Performance Work Statement (PWS) For

Maintenance and Service of Electronic Security Systems at Arlington National Cemetery, Arlington Virginia

PART 1

GENERAL INFORMATION

1. Introduction: This is a non-personal services contract to provide personnel, equipment, material, supplies, tools, transportation, supervision, preventive maintenance, corrective maintenance, and other items and/or services necessary to repair, respond to emergency calls, conduct semi-annual system verification and testing on CCTV hardware, software, and all other devices connected to the system. The contractor shall perform to the standards outlined within this contract. The Government will not exercise any supervision or control over the contract service providers performing the service herein.

Sub-contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

1.2. Background: Arlington National Cemetery (ANC) is our nation’s most sacred shrine and the final resting place for our most revered military and political leaders. ANC is open every day of the year, including holidays. ANC receives over three million visitors per year, including visits from the President of the United States, other heads of state, family members of the deceased, and millions of tourists from around the world. Approximately 7,000 funerals are conducted annually, in addition to over 3,000 other ceremonies such as commemorations, wreath ceremonies, and head-of-state visits.

1.3 Scope: The contractor shall provide personnel, equipment, material, supplies, tools, transportation, supervision, preventive maintenance, corrective maintenance, and other items and/or services necessary to repair, respond to emergency calls, conduct semi-annual system verification and testing on 74 Cameras, Genetec security software, 3 Genetec Network Video Recorders, 9 Genetec security workstations and all other devices connected to the system across Arlington National Cemetery (ANC) geographic area to include ANC welcome center, visitor parking garage, and Joint Base Myer-Henderson Hall (JBM-HH)/ANC mutual fence line. All information technology (IT) systems procured must meet all Defense Information System Agency (DISA) and DoD regulations and standards in relation to Information Assurance and setup.

1.4. Period of Performance: The period of performance for this effort will consist of base (12-month); plus, four (12-month) Options:

• Base: JAN 15, 2023- JAN 14, 2024

• Option Year 1: JAN 15, 2024- JAN 14, 2025

• Option Year 2: JAN 15, 2025- JAN 14, 2026

• Option Year 3: JAN 15, 2026- JAN 14, 2027

• Option Year 4: JAN 15, 2027- JAN 14, 2028

1.5. General Information:

1.5.1. Quality Control: Quality Control is the responsibility of the contractor. The contractor is responsible for the delivery of quality services/supplies to the Government (see FAR 52.246-1, Contractor Inspection Requirements). The Contractor shall develop, implement, and maintain an effective Quality Control System, which includes a written Quality Control Plan (QCP). The QCP shall implement standardized procedure/methodology for monitoring and documenting contract performance to ensure all contract requirements are met. The Contractors’ QCP must contain a systematic approach to monitor operations to ensure acceptable services are provided to the Government.

1.5.1.1. The Contractor shall submit their QCP as part of the Contractor’s proposal.

After acceptance of the QCP, or any proposed changes to the QC procedures, the contractor shall receive the Contracting Officer’s acceptance in writing. The Contractor shall submit QCP changes within five (5) business days to the Contracting Officer and COR for review and approval prior to implementation. The QCP shall, at a minimum, address: continuous process improvement; procedures for scheduling, conducting and documentation of inspection; discrepancy identification and correction, and corrective action procedures. To include procedures for addressing Government discovered non-conformances; procedures for root cause analysis to identify the root cause and root cause corrective action to prevent re-occurrence of discrepancies; procedures for trend analysis; procedures for collecting and addressing customer feedback/complaints. The following provides additional details for the QCP.

1.5.2. Inspection System: The Contractor shall develop, implement, and maintain a system to inspect their services as well as their subcontractor services and products to ensure compliance with PWS requirements, and applicable laws and regulations. The QCP shall specify tasks or areas to be inspected on a scheduled or unscheduled basis, Maintenance and Service of Electronic Security Systems at Arlington National Cemetery, Arlington Virginia the way inspections are to be conducted, the titles of the individuals who will perform the inspections, and the percentage of the work that will be inspected on a recurring basis.

1.5.2.1. Inspection Files: The contractor shall document all inspections that are conducted, and the necessary corrective and preventive actions taken (as applicable).

The Contractor shall provide monthly Contract Quality Control Inspection Reports to the COR. Upon request from the Contracting Officer or COR, the Contractor shall provide additional quality control documentation.

1.5.3. Quality Assurance: The Government will evaluate the Contractor’s performance under this contract in accordance with its QCP and the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government shall do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards identified in the Performance Requirements Summary (PRS) will be measured, by whom, the frequency of the surveillance, and the maximum acceptable defect rate(s). See Technical Exhibit 3 for the PRS.

1.5.4. Recognized Holidays: The contractor will not perform services on recognized holidays as indicated below. Holidays occurring on weekends will be observed as directed by the published Army calendar.

1.5.5. Hours of Operation: The contractor shall perform the requirements of this contract between Monday through Friday, 8:00 a.m. to 4:00 p.m. If normal operating status is affected by local or national emergencies, administrative closures, or similar Government directed facility closures, such information will be communicated to the Contractor by the Contracting Officer or COR. If additional hours are requested by the contractor, ANC will require written requests no less than 3 business days in advance. When the contractor is on site to carry out maintenance duties IAW the PWS, the contractor shall perform these duties during approved hours as to not interfere with funeral services which occur between 9am and 3pm Monday Through Friday and 9 am to 12pm Saturdays.

1.5.6. Place of Performance: The work to be completed for the configuration of equipment as per this contract will be coordinated through the COR as some configuration will need to be done offsite before installation on ANC to reduce disruption time.

1.5.7. Interface with Government Operations: Performance of work by Contractor personnel under the terms of this contract shall not interfere with regularly scheduled Government operational activities.

1.5.8. Contract Type: The Government award of a Firm Fixed Price Contract for the government.

1.5.9. Security Requirements: Contractor personnel or any representative of the Contractor entering Arlington National Cemetery shall abide by all security rules and regulations. The Contractor shall coordinate with the ANC security office to ensure all Contractor employees have received the appropriate security background check (see paragraph 1.5.9.1.2. and 1.5.9.1.3. below). The Contractor is solely responsible for processing employees through the Department of Homeland Security e-Verify system, a mandatory requirement for all federal contracts, and should consult with that agency for any questions.

1.5.9.1. Access to Arlington National Cemetery: The Contractor shall be responsible for ensuring all contractor personnel authorized to perform work on Arlington National Cemetery under this contract obtain cemetery access. Within ten (10) business days after contract award, Contractor shall submit to the Contracting Officer and Contracting Officer Reprehensive (COR) the names of all personnel working under this contract. Changes in contractor personnel reporting for duty shall be submitted to the COR within one (1) business day of the change taking place. All Contractor employees shall have on them, always, positive/valid, photographic identification.

1.5.9.1.1. Access and general protection policy and procedures: All Contractor employees shall provide all information required for background checks to

Maintenance and Service of Electronic Security Systems at Arlington National Cemetery, Arlington Virginia meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. Before beginning any performance on this contract, all Contractor personnel shall complete the basic background check stipulated in paragraph 1.5.7.1.3., regardless of whether they require a CAC.

1.5.9.1.2. Contractors requiring a Common Access Card (CAC): To obtain a CAC, the contractor employee requires, at a minimum, a favorably adjudicated Tier 1 investigation (formerly referred to as a National Agency Check with Inquiries (NACI)), or an equivalent or higher investigation in accordance with Army Directive 2014-05. The contractor employee will be issued a CAC only if duties involve one of the following: (1) Both physical access to a DoD facility and access, via logon, to DoD networks on-site or remotely; (2) Remote access, via logon, to a DoD network using DoD-approved remote access procedures; or (3) Physical access to multiple DoD facilities or multiple non-DoD federally controlled facilities on behalf of the DoD on a recurring basis for a period of 6 months or more. At the discretion of the sponsoring activity, an initial CAC may be issued based on a favorable review of the FBI fingerprint check and a successfully scheduled Tier 1 investigation at the Office of Personnel Management. Adjudication of investigations to determine eligibility for obtaining a CAC is the sole responsibility of the Government;

however, in circumstances where an investigation includes potentially disqualifying information, the Contract may be required to provide supplemental information or documentation to mitigate the derogatory information. Contractor employees who require a CAC, but who do not have a completed and adjudicated Tier 1 investigation (including equivalent or higher investigations), shall contact the ANC Security Office to initiate the investigation process, and should expect up to 6-8 weeks from the initiation of the investigation application to receive their initial CAC.

1.5.9.1.3 Contractors not requiring a CAC: Contractor employees who do not require a CAC, must still be cleared through a basic criminal history check prior to performing on the contract, and then annually thereafter. All Contractor employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations. Contractors who initially receive an approved background check but are later denied during the annual re-check shall no longer be permitted to perform on the contract.

1.5.9.1.4. Contractor Identification Badge: Upon notification of successful adjudication of NCIC-III and TSDB screening, the Contractor employee will report to the ANC Badging Station within (5) business days to receive their ANC generated Contractor Identification Badge. The Contractor shall always wear their Contract Employee Identification Badge during when the employee is performing work under this contract.

Each Contractor employee shall wear the ID Badge in a conspicuous place on the front of

The Contractor shall be responsible for collection and return of badges upon completion of the contract or termination of employee.

1.5.9.1.5. Vehicle Access: The Contractor shall carry passes issued by Arlington National Cemetery for all vehicles entering the Cemetery, whether company-owned or employees’ private vehicles The Contractor shall provide a list of these vehicles to including pertinent information as directed by ANC Security, to the COR within ten (10) business days of contract award and within one (1) day of any changes to the list throughout the contract’s period of performance.

1.5.9.2. Physical Security: The Contractor is responsible for complying with physical security policies and procedures at Arlington National Cemetery. The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

1.5.9.2.1. Automated Gate and Building Access Codes: If issued an automated gate and/or building access codes, the Contractor shall establish and implement methods of ensuring that all gate access codes are not revealed to unauthorized persons. The Contractor shall notify the COR when personnel having access to the combinations no longer have a need to know such combinations. These procedures shall be included in the Contractor’s Quality Control Plan.

1.5.9.2.2. Key Control: The Contractor shall establish and implement methods of making sure all keys issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas.

a. The Contractor shall immediately report any occurrence of duplicated, misplaced, or lost keys to the Contracting Officer and COR after discovery of occurrence and submit a written report to the Contracting Officer by close of business the next business day. The written report shall provide complete details relating to duplication, misplacement, or loss. In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the Contracting Officer, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re- keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.

All performance failures shall be addressed within 8 hours when identified.

b. The Contractor shall prohibit the use of Government issued keys by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the COR.

1.5.9.3. Security Training Requirements: The Contractor shall ensure all personnel receive security-related training in accordance with applicable DoD, Army, and ANC policies and regulations. Training will include, but not limited to, Antiterrorism Awareness and Operations Security (OPSEC). Antiterrorism (AT) Level I and OPSEC training shall be conducted within 15 days after start of contract performance, and annually thereafter.

The Contractor may use its own training materials provided the materials are reviewed and approved by the ANC security office within five (5) business days prior to training being conducted. The Government will not be responsible for the cost of developing AT or OPSEC awareness training materials. Contractor developed training will include information on identifying and reporting suspicious activity based on the Army's iWatch program. The Contractor may receive training materials and presentations from the ANC security office; however, it is the Contractor's responsibility to ensure all personnel receive the training. The Government estimates that time required to complete all security training requirements (both initially, and annual refresher training) is two hours per Contractor employee; however, the cost of these non-productive labor hours shall be incorporated into the Contractors overhead and administration costs, not included as separate costs in the proposal.

1.5.9.3.1. Antiterrorism Level I Training (AT Level I): All Contractor employees requiring access to ANC shall complete AT Level I awareness training within 15 business days after contract start date or new employees beginning performance after contract award, and annually thereafter. The Contractor shall submit training certificates to the COR within five (5) business days after completion of training. 1.5.9.3.2. iWATCH Training: All Contractor employees shall be briefed on the local iWATCH program (training materials to be provided by ANC upon contract award).

This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 15 calendar days of contract award and within 15 calendar days of new employees commencing performance, and annually thereafter. Training completion shall be reported to the COR within five (5) business days after completion of the training.

1.5.9.3.3. Operations Security (OPSEC) Training: All Contractor employees performing services under this contract shall receive initial (and annual refresher) OPSEC training in accordance with Army Regulation 530-1 (Operations Security). Initial training at the beginning of the contract and for new employees after contract award shall be completed within 15 calendar days of their reporting for duty, and then annually thereafter.

http://cdsetrain.dtic.miI/opsec/index.htm. Alternative training materials may be provided by the Government following award of the contract. Training certificates shall be submitted to the COR within five (5) calendar days after completion of the training.

1.5.10 Special Qualifications: Contractor shall be certified with the following certifications: Genetec Security Center 5.x Enterprise (advanced) technical certification, Genetec Mission Control admin certification, Security Center 5.x Advanced troubleshooting and Security Center 5.x system hardening certification. In order to perform maintenance and software developmental changes and upgrades to Genetec security software center solutions installed on ANC security system severs.

1.5.11. Access to Government Information Systems: All Contractor employees with logical access to a government information system must have a favorably adjudicated Tier 1 (formerly known as a National Agency Check with Inquiries (NACI)) or higher-level investigation and must be registered in the ATCTS (Army Training Certification Tracking System) at commencement of services. The use of Government information systems shall be exclusively for the purpose of meeting performance requirements of this PWS.

All Contractor employees with access to a Government information system shall comply with applicable rules and polices regarding such use (e.g., Acceptable Use Policy, User Agreements, etc.). This includes, but is not limited to, the following restrictions:

1.5.11.1. Unauthorized Use: All Contractor personnel with access to Government information systems shall use such systems, including wireless networks, only for authorized purposes and performance of the requirements of this contract. Access to the network and information systems shall not be used for personal business, installing unauthorized software, attempting to alter or modify the system or network, or accessing inappropriate content (e.g., illicit websites).

1.5.11.2. Protecting Network and System Access: The sharing of login information, including personal identifying numbers (PINs) for Common Access Cards (CACs) is strictly prohibited, and may result in removal from the network, revocation of eligibility to receive a CAC, or removal from the contract. All Contractor personnel who receive a CAC shall protect their card from unauthorized use, damage, loss, or theft, and shall remove their CAC from an information system when no longer actively in use.

1.5.12. Information Assurance Training: Access to Government information systems requires completion of initial and annual refresher training on Information Assurance (IA) prior to obtaining a network account. The IA training is available at https://ia.signal.army.mil; certifications shall be submitted to the COR within five (5) calendar days of completion of the training, or with submission of network user account application, whichever occurs sooner. Additional information on the procedures for

1.5.13. Combating Trafficking in Persons (CTIP) Training: The Contractor shall ensure all personnel receive initial Combating Trafficking in Persons (CTIP) training within 15 calendar days of contract award, or effective date of employment throughout contract period, and annually thereafter. Certificates of completion shall be submitted within five

(5) calendar days after completion of the training.

1.5.14. Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer, COR, and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the Contracting Officer will apprise the Contractor of how the Government views the Contractor's performance and the Contractor shall apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues.

These meetings shall be at no additional cost to the Government.

1.5.14.1. Performance Evaluation Meetings: The Contracting Officer may require the Contractor to meet with the Contracting Officer, Contracting Officer Representative (COR), and other Government personnel as deemed necessary to review quality control issues or other matters relevant to the performance of this contract. Written minutes of such meetings will be recorded by the Government and signed by the Contractor and the Contracting Officer or COR and distributed within five (5) business days after the meeting.

The Contractor may request a meeting with the Contracting Officer or COR when the Contractor believes such a meeting is necessary. Written minutes of such meetings shall be recorded by the Contractor and signed by the Contractor and the Contracting Officer or COR and distributed within five (5) business days after the meeting. In either case if the Contractor does not concur with any portion of the minutes, recorded by the Government or the Contractor, such non-concurrence shall be provided in writing to the Contracting Officer within two (2) business days following receipt of the minutes.

1.5.15. Identification of Contractor Employees: The Contractor shall provide a name tag on all employees that clearly identify the name of the contractor company. All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties shall identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They shall also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

1.5.15.1. Supervision of Contractor Employees: The Government will not exercise any supervision or control over Contractor or subcontractor employees while performing work under the contract. Such employees shall be accountable solely to the Contractor, not the Government. The Contractor, in turn, shall be accountable to the Government for Contractor or subcontractor employees.

1.5.15.2. Conduct of Personnel: The Contracting Officer may require the Contractor to be remove from the job site any employee working under this contract for reasons of misconduct, security infractions, or found to be under the influence of alcohol, drugs, or other incapacitating agents. Contractor employees shall be subject to dismissal from the premises upon determination by the Contracting Officer that such action is necessary in the interest of the Government. In accordance with (IAW) Joint Ethics Regulations, DOD 5500.7-R, and 18 U.S.C. 1382 (1972), the cemetery Executive Director (who has authority such as an installation commander) has the authority to bar individuals from the cemetery. The removal from the job site or dismissal from the premises shall not relieve the Contractor of the requirement of providing sufficient personnel to perform the services as required by this contract.

1.5.16. LIABILITY AND RESPONSIBILITY FOR DAMAGED PROPERTY

1.5.16.1. Damage to Government Property: The Contractor shall be held liable for damage or destruction of Government property (e.g., buildings, vehicles, sidewalks, headstones, etc.) caused by the Contractor, Contractor personnel or representatives of the Contractor in the performance of services in this contract. The Contractor shall be aware that Government property (beyond standard structures and equipment) also includes headstones, monuments, trees, beds, and turf. The Contractor shall immediately notify the COR and submit a damage report to the Contracting Officer and designated representative within two (2) business days of damage or destruction to Government property or privately owned property caused by the Contractor, Contractor personnel or representatives of the Contractor. The damage report shall detail the facts and the extent of damages or destruction, and the corrective action taken by the Contractor to repair damages or replace destroyed property.

1.5.16.2. Damage to Privately Owned Property: The Contractor shall be held liable for damage or destruction of privately owned property (e.g. privately owned vehicles), as defined in this PWS, caused by the Contractor, Contractor personnel or representatives of the Contractor in the performance of services in this contract. The Contractor shall take corrective action in a reasonable amount of time to repair damages or replace destroyed property.

1.5.16.3. Government Observation: As applicable, the Contractor shall provide access to Government owned real property operated by the Contractor for observation or inspection by any Government agency or individual authorized access by the Contracting Officer. Government personnel will not interfere with Contractor performance.

1.5.17. Environmental Management System.

1.5.17.1. Environmental Management System: Arlington National Cemetery has implemented an Environmental Management System (EMS) to address the environmental impacts of its activities. While the Government does not expect any performance requirements under this contract to impact environmental considerations, it is the responsibility of the Contractor to adhere to these provisions.

1.5.17.2. Solid Waste and Recycling: The Contractor shall recycle used oil and used antifreeze in accordance with Federal and State laws and regulations. The Contractor must provide the Government with records of the type, weight, and /recycling location for used oil and used antifreeze. The Contractor shall ensure all other recyclable materials (e.g., cardboard, paper, aluminum/metal cans, plastic, and glass jars/bottles, scrap metal, etc.) are deposited into recycling receptacles provided at ANC.

1.5.17.3. Hazardous Waste: The Contractor shall manage hazardous waste in accordance with Federal and State laws and regulations. The contractor may not sign waste profiles or manifests on behalf of ANC. Contractor must follow ANC’s Manifest

SOP.

1.5.17.4. Hazardous Material: The Contractor shall furnish and store all hazardous materials in a storage container or other secondary containment system.

Maintenance of on-site equipment is not authorized.

1.5.17.5. Storm Water Pollution Prevention: The Contractor shall implement measures to prevent storm water pollution in accordance with Federal and State laws and regulations, and ANC’s Municipal Separate Storm Sewer System (MS4) permit. For example, if the Contractor provides space heaters at stations or posts outdoors, measures must be taken to ensure fuel does not affect the storm water management system. When applicable, the Contractor shall furnish, install, maintain, and operate erosion and sediment control measures, such as silt fences, storm drain protection, soil retention blankets, etc., prior to the start of any work that could cause pollution to state waters. The Contractor shall keep paved roads, parking lots and walkways clear of dirt, debris, and other materials. The Contractor shall remove immediately any dirt, debris, or materials deposited onto these surfaces. The Contractor must furnish and use drip pans under equipment oil and fuel tanks, and cover equipment when not in use and during rain events.

1.5.17.6. Permits, Taxes, Licenses, Ordinances, Laws, and Regulations: If required by applicable laws, the Contractor shall maintain a solid waste management permit and air permit issued by VA Department of Environment Quality. The Contractor shall adhere, and comply with all applicable Federal, Local, and State codes, regulations, and permits.

1.5.17.7. Environmental Protection: The Contractor and Contractor representative shall manage all waste generated by any work performed under this contract in

Maintenance and Service of Electronic Security Systems at Arlington National Cemetery, Arlington Virginia accordance with all applicable Federal (Clean Air Act; Toxic Substances Control Act; Solid Waste Disposal Act; Resource Conservation Recovery Act; Clean Water Act; Safe Drinking Water Act) and State laws and regulations; Executive Orders, or other types of rulings having the effect of the law. In case of a conflict among these laws and regulations, the most stringent law or regulation shall apply.

1.5.17.8. Air Quality: The Contractor shall take all necessary reasonable control measures to reduce air pollution by any material or equipment used to carry out the requirements of this contract. This includes, but is not limited to, wetting down dry materials as necessary to prevent blowing dust, and keeping waste and materials in covered containers.

1.5.18. Fire Protection: The Contractor shall comply with AR 420-1 Army Facilities Management Chapter 25 for fire protection and fire prevention. In the event of a fire, the Contractor shall immediately call 911 and the fire department requesting assistance. In the event of a potential fire or other emergency, the Contractor shall notify the COR, ANC Safety Manager, and other government personnel immediately by radio or telephone to report such incidents after contacting emergency services.

1.5.19. Contracting Officer’s Representative (COR): The COR will be nominated by the requiring activity and appointed by the contracting officer by separate letter. A copy of the COR’s appointment letter will also be sent to the awarded Contractor, identifying the designated duties and limitations of the COR. The CORs’ designated duties will describe the level of responsibility (inspection only – or inspection and acceptance) and what technical or administrative aspects of the contract are to be monitored. The COR’s oversight responsibilities are not limited to the QASP since all listed contract requirements or tasks are expected to be always met by the contractor, the COR is authorized to conduct oversight on any and all tasks or requirements and report observations to the Contracting Officer. The COR is not authorized to change any terms or conditions in the contract that pertain to cost, schedule, performance, quality, quantity, or other legal aspects of the resulting order.

1.5.20. Organizational Conflict of Interest: The Contractor shall not employ any person who is an employee of the United States Government or the Department of Defense, either military or civilian, if such employment would create a conflict of interest or be contrary to the policies contained in Department of Defense (DOD) Joint Ethics Regulation (JER), DOD 5500.7-R.

1.5.21. Safety: The Contractor shall safeguard and maintain all Government property as well as provide for the safety and well-being of personnel employed in the administration of this contract. The Contractor is solely responsible and liable for following all applicable Federal, Department of Army and State of Virginia mandates and guidelines; and

Maintenance and Service of Electronic Security Systems at Arlington National Cemetery, Arlington Virginia ensuring safe work and otherwise safe actions, behavior, and conduct of employees while at ANC. The Contractor shall comply with the provision of AR 385-10, Army Safety Program. The Contractor shall develop and implement a safety program for employees performing work under this contract. The Contractor shall submit the Safety Plan, applicable to the work at ANC, to the Contracting Officer. The Safety Plan shall include the Contractors plan to handle performance requirements in dangerous situations, such as ability to negotiate and carry required materials along a steep flight of stairs, severe inclement weather (e.g., active nearby lightning activity). The Contractor shall provide the Safety Plan to the Contracting Officer or designated representative for review and acceptance with their proposal. Revisions shall be submitted five (5) business days prior to effective date of change. The Contractor shall have a designated safety representative who shall meet quarterly with the COR and the Safety Manager of ANC. The Contractor shall be responsible for collecting meeting notes or minutes from these quarterly Safety meetings and shall provide them to the COR within 5 business days from the meeting date.

1.5.22. Life, Health, and Safety: The Contractor shall be fully responsible for and shall assume all liability for compliance with all applicable regulations pertaining to the life, health and safety of Contractor personnel during execution of work. The Contractor shall hold the Government harmless for any action on its part or that of its employees or Contractor’s representatives, which results in illness, injury, or death to anyone on the Cemetery grounds. All rules of safety which are or may be imposed upon the Contractor by federal, state or municipal code, and the applicable cemetery regulations shall be effectively carried out in the performance of this contact.

1.5.22.1. Medical Treatment: Medical facilities are not available for use by the Contractor on ANC. The Contractor shall be responsible for providing any medical treatment for employees. If such treatment should ever be provided at a government medical treatment facility, the total cost of such treatment to the Contractor’s employees is the responsibility of the Contractor. The Contractor shall take measure to ensure the government is reimbursed according to applicable procedures, policy, and laws governing Government provided health care.

1.5.22.2. Accident Reporting: The Contractor shall immediately notify the COR of accidents resulting in injury or death and accidents resulting in damage to Government property, supplies, and equipment. The Contractor shall report accidents IAW the requirements indicated in AR 385-40, Accident Reporting and Records.

1.5.23. Disclosure of Information: Performance under this contract may require the Contractor to access data and information proprietary to a government agency, another Government Contractor, or of such nature that its dissemination or use other than as specified in this work statement would be averse to the interests of the Government or others. Neither the Contractor, nor Contractor personnel, shall divulge nor release data or information developed or obtained under performance of this work statement, except to

The Contractor shall not use, disclose, or reproduce proprietary data which bears a restrictive legend, other than as specified in this work statement.

1.5.23.1. Disclosure of information regarding operations and services of the activity to persons not entitled to receive it, or failure to safeguard any classified information that may come to the Contractor (or any persons under the Contractor’s control) in connection with work under this work statement, may subject the Contractor’s agent, or employees to criminal liability under Title 18, Sections 793 and 798 of the United States Code. Neither the Contractor nor the Contractor’s employees shall disclose or cause any information to be disseminated concerning the operations of the activity that could result in, or increase the likelihood of, the possibility of a breach of the activities’ security or interrupt the continuity of its operation.

1.5.23.2. The Contractor shall direct to the Contracting Officer all inquiries, comments, or complaints arising from matters observed, experienced, or learned because of, or in connection with, the performance of this contract. The resolution of such inquiries, comments or complaints may require the dissemination of official information.

1.5.23.3. Inquiries received by the Contractor for work performed under this contract shall be referred to the Government within two (2) business days for evaluation under the Freedom of Information Act (FOIA) of 1975, Public Law 93-502, 5 U.S.C.

Section 552. The determination of whether records will be released will remain with the Government. The Contractor shall be responsible for search and submission of records upon request by the Government.

1.5.23.4. The Contractor shall not release any information (including photographs, files, public announcements, statements, denials, or confirmations) on any part of the subject matter of this contract or any phase of any program hereunder without the prior written approval of the Contracting Officer. All documentation showing individuals’ names or other personal information shall be controlled and protected. The provisions of the Privacy Act of 1974, Public Law 93-579, 5 U.S.C., Section 552a, shall apply.

1.5.24. Lost and Found or Abandoned Property: The Contractor shall turn-in to the COR, or other ANC representative as directed by the COR, all personal property found on the grounds of the cemetery. Found Government property will be turned in immediately and found personal property will be turned in the next business day, or as otherwise directed in accordance with ANC policy. The Contractor shall record all appropriate information about found property, or lost property reported by visitors in the ANC Lost and Found Database. The government reserves the right to change its policy and procedures regarding lost and found property and will be provide any revisions to such policy and procedures to the Contractor within a reasonable time.

1.5.25. Files: The Contractor shall maintain complete and accurate files of documentation, records, logs, and reports required under the terms of this contract IAW AR 25-1, Army Knowledge Management and Information Technology, and AR 25-400-2, The Army Records Information Management System (ARIMS). The Contractor shall not allow access to the files by any Government agency, non-Governmental agency, or individual unless specifically authorized by the Contracting Officer or COR. Files shall be made available to the Contracting Officer, COR or designated representative upon request as a contract deliverable. All files will become the property of the Government and shall be turned over to the Contracting Officer or COR at the completion or termination of this contract.

1.5.26. Data Rights: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.

1.5.27. Media: The Contractor is not authorized to interact with media regarding the performance of this contract, or any other matter related to ANC and the US Government.

1.5.27.1. Media Interaction: If the Contractor is interacting with a visitor who then identifies himself or herself as a member of the media, the contractor shall make every reasonable effort to contact the ANC Public Affairs Office (PAO) to assist the media member; if the PAO is not available, the Contractor shall provide the media member with ANC’s toll-free number for a follow-up response from the PAO. If the Contractor identifies unauthorized media activity on ANC, or in the vicinity of Memorial Avenue, the Contractor shall immediately report the activity to the ANC Public Affairs Office and the COR.

1.5.27.2. Identifying Media Activity: If the Contractor sees a person or group who appear(s) to belong to the media the Contractor shall seek assistance from ANC security personnel.

PART 2

DEFINITIONS & ACRONYMS

2.1. ACCESS CONTROL: The selective restriction of access to a place or other resource.

2.2. CEREMONIES: Pre-coordinated special events (not including funerals or committal services), approved by ANC or its partners.

2.3. CONTRACT QUALITY CONTROL INSPECTION REPORT: A written explanation by the Contractor of deficiencies in the quality of services provided by the Contractor. Format for the CIR is to be developed by the Contractor.

2.4. CONTRACT ADMINISTRATOR. The official Government representative delegated authority by the Contracting Officer to administer a contract. This individual is normally a member of the Contracting/Procurement career field and advises on all technical contractual matters.

2.5. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or services to the government. The term used in this contract refers to the prime. For the purposes of this PWS, the terms “Contractor employee” or “Contractor personnel” include sub-contractor employees and personnel.

2.6. CONTRACTING OFFICER. A person with authority to enter into, administer, and/or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.7. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S.

Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor if that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.8. CORRECTIVE MAINTENANCE. Corrective maintenance is the category of maintenance tasks that are performed to rectify and repair faulty systems and equipment.

The purpose of corrective maintenance is to restore systems that have broken down.

2.8. CUSTOMER COMPLAINT: An inspection method that is initiated by receipt of customer complaints concerning the Contractor’s performance.

2.9. DAMAGE: A condition that impairs either value or use of an article; may occur in varying degrees. Property may be damaged in appearance or in expected useful life without rendering it unserviceable or less useful.

2.10. DATA RIGHTS: Data Rights is a shorthand way to refer to the Government's license rights in two major categories of valuable intellectual property. Technical Data includes any recorded information of a scientific or technical nature (e.g., product design or maintenance data, computer databases, and computer software documentation).

Computer Software includes executable code, source code, code listings, design details, processes, flow charts, and related material.

2.11. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.12. DELIVERABLE. Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.

2.13. FAIR WEAR AND TEAR: The loss of impairment of appearance, effectiveness, worth, or utility of an item that has occurred solely because of normal and customary use of the item for its intended purpose.

2.14. FISCAL YEAR (FY): A period of 12 months beginning October 1 and ending September 30 of the following year. The fiscal year is designated by the calendar year in which it ends.

2.15. Government-Furnished Property (GFP) or Government Property (GP): Property in the possession of, or directly acquired by, the Government and subsequently made available to the Contractor.

2.16. KEY PERSONNEL: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.17. HAND RECEIPT: A signed document acknowledging acceptance and responsibility for property listed therein on a loan basis.

2.18. MEMORIAL SERVICES: Special events specifically related to the memorial or commemoration of an individual.

2.19. NON-DUTY DAY: Those days in which the Contractor is not required to have personnel available for regularly scheduled tasks in a particular functional area.

2.20. NON-DUTY HOURS: Those hours that the Contractor is not required to have personnel available for regularly scheduled tasks in a particular functional area.

2.21. NORMAL DUTY DAY: Those days in which the Contractor schedules Contractor employees in each functional area to complete minimum requirements of the contract without respect to surge capacity. Normal duty days shall include the scheduled requirements. A normal duty day is based on the total hours of performance for any specified requirement based on the operating schedule of ANC.

2.22. OPERATION CELL: The ANC Operations Directorate.
