Description of Requirement
Ground maintenance will be performed on approximately five (5) acres of land in a manner that will maintain a healthy grass, trees, shrubs, and plants. The grounds will present a clean, neat, and professional appearance. Except for items listed under the Government Furnished Property, the contractor shall furnish all labor, supplies, materials, equipment, transportation, incidentals, and supervision necessary to perform lawn services in accordance with the terms, specifications, and provisions of this contract. All lawn supplies used for this contract will be in accordance with the Sustainable Acquisition Policy (FAR 23.1).
The site consists of approximately five (5) acres of land containing a Laboratory, FSAC Bldg., Headhouse/Greenhouse, four smaller structures, and a nursery bed. See Attachment 02-Site Map for more details.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 7 calendar days of the contract expiration date.

(a) Definitions. As used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.

(d) Representation. The Offeror represents that—
(1) It ☐will, ☐will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds “will” in paragraph (d)(1) of this section; and

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
• PAST PERFORMANCE
• PRICE
(b) Options. As part of price evaluation, the government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one half of the offeror’s final option period price to the offeror’s total price (base and four option periods). Thus, the offeror’s total price for the purpose of evaluation will include the base year, 1st option and 2nd option period, 3rd option period, 4th option period, and ½ of the 4th option period price. Offerors are not required to enter a price for the potential six-month extension period.
BASIS FOR CONTRACTACT AWARD.
This is a competitive best value acquisition utilizing simplified acquisition procedures in accordance with FAR Part 13. By submission of its offer, and the offeror acceding to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, they will be determined technically acceptable. All such offers shall be treated equally except for their prices and performance records. Failure to meet a requirement may result in an offer being determined technically unacceptable. Offerors must clearly identify any exception to the solicitation terms and conditions. Any exception taken must include a complete accompanying rationale.
The evaluation process shall proceed as follows:
A. Initially, technically acceptable offers shall be ranked according to price, including all option prices. The price evaluation will document for the offers evaluated under the following subparagraph B, the reasonableness and affordability of the proposed total evaluated price.
B. Using questionnaires, the contracting officer shall seek relevant performance information on the five (5), lowest priced technically acceptable offerors based on (1) the past and present efforts provided by the offeror and (2) data independently obtained from other government and commercial sources. Past performance must be recent and relevant.
Recent past performance must include performance that occurred within three (3) years of the solicitation issuance date.
Relevant performance includes performances of efforts involving grounds maintenance services similar to the dollar value and complexity of this solicitation.
The purpose of the past performance evaluation is to allow the government to assess the offeror’s ability to perform the effort described in this solicitation, based on the offer’s demonstrated present and past performance. The assessment process will result in an overall performance confidence assessment of High Confidence, Significant Confidence, Satisfactory Confidence, Unknown Confidence, Little Confidence, or No Confidence, as defined below:
HIGH CONFIDENCE: Based on the offeror’s performance record, the government has high confidence the offeror will successfully perform the required effort.
SIGNIFICANT CONFIDENCE: Based on the offeror’s performance record, the government has significant confidence the offeror will successfully perform the required effort.
SATISFACTORY CONFIDENCE: Based on the offeror’s performance record, the government has confidence the offeror will successfully perform the required effort.
UNKNOWN CONFIDENCE; No performance record is identifiable.
LITTLE CONFIDENCE: Based on the offeror’s performance record, substantial doubt exists that the offeror will successfully perform the required effort.
NO CONFIDENCE: Based on the offeror’s performance record, extreme doubt exists that the offeror will successfully perform the required effort.
C. In evaluating past performance, the government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this solicitation.
D. If the lowest priced evaluated offer is judged to have a High Confidence performance assessment, that offer represents the best value for the government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers.
E. If the lowest priced offeror is not judged to have a High Confidence performance confidence assessment, the next lowest offeror will be evaluated, and the process will continue (in order by price) until the 5th lowest priced technically acceptable offer has been evaluated. Affordability may be controlling in circumstances where two or more offers are evaluated for past performance and the superior offeror is at a cost that the Government cannot afford.
F. Offerors are cautioned to submit sufficient information and, in the format, specified. Offerors may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that support a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system.
BASED ON THE ABOVE OUTLINED EVALUATION APPROACH PAST
PERFORMANCE, PRICE REASONABLENESS, AND AFFORDABILITY, MAY NOT BE
EVALUATED FOR ALL OFFERORS.
THE GOVERNMENT RESERVES THE RIGHT TO AWARD TO OTHER THAN THE LOW
OFFEROR.
