About this file

This request for quote solicits proposals for the design, testing, and production of 12-ton dolly set mobilizers to meet Air Force requirements from fiscal years 2021 to 2023. The solicitation requires a battery-powered dolly set mobilizer capable of lifting, loading, and transporting ISO containers or shelters weighing up to 24,000 pounds, for transport across various terrain types and loading onto C-5, C-17, and C-130 aircraft. The mobilizer consists of a front-steerable dolly and rear-trailer dolly with interconnecting brake lines and electrical harnesses that can be towed by tactical vehicles meeting towing capacity requirements. The Air Force seeks a one-year firm fixed price contract to meet an immediate need for 44 mobilizers, with potential additional orders in subsequent fiscal years depending on requirements and funding. Proposals are due by specified date and time, with evaluations based on technical capability, price, contract references, and other factors.

Related Similar efforts must demonstrateshow factual data that is convincing reflective of the Dolly being bought under this effortdata of similarity. The final decision of whether the four contracts are related to the effort outlined in this RFQ rests with the government. Comment by MCDANIEL, IAN T NH-03 USAF AFMC 78 ABW/JA: This needs to be defined better, why don’t they just submit the contracts to you? Are there other documents (that you can specify) that you think would help here? This statement is currently too vague.

The system is designed to be loaded onto a C-5, C-17, and C-130 aircraft using its own power and the aircraft winch

M-900 Proposal Evaluations

FAR Provision *52.212-2, Evaluation -- Commercial Items (Oct 2014), applies to this acquisition and the following evaluation is applicable:

(a) The Government will award a contract resulting from this RFQ to the responsible vendor whose quote conforming to the RFQ will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

· technical capability of the item offered to meet the Government requirement

· price

· contract relationship to the current effort and contract references

Contractor is responsible to submit valid forms of contract references such as, but not limited to, name, work phone number, work email, etc. Contractor should notify these individuals in advance regarding this effort in the near future.

Technical and contract references, when combined, are significantly approximately more important thanequal to cost or price.

(b) A written notice of award or acceptance of a quote, emailed or otherwise furnished to the Comment by MCDANIEL, IAN T NH-03 USAF AFMC 78 ABW/JA: Please provide reference that allows contract formation like this. See FAR 13.004(a) (“Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer.”)

If there a statement (a FAR provision or legal authority) that provides for contract formation in this fashion I might have missed it. Thank you for your help.

I saw this is the language from FAR 52.212-2(c), but that language is geared towards the normal RFP process. Here, with quotes, the USG is the offeror when we supply the vendor with an order. If the vendor accepts that order then the contract is established.

successful vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The following addendum applies:

Basis for Award

A. This is a competitive selection conducted in accordance with FAR Part 12 and FAR Part 13.

The Government intends to award one contract as a result of this solicitation. In using the best value approach, the Government seeks to award to the offeror who gives the Air Force the greatest confidence that it will best meet or exceed our requirements affordably in a way that will be advantageous to the Government. This may result in an award to a higher rated, higher priced offeror where the decision is consistent with the evaluation factors and the Contracting Officer CO Comment by MCDANIEL, IAN T NH-03 USAF AFMC 78 ABW/JA: “Contracting Officer (CO)” / if you used “contracting officer” or “CO” before this reference define the acronym at that prior point.

reasonably determines that a lower technical risk and/or superior contract relationship and references performance of the higher priced offeror outweighs the cost difference.

B. Offerors are reminded that the Government will only evaluate one proposal from each offeror. Award will be made to the responsible offeror whose proposal conforms to all required terms and conditions, includes all required representations and certifications, meets all requirements set forth in the RFQ, and also provides the best value to the Government based on the results of the evaluation as described below. Contract terms and conditions consistent with customary commercial practices are specified in the solicitation/contract, with otherwise tailored terms and conditions specified in the Addendum to the solicitation/contract.

C. The evaluation process will be accomplished as follows:

PROPOSAL EVALUATION

The evaluation process will be accomplished as follows (Organized by volume):

Proposal Adequacy: The Government will review all quotes for responsiveness and completeness. If an Offeror fails to comply with the Instructions to Offerors, the Offeror's proposal may be deemed unresponsive and/or incomplete and will receive no further consideration and be eliminated from the competition. The Government will only evaluate proposals deemed responsive and complete.

Discussions: Government intends to award without discussions, but reserves the right to conduct discussions if determined necessary.

Evaluation Process: The evaluation process will be accomplished as follows:

Technical Factor. (a) Each offeror’s proposal shall be evaluated to determine if the offeror provides a sound, compliant approach that meets the requirements of A-A-59888B and any revisions based on the factors identified below and demonstrates a thorough knowledge and understanding of those requirements and their associated risks. The proposal must address each of the following factors in sufficient detail. For each factor, the offerors shall identify any risks associated with the proposed approach and actions taken by the offeror to mitigate the identified risk. If no risks/mitigations are identified in the offeror’s proposal, it indicates the offeror does not consider there to be any risks associated with their proposed approach. The Government will determine a proposal to be compliant and acceptable when it meets the specifications identified in A-A-59888B. The government will evaluate the factors in each proposal as follow: Each offeror's written technical proposal shall be evaluated, based on the subfactors below, to determine if the offeror provides a sound, compliant approach that meets the requirements of the SOW and CID, and demonstrates a thorough knowledge and understanding of those requirements. The technical proposal addresses each of the following subfactors in sufficient detail.

(b) The technical rating reflects the evaluation of the acceptability of the offeror’s technical solution for meeting the Government’s requirement. The technical risk associated with the offeror’s proposed technical approach will also be considered as part of the technical acceptability decision. Technical risk, which is manifested by the identification of weaknesses, assesses the degree to which an offeror’s proposed approach for the requirements of the solicitation may cause disruption of schedule, degraded performance, the need for increased government oversight, and the likelihood of unsuccessful contract performance. The evaluation shall address the Evaluation Team’s identification of any weakness as well as the offeror’s identified risks and proposed mitigation (if applicable) and document why that is or is not acceptable. The Evaluation Team may independently identify risks associated with the offeror’s proposed technical approach not identified by the offeror and assess its impact to successful performance of the contract. Should the Evaluation Team determine that any risks identified by either the offeror or the Evaluation Team poses too great a risk to the program and does not address suitable mitigation, the Government may consider the proposal technically unacceptable.

(c) Based on the results of the written technical proposal evaluations, the Government will assign one of the following two ratings to each technical subfactor. In order to be considered awardable, there must be an “acceptable” rating in every subfactor.

Acceptable: The proposal clearly meets the minimum requirements of the solicitation.

Unacceptable: The proposal does not clearly meet the minimum requirements of the solicitation.

(d) The Government will evaluate offers for award purposes by adding the total price for the basic requirement. Comment by MCDANIEL, IAN T NH-03 USAF AFMC 78 ABW/JA: You referenced something more in Section L; above you have: “The contractor shall submit its prices as outlined in the Attachment X Spreadsheet. It will automatically computer the Total Evaluated prices. Any NSP CLINs shall be marked as a comment in the applicable excel cell.”

I would incorporate that here somehow.

(e) The Government will evaluate and make a decision on the contracts relationship of each proposed offeror’s effort. Final conclusion will be either there is or is not a contract relationship. The Government will then contact the given contract references to gain performance data for those proposals earning a valid given relationship.

Once received the government will evaluate each proposal for a decision that falls in Acceptable or Unacceptable. The lack of sufficient references and/or performance data as determined by the government shall labeled the offeror Unacceptable for award.

(f) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the Comment by MCDANIEL, IAN T NH-03 USAF AFMC 78 ABW/JA: Please provide reference that allows contract formation like this. See FAR 13.004(a) (“Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract.
