9. Interested Sources: Other than the six respondents to the RFI , no other sources have expressed interest in this procurement.

10. Other Facts:

Procurement History:

Senspex Inc. was awarded a Firm-Fixed Price (FFP) 5-year Indefinite Delivery Indefinite Quantity (IDIQ) contract, W56HZV-16-D-0129, 28 September 2016 for a total dollar value of $1,075,000. The statutory authority permitting other than full and open competition is 10 USC 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “ Responsible Source and Will Satisfy Agency Requirements”. The reason for authority cited because Senspex is the developer and Original Equipment Manufacturer (OEM) of their own camera systems and spare parts. Senspex owns the TDP required to interface with the camera systems at the various ranges. As a result, the Government does not have the rights to the data that would be required to allow for competition, and Senspex has advised that they are not interested in selling its TDP to the Government. Senspex uses their own proprietary technical data to build, produce, and then maintain targetry systems to the Government’s performance requirements. Therefore they are the responsible sources that can fulfill the Army’s requirements.

Contents of Paragraph 7: The Requiring Office planned to track procurement history and trends (failure and demand rates) on spare parts that will be procured under this contracts. However, because the contractor has expressed its unwillingness to license the TDP, no action to increase competition will be taken, and the Requiring Office will continue to maintain the systems with sole source procurements.
