SUBJECT: Serv M23-007 Filter Debris Apparatus Service

1. 76 MXSG requests a one-year base contract with four (4) one-year options for Serv M23-007 Filter Debris Apparatus Service, for annual maintenance and repairs of the Filter Debris Analyzer (model number FilterCHECK 290).

2. Gastops, Inc. is the original equipment manufacturer (OEM) for the equipment listed in equipment list. The OEM owns all software licenses and equipment data for components.

Therefore, they are the only authorized service provider for the Filter Debris Analyzer (model number FilterCHECK 290). The OEM owns all data rights to their technology. Gastops, Inc. is the only known source that has the required parts (software/hardware/electronic/electrical) and access to proprietary data to perform the required maintenance, software, and repairs for this equipment. Certified Gastops, Inc. technicians are the only qualified contractors to perform the services for this requirement.

Upon contacting Gastops, Inc., it was determined that they have no intentions on selling the data rights to the government at this time. There are no other companies authorized as an OEM maintenance facility. Only the OEM (Gastops, Inc.) is capable of performing this specific maintenance service for the specified equipment using their proprietary, unique software and data in a cost-effective manner.

In review, it has been determined that there is only one source capable of providing the service for this acquisition.

3. After market research was conducted, it was determined that there is only one company, the original equipment manufacturer (OEM), Gastops, Inc., that can satisfy the Government’s requirement.

4. Market research was performed reviewing Dynamic Small Business Search (DSBS) and

System for Award Management (SAM) databases using North American Industry Classification System (NAICS) Code (811310) looking for companies that could provide Filter Debris Apparatus Maintenance. A review of small businesses to include 8(a), HUBZone, Service-Disabled Veteran Owned Business, and Women Owned Small Business was conducted in search of a company that could provide Filter Debris Apparatus Maintenance. After contacting the OEM, it was discovered that the key components of the FilterCHECK 290 (the MetalSCAN system and analysis software) are proprietary to GasTOPS. The OEM does not use subcontractors or train engineers for any other companies to perform the requested services.

There are no other companies that have the proprietary information and capabilities to perform the requested services. The OEM is not willing to sell any proprietary data rights to the government at this time.

In review, there are no vendors outside of the original equipment manufacturer, Gastops, Inc., that are capable of providing the requested equipment service.

5. In the future, the Government will continue to conduct market research to determine if Gastops, Inc. has any distributors capable of providing maintenance services for the Filter Debris Analyzer (model number FilterCHECK 290), or if the OEM would be willing to sell the data rights to the Government.

6. I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
