About this file

This is Amendment 0001 to Solicitation S-19CG5026R0008, issued by the American Embassy Kinshasa (Democratic Republic of Congo) on July 24, 2026, with an effective date of July 24, 2026.

The amendment clarifies premium payment timing requirements for a health insurance contract in compliance with Article 16 of the Democratic Republic of Congo's Insurance Code (Law No. 15/005 of March 17, 2015) and guidance from the Autorité de Régulation et de Contrôle des Assurances (ARCA) dated July 23, 2026. Revised Section B.2.2.1 establishes that monthly premium installments must be paid by the Embassy in advance of each coverage period, with coverage not taking effect until the corresponding premium is actually collected by the contractor. The 60-day premium credit period available under Article 16 is expressly excluded for health/medical branch insurance contracts. Revised Section G.4.2 specifies that payment shall be made prior to the first day of the month for which insurance coverage is provided, consistent with FAR 32.404 and the DRC Insurance Code. The proposal deadline is extended to August 3, 2026, at 17:00 WAT. The amendment incorporates the finalized Pre-Proposal Conference Questions and Answers as Attachment 1, addressing six topics: ARCA payment requirements confirmation, treatment of the 2% hospital tax, eligibility of dual project managers, definition of "premium" as a per-individual/per-family enrollment unit, out-of-country medical coverage scope, and licensing requirements clarifying that only ARCA-licensed insurance underwriting entities may serve as prime contractors, though third-party administrators may participate in joint ventures or teaming arrangements if the licensed underwriter bears the insurance risk. All other solicitation terms and conditions remain unchanged, with total contract price unchanged.

Amendment to Solicitation 19CG5026R0008

1. Revision to Section B.2.2 — Prices

Revised text (add new paragraph B.2.2.1):

B.2.2.1. Advance Payment of Monthly Premiums. Consistent with Article 16 of the Democratic Republic of Congo's Code des Assurances (Law No. 15/005 of March 17, 2015), and as confirmed by the Autorité de Régulation et de Contrôle des Assurances (ARCA) by written clarification dated July 23, 2026, each monthly premium installment shall be paid by the Embassy in advance of the coverage period to which it relates. Coverage for a given month shall not take effect, and the Contractor shall not be obligated to extend insurance guarantee, until the corresponding premium for that month has been actually collected by the Contractor. The Contractor shall promptly notify the COR in writing of any premium payment not received prior to the start of the applicable coverage period. Notwithstanding the foregoing, the 60-day premium credit period otherwise potentially available under Article 16 for certain risks does not apply to this contract, as ARCA has confirmed this exception is expressly excluded for health/medical branch insurance contracts.

2. Revision to Section G.4.2 — Frequency of Payments

Revised text:

G.4.2. Frequency of Payments. All funds under this contract will be obligated by issuance of task orders, as described in H.3, for all non-rider coverage. Each task order will fund a specific period of time and number of employees, and task orders will be issued at the frequency described in H.3. The Contractor shall submit invoices monthly. Payment shall be made by the Embassy prior to the first day of the month for which insurance coverage is to be provided, in accordance with FAR 32.404 and consistent with Article 16 of the DRC Code des Assurances, as clarified by ARCA on July 23, 2026.

The Contractor's obligation to provide coverage for a given month is contingent upon the Embassy's timely advance payment of the corresponding monthly premium in accordance with this section.

3. Extension of Proposal Due Date

Revised text:

Proposals are due no later than August 3, 2026, at 17:00 (WAT Time). No proposals will be accepted after this time.

4. Incorporation of Pre-Proposal Conference Q&A

The finalized Pre-Proposal Conference Questions & Answers document is incorporated by reference as Attachment 1 to this amendment and is hereby made part of the solicitation.

5. Acknowledgment of Amendment

Offerors must acknowledge receipt of this amendment by one of the methods specified in FAR 52.215-1 (Instructions to Offerors — Competitive Acquisition), and as indicated in Block 11 of Standard Form 30.

All other terms and conditions of solicitation 19CG5026R0008 remain unchanged and in full force and effect.

Pre-Proposal Conference Q&A Pre-Proposal Conference Date: July 10, 2026

Q1. ARCA Payment Requirements

Question: ARCA does not appear to allow monthly or quarterly payments and requires annual payment for Medical Insurance. Is the U.S. Embassy Kinshasa flexible on this, or will an agreement need to be reached with the selected vendor at the time of contract signing?

FINAL Response: The Embassy formally consulted ARCA on this question. By written response dated July 23, 2026, ARCA confirmed that Article 16 of Law No. 15/005 of March 17, 2015 (Insurance Code) does not impose an exclusively annual payment periodicity for health insurance premiums. Monthly or quarterly payment is permissible, provided that:

1. The periodicity is clearly stipulated in the contract; and

2. Each premium installment is paid in advance of the coverage period to which it relates.

Coverage may not take effect, nor may the insurer extend guarantee, before the corresponding premium (or fraction) is actually collected.

ARCA further clarified that the 60-day premium credit period otherwise available under Article 16 for certain risks above a legal threshold is expressly excluded for health/medical branch contracts.

Accordingly, monthly premium payments under this contract must always be made on an anticipatory basis (i.e., before the start of the coverage month), and the resulting contract will be amended to state this explicitly.

Action: The Contracting Officer will issue Amendment 001 revising Sections B.2.2 and G.4.2 to state that monthly premium payments are due and must be received by the Contractor in advance of the coverage period for which they apply, consistent with Article 16 of the DRC Insurance Code and ARCA's guidance of July 23, 2026.

Q2. Two Percent Hospital Tax

Question: A 2% tax is levied on hospitals where insured individuals receive treatment. Should this tax be incorporated into the quote?

FINAL Response: The Embassy's tax exemption under this contract applies only to Value Added Tax (VAT), as stated in Sections B.2.1 and G.6 of the solicitation. The Embassy will not separately reimburse or exempt the Contractor from any other host-country taxes, including the referenced 2% hospital tax.

Offerors should incorporate any such non-VAT taxes into their proposed fixed premium rates in Section B.

Q3. Two Project Managers

Question: Can the proposal include two project managers?

FINAL Response: Yes. Offerors may propose a primary and a secondary/backup project manager. One individual must be clearly designated as the primary point of contact for the Embassy and must independently meet the qualification requirements in Section L.4.3, Part 2, Item 3 (minimum two years' experience in the local or international insurance industry, and the ability to communicate acceptably in English on all matters related to the contract). Any substitution of key personnel during contract performance must be communicated to, and approved in advance by, the COR and Contracting Officer.

Q4. Premium Package Clarification

FINAL Response: A "premium," as used in this solicitation, represents one enrolled coverage unit billed monthly, corresponding to one of the three tiers defined in Section B.2.3:

• Self-only — one covered employee, no dependents;

• Self-Plus-One — one covered employee plus one dependent;

• Self-Plus Family — one covered employee plus three or more dependents.

This directly corresponds to a per-individual/per-family insurance model; the Embassy uses "premium" simply as the unit of enrollment and pricing, not as a lump-sum or pooled payment concept.

Q5. Scope of Coverage

FINAL Response: This contract is not limited to local coverage. Section C.1.1.17 (Out-of-Country Medical Treatment) and C.1.1.18 (Out-of-Country Medical Travel) of the solicitation provide for coverage of medical expenses incurred outside the DRC at the same benefit levels as in-country care, as well as 100% reimbursement of transportation costs for certified, medically necessary treatment that is unavailable locally, subject to the annual maximum limit in Section C.1.2. Offerors are encouraged to review Sections C.1.1.17 and C.1.1.18 in full.

Q6. Offeror Eligibility — Licensing Requirement

Question: May a third-party administrator of medical budgets rather than a licensed insurance company be eligible to compete for this contract?

FINAL Response: Per Sections L.4.3 (Part 4) and M.5(ii) of the solicitation, the entity underwriting the policy — i.e., bearing the insurance risk — must hold valid ARCA authorization/licensing to write health insurance in the Democratic Republic of Congo.

A Third-Party Administrator (TPA) that does not itself hold an ARCA insurance underwriting license is not eligible to compete as a standalone Prime Contractor under this solicitation. However, a TPA may participate as part of a Joint Venture, Teaming Agreement, or Prime/Subcontractor arrangement, provided that the entity bearing the insurance risk and issuing the policy is fully licensed by ARCA. In such an arrangement, offerors must clearly identify the licensed underwriting entity and include all required ARCA licensing documentation (per Section L.4.3, Part 4) in the technical proposal.

Offerors in this category are invited to structure their proposal accordingly and to submit full supporting documentation for evaluation against these requirements.
