CLAUSES INCORPORATED BY FULL TEXT
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government will utilize a Lowest Price Technically Acceptable (LPTA) evaluation method for this requirement.
(b) Only those proposals determined to be Technically Acceptable will be eligible for award. Offerors whose technical proposals are determined “Unacceptable” will not be eligible for award. For a proposal to be determined “Technically Acceptable” and receive consideration for award based upon low price submitted, the proposal must receive a rating of “Acceptable” for all factor and sub-factors.
(c) The Government intends to evaluate the offer and award a contract without discussions. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.
Adjectival Ratings
1. The adjectival ratings to be utilized for proposal evaluations are consistent with the DoD Source Selection Procedures and the Army Source Selection Supplement (AS3). A single rating system will be used to evaluate the Technical Acceptability (to include Subfactor 1 and Subfactor 2, as indicated below).
Price will be evaluated for reasonableness and will not receive an adjectival rating.
Technical Acceptable/Unacceptable Ratings
Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
Evaluation Criteria
Evaluation criteria consist of three (3) factors. The proposal will be evaluated under the following evaluation factors:
Factor 1: Technical Capability Subfactor 1: Management Approach Subfactor 2: Staf f ing Approach
Factor 2 Past Performance
Factor 3: Price
Evaluation Factors.
(1) Factor 1 – Technical Capability. The Technical Capability Factor evaluation provides an assessment of the of feror‘s capability to satisfy the Government‘s minimum requirements. The Government will evaluate the contractor‘s technical proposal to ensure that it ref lects a sound understanding of this requirement.
Subfactor 1: Management Approach: The Government will evaluate responders’ proposed methodology for staf f ing planning, organizing, directing, and controlling its staf f in performance of the tasks identif ied in the PWS and associated attachments. The document will be evaluated based on the soundness of the approach, the feasibility of the approach, and the comprehensiveness of the document.
An assessment of the proposed management roles, controls, and communications will be evaluated on likelihood of success.
Subfactor 2: Staffing Approach: The Government will evaluate how the of feror identif ied personnel/ labor categories (positions essential for contract performance) deemed necessary to satisfy the requirement of the PWS. The Government will evaluate how proposed personnel f it into the overall organization and how they describe the proposed responsibilities for each position. The Government will evaluate the personnel qualif ications to ensure qualif ications are commensurate with the size and scope of PWS requirements. The Government will evaluate the of feror‘s key personnel qualif ications relevant to Educational Services: education, professional experience, specif ic experience and other relevant activities and achievements. The Government will evaluate how the of feror is going to ensure that all the requirements of the contract/PWS will be met during vacancies in the of feror’s staf f due to resignations, leave, etc.
(2) Factor 2 – Past Performance. In lieu of requesting past performance information, Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS) and other commercial databases will be utilized in reviewing past performance.
Past Performance Evaluation Ratings Rating Description
Acceptable Based on the of feror’s performance record, the Government has a reasonable expectation that the of feror will successfully perform the required ef fort, or the of feror’s performance record is unknown.
Unacceptable Based on the of feror’s performance record, the Government has no reasonable expectation that the of feror will be able to successfully perform the required ef fort.
(3) Factor 3 – Price. The Price Submission will not be scored or rated. The techniques and procedures described under FAR Part 15.404-1(b) will be the primary means of assessing Price analysis for commercial items to determine price reasonableness. To be viable for award, an Of feror’s price must be determined fair and reasonable and not exceed the established fair market price in accordance with FAR
19.807. The Offeror’s total proposed price will be utilized to evaluate if the proposal represents a fair and reasonable price. The total evaluated price includes the price of the phase-in period, base period, all option periods (to include the option to extend services in accordance with FAR 52.217-8).
Total Evaluated Price (TEP): The TEP to be used for the determination of price reasonableness will be calculated as follows: The sum of all CLINs‘ (to include the travel plug f igure), the base period and f irst option period, second option period, and ½ of the second option period price as an evaluation of potential pricing under FAR Clause 52.217-8.
Unbalanced Pricing: Unbalanced pricing will be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk which could result in unreasonably high prices.
Technical and past performance, when combined, are equal.
(b) Options. The Government will evaluate of fers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an of fer is unacceptable if the option prices are signif icantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the Of feror’s f inal option period prices to the Of feror’s total price. Thus, the Of feror’s total price for the purpose of evaluation will include the phase in and base period, 1st option, 2nd option, and 1/2 of the 2nd option. Of ferors are not required to enter a price for the six-month period.
(c) A written notice of award or acceptance of an of fer, mailed or otherwise furnished to the successful of feror within the time for acceptance specif ied in the of fer, shall result in a binding contract without further action by either party. Before the of fer's specif ied expiration time, the Government may accept an of fer (or part of an of fer), whether or not there are negotiations af ter its receipt, unless a written notice of withdrawal is received before award.
