About this file

This is a Justification for Other Than Full and Open Competition document for a sole-source contract award by the Department of Veterans Affairs (VA) to ScriptPro USA, Inc. The VA's Technology Acquisition Center is seeking to upgrade existing ScriptPro pharmacy management servers and associated hardware, software, and support services at the Salisbury VA Health Care System, which operates across three facilities: Salisbury VA Medical Center, Charlotte Health Care Center, and Kernersville Health Care Center. The upgrade is necessary to meet security requirements and support approximately 476,000 prescription fills annually across all sites.

The specific deliverables include one Enterprise HCI 2000 Server Array, three Workflow Management System Software licenses, two Pharmacy Services Portals, three Remote Access Software packages, three Smart Card Scanners, three RAS Device License Packages, eleven HCI EDGE Virtual Machine Licenses, three ScriptPro Central Expanded Platform licenses, customer hard drive retention systems, robotic systems, endpoint security management software, and various software upgrades (Windows 11 and datapoint/notice board upgrades), along with uninstalls and twelve months of subscription and support for each facility. Equipment delivery is required within 90 days of award, with installation completed within 180 days. The maintenance and support period is twelve months, with an estimated contract value that has been redacted. The contracting activity is located at 23 Christopher Way, Eatontown, NJ 07724. The justification cites FAR 8.405-6(a)(1)(i)(B) as authority, determining that only ScriptPro can provide the required services due to the proprietary and highly specialized nature of its system, with market research conducted in October 2024 examining alternative vendors (Pyxis, Parata Systems, and BestRx) that were determined unable to seamlessly integrate with existing ScriptPro infrastructure. A January 2, 2025 letter from ScriptPro, LLC confirmed it is the sole source provider with no authorized distributors. The contract value does not exceed $750,000.

SCRIPTPRO HCI 2000 SERVERS CONTROL NUMBER VA-25-00093953

4. Statutory Authority: This acquisition is conducted under the authority of the Multiple Award Schedule Program. The specific authority providing for a limited source award is Federal Acquisition Regulation (FAR) 8.405-6(a)(1)(i)(B), “Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.”

5. Rationale Supporting Use of Authority Cited Above: The proposed source for this proposed action is ScriptPro USA, Inc. 5828 Reeds Road, Mission, KS 66202-2740.

Based on the conducted market research, as described in section 8 of this justification, it was determined that ScriptPro is the only source capable of providing the required software, hardware and professional services; therefore there is no competition for this acquisition. This effort is only to upgrade hardware and software components to the existing system in use at Salisbury VA HCS. No other brand hardware or software components can be used to integrate and upgrade the existing ScriptPro management system due to the proprietary nature of the system. ScriptPro is the only authorized provider for the upgrade, as ScriptPro equipment and software are proprietary, and no other product vendors will fully and seamlessly integrate with the currently installed ScriptPro systems. Therefore, only ScriptPro technicians are qualified to upgrade and work on the equipment already installed. Further, no other source is capable of providing the required maintenance support and professional services as access to ScriptPro’s proprietary source code is required in order to ensure the services provided to the hardware and software components of the system are properly configured.

If this system is not upgraded to meet security requirements, all noted VHSO pharmacy locations will be forced to cease use of automation to support prescription processing, resulting in the need to transmit pharmacy results/orders in a manual fashion. This is estimated to be 476,000 prescription fills per year across all sites.

Any such manual intervention would significantly impact VA patient care as VA clinical staff are dependent on the existing ScriptPro Workflow system to safely distribute Veteran medications in an accurate and timely manner. Furthermore, if VA were to switch vendors from ScriptPro, VA facilities would have to replace the existing ScriptPro system. All current ScriptPro systems are estimated to be valued at over $1,500,000.00 in replacement cost which would not be recovered through competition. This estimate is based on previous upgrade efforts of similar size and scope. Additionally, the estimated timeline for installing a new functional interface with a different provider would be at least one year or longer and would negatively impact Salisbury VA HCS’s ability to support prescription processing needs. The loss of automation use would affect patient safety and record retention for all 476,000 prescription fills.

ScriptPro is the only vendor able to provide time-saving solutions to fit the unique needs of VA. Based on the above information, only ScriptPro meets all the Government’s requirements and is the only capable solution.

6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government’s requirements. There is no competition anticipated for this acquisition. Additionally, the proposed action will be synopsized on the Contracting Opportunities Page in accordance with FAR 5.201. Any proposals that are received shall be evaluated.

7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be completed.

8. Market Research: The Government’s technical experts conducted market research in October 2024 by conducting online reviews of similar software and equipment to ascertain if these items could meet VA’s requirements. Alternate product suppliers researched were Pyxis, Parata Systems, and BestRx. While these competing products provide some of the capability required by VA, these products do not seamlessly integrate with existing ScriptPro systems due to proprietary nature of the existing ScriptPro system. Based on this market research, VA’s technical experts confirmed that only brand name ScriptPro hardware, software, maintenance and professional services can meet all of VA’s requirements for this effort. Additionally, on January 2, 2025, the Government obtained a letter from ScriptPro, LLC stating that they are the sole source for upgrades and support for ScriptPro equipment and have no authorized distributors.

Based on these market research efforts, the Government has determined that only ScriptPro, LLC can meet the Government's needs. As such, there is no expectation of competition even in a limited capacity.

9. Other Facts: None.

10.Technical/Requirements Certification I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.

11. Fair and Reasonable Cost Determination

I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable based on price analysis to include the Independent Government Cost Estimate and prices obtained through market research for the same or similar items.

12. Contracting Officer Certification/Approval

I certify that this justification is accurate and complete to the best of my knowledge and belief. This contract action exceeds the simplified acquisition threshold, but does not exceed $750,000, therefore, the certification required by FAR 6.304(a)(1) serves as the Contracting Officer’s approval.
