About this file

This is a Justification and Approval (J&A) document for a sole-source federal contract with the Federal Bureau of Investigation (FBI) Miami Procurement Unit.

The FBI Miami SWAT Team requires a complete integrated mast system for its Mobile Tactical Operations Center (MTOC) to enhance tactical law enforcement operations and critical incident response. The requirement includes procurement and installation of a Will-Burt Inflexion 4.5-meter low-profile, fold-down pneumatic telescoping mast; a Will-Burt PositionIt PI-75 motorized pan-and-tilt positioner; and a custom mounting plate designed to support both an FBI repeater antenna and a tactical pan-tilt-zoom camera. The acquisition also encompasses all shipping, installation, integration, testing, and commissioning services to ensure full operational capability. The estimated contract value is $23,440.91 with a firm-fixed-price structure and anticipated performance period from September 1, 2026 through September 30, 2026. Ten-8 Fire & Safety was identified as the sole source capable of providing the complete integrated solution, as it is the only authorized Will-Burt U.S. Service Center within the operationally required 50-mile service radius from the FBI Miami Field Office. The 50-mile geographic limitation was established based on logistical constraints associated with transporting the MTOC, including vehicle downtime, personnel availability, and travel time through congested metropolitan areas. Market research confirmed that while multiple vendors could supply equipment alone, only Ten-8 Fire & Safety could provide manufacturer-authorized installation combined with equipment procurement in a single contract, which is essential to preserve the manufacturer's warranty and ensure proper system reliability. The contracting officer determined the proposed price of $23,440.91 is fair and reasonable based on market research and price analysis. The procurement authority cited is 41 U.S.C. 3304(a)(1) and FAR Subpart 6.103-1, permitting sole-source acquisition when only one responsible source can satisfy agency requirements.

JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN

FULL AND OPEN COMPETITION

Attachment M – J&A Guide & Template <Requisition Number>

Procurement Section Format Update: 06/22/2026

Justification for Other than Full and Open Competition in Accordance With 41 U.S.C. 3304(a)(1)

Requisition Number: SHOP-PR-26-002068

Title: Miami SWAT MTOC Antenna Date: 07/20/26 Estimated Contract Dollar Value: $23,440.91

1. Identification of the agency and the contracting activity.

The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Miami Procurement Unit, has prepared this Justification for Other than Full and Open Competition for Miami SWAT MTOC Antenna on behalf of the SWAT Team, Miami.

2. The nature and/or description of the action being approved, i.e. sole source, limited competition, establishment of a new source, etc.

It is the intent of the Miami Procurement Unit, in support of the FBI Miami SWAT Team, to award a Firm-Fixed-Price (FFP) sole-source contract to Ten-8 Fire & Safety for the procurement, integration, installation, and testing of a Will-Burt Inflexion 4.5-meter telescoping mast system and associated equipment for the Miami SWAT Mobile Tactical Operations Center (MTOC). The anticipated period of performance is 1 September 2026 through 30 September 2026.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The Federal Bureau of Investigation (FBI) Miami SWAT Team requires an integrated mast system to enhance the operational capabilities of its Mobile Tactical Operations Center (MTOC) during tactical law enforcement operations, critical incidents, and other mission-essential deployments. The system will provide an elevated platform to simultaneously support tactical communications and surveillance capabilities, enabling reliable communications interoperability and enhanced situational awareness in support of FBI operations.

The requirement includes the procurement and installation of a Will-Burt Inflexion 4.5-meter low-profile, fold-down pneumatic telescoping mast, a Will-Burt PositionIt PI-75 motorized pan-and-tilt positioner, and a custom mounting plate designed to simultaneously support the FBI's repeater antenna and a rugged, high-zoom pan-tilt-zoom (PTZ) tactical camera. The acquisition also includes all required shipping, installation, integration, testing, and commissioning services necessary to ensure the system is fully operational and installed in accordance with the manufacturer's specifications.

Procurement Section Format

The estimated total value of this requirement, including equipment, shipping, installation, and associated labor, is $23,440.91. The anticipated period of performance is September 1, 2026, through September 30, 2026.

4. The statutory authority permitting other than full and open competition.

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.103-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” Agencies may contract without providing for full and open competition when the supplies or services required by the agency are available from only one responsible source and no other type of supplies or services will The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1), as implemented by Federal Acquisition Regulation (FAR) Overhaul 6.103-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements."

This authority permits the Government to use other than full and open competition when the supplies or services required are available from only one responsible source and no other supplies or services will satisfy the Government's minimum requirements.

As described in this justification, the Government has determined that only Ten-8 Fire & Safety can provide the complete integrated solution required for this acquisition, including the procurement, installation, integration, and manufacturer-authorized installation of the Will-Burt Inflexion 4.5-meter mast system while preserving the manufacturer's warranty and meeting the FBI's operational requirements. Accordingly, the use of the authority at 41 U.S.C. 3304(a)(1) and FAR Overhaul 6.103-1 is appropriate.

5. Demonstrate that the proposed contractor’s unique qualifications or the nature of the acquisition requires using the authority cited.

The Government's minimum requirement is for a contractor capable of providing the complete procurement, manufacturer-authorized installation, integration, testing, and commissioning of the Will- Burt Inflexion 4.5-meter telescoping mast system for the FBI Miami SWAT Mobile Tactical Operations Center (MTOC). To ensure proper installation, maintain system reliability, and preserve the manufacturer's warranty, the mast system must be installed in accordance with the manufacturer's specifications by an authorized Will-Burt U.S. Service Center.

As part of its market research, the Government contacted all five (5) vendors identified through the

FBI Strategic Tactical Equipment Acquisition List (STEAL) platform that were capable of supplying the required equipment. In addition, the Government conducted online research to identify authorized Will- Burt U.S. Service Centers capable of providing both the required equipment and manufacturer-authorized installation services.

Procurement Section Format

The requiring activity established a 50-mile service radius from the FBI Miami Field Office as the maximum practical distance for installation services. This geographic limitation was based on operational and business considerations associated with transporting the Mobile Tactical Operations Center. Delivery and retrieval of the MTOC requires a minimum of two Government employees and two Government vehicles. Expanding the service area beyond 50 miles would significantly increase travel time through the heavily congested Miramar, Miami, and Fort Lauderdale metropolitan areas, resulting in increased labor hours, fuel costs, administrative burden, vehicle downtime, and reduced personnel availability for mission support. Accordingly, limiting the search to authorized service providers within a 50-mile radius represents the Government's minimum practical requirement for this acquisition.

Based on the results of the Government's market research, Ten-8 Fire & Safety was identified as the only authorized Will-Burt U.S. Service Center the Government was able to locate within the required 50-mile service area that could provide the complete solution, including procurement of the required mast system, manufacturer-authorized installation, system integration, testing, and commissioning under a single acquisition.

Although multiple vendors were capable of providing quotations for the Will-Burt mast system, the

Government did not identify another vendor within the required geographic service area capable of providing the complete integrated solution while meeting the Government's requirement for manufacturer-authorized installation. Procuring the equipment and installation separately would require multiple contractual actions, increase contract administration, introduce schedule and integration risks, and could jeopardize the manufacturer's warranty if installation is not performed in accordance with the manufacturer's requirements.

Based on the Government's documented market research and the operational requirement for a complete, manufacturer-authorized installation within the established geographic service area, Ten-8 Fire & Safety is the only responsible source identified that can satisfy the Government's minimum requirements.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will not be publicized as required by Subpart 5.1 and, if not, which exception under 5.101 applies.

The Government conducted market research in accordance with FAR Overhaul Part 10 to identify potential sources capable of satisfying the FBI's minimum requirements. As part of this effort, the Government reviewed the FBI Strategic Tactical Equipment Acquisition List (STEAL) platform and contacted all five (5) vendors identified as capable of supplying the required equipment to determine their ability to provide the required Will-Burt mast system, manufacturer-authorized installation, and system integration.

Procurement Section Format

In addition to contacting vendors on the FBI STEAL platform, the Government conducted online research to identify authorized Will-Burt U.S. Service Centers capable of providing both the required equipment and manufacturer-authorized installation services within the 50-mile service radius established by the requiring activity. The 50-mile geographic limitation was based on the operational and logistical considerations associated with transporting the Miami SWAT Mobile Tactical Operations Center (MTOC), including vehicle downtime, personnel availability, travel time through the Miramar, Miami, and Fort Lauderdale metropolitan areas, and the additional Government costs associated with transporting the vehicle beyond the established service area.

The Government's market research determined that although multiple vendors could provide quotations for the required Will-Burt mast system, Ten-8 Fire & Safety was the only authorized Will-Burt U.S. Service Center the Government was able to identify within the required geographic service area that could provide the complete acquisition, including procurement, manufacturer-authorized installation, system integration, testing, and commissioning.

Because the Government's market research did not identify another responsible source capable of satisfying the Government's minimum requirements, soliciting additional sources was not expected to result in increased competition. Therefore, the Government concluded that Ten-8 Fire & Safety is the only responsible source capable of meeting the FBI's requirements under the authority of 41 U.S.C.

3304(a)(1) and FAR Overhaul 6.103-1.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer has determined that the anticipated price of $23,440.91 is fair and reasonable.

Price reasonableness was determined through market research and a price analysis of the proposed acquisition. The Government contacted all five (5) vendors identified through the FBI Strategic Tactical Equipment Acquisition List (STEAL) platform and evaluated commercially available sources capable of providing the required equipment. The Government also conducted online research to identify authorized Will-Burt U.S. Service Centers capable of providing the required manufacturer-authorized installation and system integration. Although multiple vendors were capable of providing quotations for the required mast system, the Government identified only one responsible source capable of providing the complete integrated solution within the established 50-mile service area.

The proposed price includes the procurement of the Will-Burt Inflexion 4.5-meter telescoping mast system, the PositionIt PI-75 motorized pan-and-tilt positioner, the custom mounting plate, shipping, manufacturer-authorized installation, system integration, testing, commissioning, and all associated labor necessary to deliver a fully operational system. The Contracting Officer evaluated the proposed

Procurement Section Format pricing to ensure it was consistent with the scope, complexity, and commercial nature of the requirement.

Based on the results of the market research and price analysis, the Contracting Officer determined that the proposed price is fair and reasonable and represents an appropriate expenditure of Government funds for the acquisition.

8. A description of the market research conducted and the results.

The Government conducted market research in accordance with FAR Overhaul Part 10 to identify potential sources capable of satisfying the FBI Miami SWAT Team's requirement for a complete, manufacturer-authorized mast system installation. Market research included reviewing commercially available sources, conducting online research to identify authorized Will-Burt U.S. Service Centers, and contacting all five (5) vendors identified through the FBI Strategic Tactical Equipment Acquisition List (STEAL) platform that were capable of supplying the required equipment.

The requiring activity established a 50-mile service radius from the FBI Miami Field Office as the maximum practical distance for installation services. This geographic limitation was based on operational and logistical considerations associated with transporting the Mobile Tactical Operations Center (MTOC).

Transporting the vehicle requires a minimum of two Government employees and two Government vehicles. Expanding the service area beyond 50 miles would increase travel time through the Miramar, Miami, and Fort Lauderdale metropolitan areas, resulting in additional labor hours, fuel costs, administrative burden, vehicle downtime, and reduced personnel availability for mission support.

The Government's market research determined that multiple vendors could provide quotations for the required Will-Burt mast system. However, the Government identified Ten-8 Fire & Safety as the only authorized Will-Burt U.S. Service Center it was able to locate within the established 50-mile service area that could provide the required equipment, manufacturer-authorized installation, system integration, testing, and commissioning under a single acquisition.

The results of the market research support the determination that no other responsible source identified during the Government's market research could satisfy the FBI's minimum requirements.

Accordingly, the Contracting Officer determined that the use of other than full and open competition under 41 U.S.C. 3304(a)(1) and FAR Overhaul 6.103-1 is appropriate.

9. Any other facts supporting the use of other than full and open competition.

Obtaining this requirement through full and open competition would not be in the Government's best interest because the Government's market research did not identify another responsible source capable of providing the complete procurement, manufacturer-authorized installation, system

Procurement Section Format integration, testing, and commissioning of the required Will-Burt Inflexion 4.5-meter mast system within the operationally required 50-mile service area.

Although multiple vendors were capable of supplying the required mast system, the Government identified only Ten-8 Fire & Safety as an authorized Will-Burt U.S. Service Center within the established geographic service area that could provide the complete integrated solution under a single contract.

Awarding separate contracts for the equipment and installation would increase contract administration, create additional coordination and integration requirements, and increase the risk of schedule delays. In addition, installation by a non-authorized service provider could jeopardize the manufacturer's warranty and increase the risk of improper installation, potentially affecting the operational reliability of the Mobile Tactical Operations Center (MTOC).

The Miami SWAT MTOC is a mission-critical asset that supports tactical operations, emergency response, and other law enforcement missions requiring reliable communications and enhanced situational awareness. Delays associated with conducting a competitive acquisition that cannot satisfy the Government's minimum requirements, or with coordinating multiple contractors to complete the installation, would unnecessarily delay deployment of the enhanced operational capability and increase operational and administrative risk without providing a corresponding benefit to the Government.

Based on the results of the Government's market research and the operational requirements of the

FBI Miami Field Office, the use of other than full and open competition represents the most effective means of satisfying the Government's minimum requirements while ensuring timely delivery, manufacturer-authorized installation, and reliable operational performance.

10. A listing of any sources, if any, that expressed a written interest in the acquisition.

Since the procurement was not advertised, no other companies have expressed an interest either orally or in writing

11. A statement of any actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

The Government will continue to conduct market research before future acquisitions to identify additional responsible sources capable of satisfying the FBI's minimum requirements. Future market research will include reviewing commercially available sources, identifying newly authorized Will-Burt

U.S. Service Centers, and evaluating whether additional vendors are capable of providing the required equipment, manufacturer-authorized installation, system integration, testing, and commissioning.

Procurement Section Format

The Government will also continue to assess whether changes in the commercial marketplace or manufacturer-authorized service network increase the availability of qualified sources within the operational service area. If additional responsible sources become available that can satisfy the

Government's minimum requirements, the Government will pursue competition to the maximum extent practicable.

This justification is based solely on the market conditions and operational requirements that exist at the time of this acquisition. The Government will reassess its requirements and the availability of qualified sources prior to any subsequent acquisition to determine whether the use of full and open competition is appropriate.
