4. Developer warrants and represents that if any funds other than federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or any employee of a Member of Congress in connection with this Agreement, Developer shall complete and submit HUD Standard Form-LLL, “”Disclosure Form to Report Lobbying”, in accordance with its instructions.

HOME BUYER REQUIREMENTS

1. Household Income. The HOME Program has income targeting requirements for Home-assisted projects. Therefore, a family’s income eligibility is determined by determining the family’s annual income. Accordingly, the Developer shall initially determine the income of each applicant in accordance with the 2013 rule amending 24 CFR §92.203(a) (1) (i) and (a)(2).

2. Home buyer Underwriting. All home buyers must obtain first mortgages from a mortgage lender.

To further increase the affordability of the home purchase, the Developer must provide additional direct financial assistance to the home buyers from the HOME funds awarded under this agreement.

This direct financial assistance cannot be the lessor of $1,000 and shall not exceed $40,000.

The Developer will ensure that all purchasers complete a pre-purchase/home buyer education course through a HUD- approved Agency.

3. Affordability Periods. The Developer will ensure that its CHIP-assisted homeowner adheres to the affordability requirement based on the amount of home buyer subsidy. The Developer will advise each applicant of the HOME provisions in 24 CFR Part 92. If at any time the homeowner no longer meets the affordability requirements, the property will be deemed to be in default and subject to recapture, via the Security Deed and Promissory Note.

4. Recapture Provisions. The Developer agrees to enforce the Recapture Provisions requirements of 24 CFR §92 for the CHIP-Assisted Unit(s). The home must be the principal residence of the home buyer for the duration of the amount invested and compliance with this requirement will be verified by the State Recipient or Sub-recipient annually. The method of verification will include letters sent to the homeowners verifying that they continue to occupy the property as their principal residence.

The Developer agrees the period of affordability is based upon the HOME funds invested per unit which are subject to recapture. The Developer agrees that the income eligible homeowners will be made aware of this affordability provision. If this process is not adhered to, the Developer will be responsible for the HOME loan and repay the County back the remaining funds once the default occurs.

5. Enforcement of the Agreement. The Developer will restrict the use of the property by recording a Security Deed and Promissory Note in form and with the same content as that executed under even date herewith.

In WITNESS WHEREOF, GHFA and the Developer have executed this Addendum to the Grant Agreement as of the day and year first above written.

Description of Scope of Work (edit as needed to meet your program requirements)

GHFA has entered into a written agreement with the State Recipient/sub-Recipient to build new affordable homes on vacant land. The State or Sub-Recipient will act the Developer for the construction of the homes. The homes will be sold to income eligible applicants.

The single family units will include but are not limited to energy standards and visitability efficiencies and will meet the property standards as prescribed by CHIP program requirements.

TIMELINE

Below is an example of tasks to be completed. The tasks can be adjusted to meet your development requirements and timeline.

CHIP funds must be committed and spent in a timely manner. In compliance with HOME requirements, a project should be closed and funds drawn within 4 years of funding commitment, or the project will be canceled by HUD. The below milestones are current estimates; the Developer agrees to use its best efforts to adhere to this to the greatest extent possible. If the Developer cannot meet certain deadlines, the Developer will submit an extension request in writing for CHIP consideration and approval.
