI's Finance and Facilities Division seeks to award a Firm-Fixed-Price contract to Harbour Towne Marina LLC (doing business as Harbour Towne Marina, located at 801 NE 3rd Street, Dania Beach, Florida 33004) for the rental of a commercial marina boat slip. The estimated contract value is $38,136.00 for a one-year period of performance from September 29, 2026, through September 28, 2027. The required marina must accommodate a 34-foot rigid hull inflatable boat (RHIB) with minimum water depth of four feet at low tide, provide continuous electrical shore power, potable water service, controlled facility access, 24-hour video surveillance, on-site fuel station, boat launch and recovery ramp capability, and unrestricted access to the Atlantic Ocean without bridge restrictions. These capabilities are essential for the Miami Division Underwater Search and Evidence Response Team (USERT) to maintain operational readiness for time-sensitive evidence recovery and law enforcement missions. Market research identified that Harbour Towne Marina is the only known responsible source capable of meeting all minimum operational and technical requirements within the required 20-mile geographic proximity to the Miami Field Office, as other marinas either lacked available slips during the performance period or could not satisfy all operational requirements. The FBI intends to publish a Notice of Intent to Sole Source on SAM.gov for a minimum of ten calendar days to allow any responsible source to submit capability statements. Price reasonableness will be determined through price analysis comparing historical rates, current commercial marina rental rates for similarly sized slips, contractor published pricing, and market research conducted during acquisition planning.

Update: 06/22/2026
Justification for Other than Full and Open Competition in Accordance With 41 U.S.C. 3304 (a) Authority: 41 U.S.C.3304(a)(1)
Requisition Number: SHOP-PR-26-002210
Title: MIAMI USERT BOAT SLIP RENTAL 2026 Date: 07/20/2026 Estimated Contract Dollar Value: $38,136.00
1. Identification of the agency and the contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Finance and Facilities Division, Procurement Section, has prepared this Justification for Other Than Full and Open Competition on behalf of the Miami Division Underwater Search and Evidence Response Team (USERT) for the acquisition of commercial marina boat slip rental services.
2. The nature and/or description of the action being approved, i.e. sole source, limited competition, establishment of a new source, etc.
The Federal Bureau of Investigation (FBI) intends to award a sole-source Firm-Fixed-Price (FFP) contract to Harbour Towne Marina LLC, doing business as Harbour Towne Marina, for the rental of a marina boat slip to support the operational requirements of the Miami Division Underwater Search and Evidence Response Team (USERT).
The anticipated period of performance is September 29, 2026, through September 28, 2027, with a total estimated value of $38,136.00.
The proposed contractor is:
Harbour Towne Marina LLC
DBA Harbour Towne Marina
801 NE 3rd Street
Dania Beach, Florida 33004
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value)
Procurement Section Format
The FBI requires the rental of a commercial marina boat slip capable of supporting the operational readiness of the Miami Division USERT vessel. The required marina must:
• Accommodate a 34-foot rigid hull inflatable boat (RHIB);
• Maintain a minimum water depth of four (4) feet at low tide;
• Provide continuous electrical shore power compatible with the vessel's onboard systems;
• Provide potable water service;
• Maintain controlled access to the marina and boat slips;
• Provide twenty-four (24) hour video surveillance;
• Have an on-site fuel station;
• Have an on-site boat ramp capable of supporting launch and recovery operations; and
• Provide unrestricted access to the Atlantic Ocean without bridge restrictions that would delay emergency deployment.
These services are essential to ensure the Miami Division USERT maintains immediate operational readiness for underwater evidence recovery, search, rescue support, and other law enforcement missions.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.103-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate that the proposed contractor’s unique qualifications or the nature of the acquisition requires using the authority cited.
Harbour Towne Marina is the only known responsible source capable of meeting all of the FBI's minimum operational and technical requirements.
The Miami Division USERT maintains a specialized 34-foot operational response vessel that must remain in a continuously deployable status. Mission requirements necessitate immediate access to the Atlantic Ocean to support time-sensitive evidence recovery and other law enforcement operations.
The required marina must be located within approximately twenty (20) miles of the Miami Field Office to support rapid personnel response while minimizing delays associated with South Florida traffic congestion. Additionally, the marina must provide unrestricted access to open water without requiring passage beneath fixed bridges. Due to the vessel's height, the mast cannot safely clear many bridges without drawbridge operation. Reliance on drawbridge openings would introduce unpredictable delays that could significantly impact mission response times.
Procurement Section Format
Harbour Towne Marina uniquely satisfies all minimum operational requirements, including vessel size accommodation, adequate water depth, electrical shore power, potable water, controlled facility access, twenty-four-hour video surveillance, on-site fueling capability, boat launching facilities, and unrestricted ocean access.
Market research determined that other marinas within the required geographic area either lacked available slips during the required performance period or could not satisfy all operational requirements.
Consequently, no other known source can presently satisfy the Government's minimum needs.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will not be publicized as required by Subpart 5.1 and, if not, which exception under 5.101 applies.
The requiring activity conducted comprehensive market research through internet searches, direct contact with commercial marinas, and in-person site visits within the Dania Beach, Florida area.
In accordance with FAR 5.201 and FAR 5.203, the Government intends to publish a Notice of Intent to Sole Source, together with this Justification, on SAM.gov for a minimum of ten (10) calendar days. Any responsible source believing it can satisfy the Government's requirements may submit a capability statement demonstrating its ability to meet all minimum technical and operational requirements.
Capability statements received will be evaluated solely to determine whether competition is available for this acquisition.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
Prior to award, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 15.404-1(b).
Price reasonableness will be established through price analysis using one or more of the following techniques:
• Comparison with historical prices previously paid for the same or substantially similar marina slip rental services;
• Comparison with current commercial marina rental rates for similarly sized slips in the local geographic market;
• Evaluation of the contractor's published commercial pricing, when available; and
• Comparison with market research conducted during acquisition planning.
Procurement Section Format
Based upon preliminary market research, the proposed annual rental price of $38,136.00 appears consistent with prevailing commercial rates for comparable marina facilities offering similar operational capabilities and security features.
8. A description of the market research conducted and the results.
Market research was conducted through internet research, telephone inquiries, and in-person visits to commercial marinas capable of supporting the Government's operational requirements.
Potential sources were evaluated using the following criteria:
• Geographic proximity to the Miami Field Office;
• Slip availability;
• Ability to accommodate a 34-foot vessel;
• Minimum water depth;
• Unrestricted access to the Atlantic Ocean;
• Electrical shore power;
• Potable water service;
• On-site fueling capability;
• Boat launching facilities;
• Controlled access; and
• Twenty-four-hour security surveillance.
Results of the market research include:
1. Harbour Towne Marina - Meets all operational and technical requirements and has an available slip during the required period of performance.
2. Royal Palm Marina - No slips available during the required performance period.
3. Cozy Cove Marina - No slips available during the required period of performance.
Based upon the market research conducted, Harbour Towne Marina is the only known source capable of satisfying the Government's minimum requirements during the required performance period.
9. Any other facts supporting the use of other than full and open competition.
The operational readiness of the Miami Division USERT depends upon maintaining its response vessel in a continuously deployable condition.
Relocating the vessel to a marina that does not provide unrestricted ocean access, or that is located significantly farther from the Miami Field Office, would increase deployment times, reduce operational responsiveness, and adversely affect the FBI's ability to conduct time-sensitive underwater evidence recovery missions.
Procurement Section Format
Trailering and launching the vessel on an as-needed basis is not operationally practical due to the vessel's size, personnel requirements, traffic congestion, launch preparation time, and mission response requirements.
Award to Harbour Towne Marina will ensure uninterrupted operational capability while meeting all established mission requirements.
10. A listing of any sources, if any, that expressed a written interest in the acquisition.
As of the date of this justification, no responsible sources have expressed written interest in this acquisition. Any capability statements received in response to the Notice of Intent posted on SAM.gov will be evaluated to determine whether competition exists for this requirement.
11. A statement of any actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition of the supplies or services required.
Prior to any future acquisition, the requiring activity and Contracting Officer will conduct updated market research to identify additional commercial marinas capable of satisfying the Government's minimum operational requirements. The FBI will continue to monitor commercial availability and market conditions in an effort to maximize competition whenever practicable.
