1. NOTICE TO ALL OFFERORS: The Government anticipates awarding a firm, fixed price contract in accordance with FAR Part 12 and 13 in response to quotes/proposals received in response to this solicitation. A firm, fixed price contract places the maximum risk and full responsibility for all costs and resulting profit or loss on the contractor, offerors are advised to consider these risks when pricing their quotes/proposals.

2. See block 8 on page 1 of the solicitation for the closing date and time.

3. The deadline for submission of questions regarding the solicitation's terms, conditions, specifications, and/or the statement of work (SOW) / performance work statement (PWS) is 1 day prior to the solicitation's closing date. 4. In accordance with FAR 13.106, the Government will select the most advantageous offer based on the following evaluation factors: technical including delivery date, price, and past performance in no order of relative importance

5. SINGLE AWARD FOR ALL ITEMS: Due to the interrelationship of supplies and/or services to be provided hereunder, the Government reserves the right to make a single award to the quoter whose quote is considered in the best interest of the government, price and other factors considered.

Therefore, quoters who quote less than the entire effort specified herein may be determined to be unacceptable.

6. This acquisition will be negotiated on a or BRAND NAME basis with Original Equipment Manufacturer (OEM) AKZONOBEL per FAR 11. Interested AUTHORIZED DISTRIBUTORS may identify their interest and capability to respond to AUTHORIZED DISTRIBUTORS the requirement or submit proposals prior to offer due date. AUTHORIZED DISTRIBUTOR letter or documentation from the OEM is required to be submitted with quotes.

7. "EXCEPTIONS: All quoters MUST note all exceptions from the solicitation's terms, conditions, specifications, and/or the statement of work / performance work statement, if any. It will be assumed that any quote without mention of any exceptions will take no exception from all specifications, terms and conditions, clauses, or provisions within the solicitation."

HAZARDOUS MATERIAL, PREPARATION FOR DELIVERY

1. The preservation, packaging, and packing of hazardous materials shall be in accordance with the requirements of one of the regulations listed below, depending upon the mode of shipment. In the event of any discrepancies between the contract requirements and these regulations, the applicable regulation shall govern. Shipments must be packaged, packed, marked, labeled and certified in proper condition for transportation according to the following appropriate regulation:

a. Department of Transportation Code of Federal Regulations, Title 49, parts 100-199, as applicable, for domestic shipments;

b. U.S. Postal Service Publication #52 for shipments via the U.S. mail system;

c. International Maritime Organization's (IMO's) International Maritime Dangerous Goods Code (IMDGC) for shipments intended for delivery overseas via water transportation;

d. International Civil Aviation Organization (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods By Air or International Air Transport Association (IATA) Dangerous Goods Regulation for shipment via commercial air; and

e. AFJMAN 24-204 (formerly AFR 71-4)/TM 38-250/NAVSUP PUB 505/MCO P4030.19/DLAM 4145.3 (Preparing Hazardous Material for Military Air Shipments).

2. Address/Commodity marking and labeling requirements shall be in accordance with MIL-STD-129 and the appropriate governing regulation for the mode of shipment.

3. Unless otherwise stated below, assume surface transportation.

4. Limited Quantities. If an item offered for transportation falls within the guidelines of a limited quantity and is not regulated by the applicable mode of transportation, it shall be packaged to meet the requirements of Level A packaging listed in MIL-STD-2073-1.

5. In addition to the above, packaging (container and containment components) designs shall pass all applicable performance-oriented packaging (POP) tests in accordance with Title 49 CFR, the ICAO, IATA or IMDGC. Compressed gases are excluded from these tests. Each packaging of acceptable design shall bear certification markings outlined in the regulations. All certificates and test reports denoting test compliance shall be available for inspection by authorized government representatives.

6. Contractors shall submit any discrepancies between contractually specified packaging procedures and Title 49 requirements to the Contracting Officer for review and evaluation.

7. Non-Manufactured Wood Packing. All non-manufactured wood utilized in wood pallets and wood containers shall be heat treated to a minimum core temperature of 56 degrees centigrade for 30 minutes and certified by an accredited agency recognized by the American Lumber Standards Committee (ALSC). Refer to www.aphis.usda.gov/ppq/swp/eunmwp.html for wood packing policy, enforcement regulations and accredited agencies.

Non-coniferous (hardwood) and manufactured wood, such as particleboard and plywood, are exempt from this requirement.

INSPECTION AND ACCEPTANCE (DESTINATION)

Inspection and acceptance of the supplies or services to be furnished hereunder shall be made at destination by the receiving activity.

PROOF OF DELIVERY

If United Parcel Service (UPS) or Federal Express services are used for transportation, each package must have a unique package identification number. The Government will not consider the manifest as proof of delivery unless each package can be uniquely identified. Acceptance will occur only after the Government can verify actual receipt of the contract items--packaged, marked and labeled as required elsewhere in this contract.

WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (JAN 2023)

(a) As used in this clause- Definitions.

"Department of Defense Activity Address Code (DoDAAC)" is a six position code that uniquely identifies a unit, activity, or organization.

"Document type" means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

"Local processing office (LPO)" is the office responsible for payment certification when payment certification is done external to the entitlement system.

"Payment request" and "receiving report" are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as Electronic invoicing.

(c) To access WAWF, the Contractor shall- WAWF access.

(d) The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice WAWF training.

(e) Document submissions may be via web entry, Electronic Data Interchange, or File Transfer WAWF methods of document submission.

(f) The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF payment instructions.

WAWF for this contract or task or delivery order:

(1) The Contractor shall submit payment requests using the following document type(s): Document type.

(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.

(ii) For fixed price line items-

(A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting Officer.

(B) For services that do not require shipment of a deliverable, submit either the Invoice 2in1, which meets the requirements for the invoice and receiving report, or the applicable invoice and receiving report, as specified by the Contracting Officer.

(iii) For customary progress payments based on costs incurred, submit a progress payment request.

(iv) For performance based payments, submit a performance based payment request.

(v) For commercial financing, submit a commercial financing request.

(2) ) Fast Pay requests are only permitted when Federal Acquisition Regulation (FAR) 52.213-1 is included in the contract.

(d) . The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded Comptroller General Examination of Record using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

HAZARDOUS MATERIAL IDENTIFICATION AND MATERIAL SAFETY DATA (FEB 2021)

(a) "Hazardous material," as used in this clause, includes any material defined as hazardous under the latest version of Federal Standard No.313 (including revisions adopted during the term of the contract).

(b) The offeror must list any hazardous material, as defined in paragraph (a) of this clause, to be delivered under this contract. The hazardous material shall be properly identified and include any applicable identification number, such as National Stock Number or Special Item Number. This information shall also be included on the Material Safety Data Sheet submitted under this contract.
