The purpose of this amendment is as follows:

1) Update Section L.5: Change the proposal due date to "no later than 5:00pm Eastern

Standard Time, on July 17, 2015."

Change instructions for submission of offers to "electronic version of proposals shall be submitted via email to John Ramsey at ramseyj@sec.gov and carbon copy (Cc) Julia Gallmon at gallmonj@sec.gov. Hard copies of proposals shall not be submitted."

Questions for

Enterprise Process Server Services

Request for Proposal

Q1. Please specify and define the basis for the CLIN amount of $10,000?

$10,000 is the SEC’s estimate of a maximum amount allowed for all ODCs per contract year, based on the best information available to the SEC at the time the solicitation was developed. There is no historical data.

Q2. Does the CLIN of $10,000 reference per individual job unit price or per the amount total?

$10,000 is the total amount of the ODC CLIN for all jobs.

Q3. Plus services will include skip tracing (the process of locating a witnesses, defendants or subjects) and also stake outs (time spent waiting for a subject to be served). Based off past business transactions, there are special cases which may be more often than not, that will demand us going above and beyond the line of duty, that is to locate a subject and stake outs. My concern is should I be bidding the average and work with the COR and CO just for the special cases that may arise post contract for authorization to be paid above and beyond the contract?

See solicitation Section L for instructions on how to prepare your proposal, and solicitation Section M for information how the SEC will evaluation proposals. It is up to the individual companies to make their business decisions on how to structure their proposals. Also, see solicitation item B.2(b) Other Direct Costs which reads, “Other Direct Costs may be used for unusual expenses, such as incidental services for which there is not a labor category specified in the contract, travel, advance fees to gain access to a venue, etc.”

Q4. Because this is a firm fixed price contract, will there be an opportunity to make adjustments to the contract for special cases that involve difficult to locate and serve subjects? This is specifically in regards to the service plus section.

See solicitation item B.2(b) Other Direct Costs which reads, “Other Direct Costs may be used for unusual expenses, such as incidental services for which there is not a labor category specified in the contract, travel, advance fees to gain access to a venue, etc.” See also solicitation item C.3(3) about engaging the SEC POC after 3 failed attempts to serve the papers.

Q5. Can you have a tier based pricing based on geographic region or does the pricing need to be one flat fee?

We are soliciting for one flat fee.

Q6. Do skips and stakeouts fall under the Other Direct Cost category? If no, please advise which category these service would fall under and give an example of an Other Direct Cost.

See solicitation item C.3 which defines Routine, Rush & Service Plus tasks. Skip tracing is defined under item C.3(d), and other direct costs are defined in item B.2(b).

Q7. Please give an example of a Service Plus request.

One example of Service Plus is the additional services of researching/locating a viable address through databases, social media, family members, etc.

Q8. Are you able to share last year's pricing?

This is a new contract requirement and there is no prior year pricing.

Q9. What type of documents will we be serving? Will these documents require in-hand personal service only or is sub-service acceptable?

See solicitation item C.3(b) which states, “(including subpoenas, summons, complaints, notices to appear and other legal documents) by hand-delivery, or other means specified by SEC staff”

Q10. In reference to Section C.3(e) on Page 7 - What happens after three (3) failed attempts and the SEC is notified? Do we wait for the SEC to get back to us with instructions on how to proceed or are we able to close out the job?

If the SEC POC for that job gives instruction to close it out, it may be closed out. If the SEC POC for that job gives instructions to proceed with another attempt, the job may be changed to Service Plus.

Q11. Historically, what percentage of serves resulted in a process server needing to appear in court?

This SEC does not have this information.

Q12. Do the original returns of service need to be returned to the point of contact via email or paper?

The SEC POC will determine the requirement. There may be times when a court will want to see the original returns of service. There may be times when a scanned copy emailed to the SEC POC is preferred by the SEC.

Q13. Do we prepare one invoice for the entire month of services?

Yes. See solicitation item G.3 which states “Invoices shall be submitted on a Monthly basis.”

Q14. In reference to Section C.3(a) on Page 7 - Do we have the option to receive the documents for service via email or is this something that is determined by the SEC on a case by case basis?

Solicitation item C.3(a) states “as determined by the SEC” which will be on a case by case basis.

Q15. In reference to Federal Acquisition Certification mentioned on Page 14, Section G.4(b) - Is this certification for us the vendor or for the SEC?

This certificate is issued to the Contracting Officer’s Representatives (CORs) and Alternate CORs (ACORs), who are SEC employees.

Q16. In reference to the Section 508 standards mentioned on Page 22 of the RFP - Is this information something that gets submitted along with our initial proposal or once the bid has been won?

The RFP contains no requirements for Section 508 documentation to be provided in a proposal.

Q17. In reference to Section L.3(a) on Page 38 - Should the separate volumes be submitted in on two separate CD's or Flash Drives? I would like clarification on how the proposal should be submitted.

CD’s or flash drives shall not be submitted. Offerors shall email electronic copies of their propsoals in accordance with Section L.3 and L.5.

Q18. In reference to Section L.3.1.1 referenced on page 39 - Does not having a Dun & Bradstreet Number (DUNS), North American Industrial Classification System (NAICS) Code, or Product Services Code (PSC) disqualify a vendor from being considered for this RPF?

An potential awardee will need to be registered in SAM.gov before being issued a contract award.

Q19. Is this a follow-on requirement? If so, could you please provide the incumbent contract number for this opportunity? If not, is this a new requirement?

This is a new requirement.
