About this file
This is a Justification for Other Than Full and Open Competition submitted by the Federal Bureau of Prisons for a sole source acquisition.
The Federal Bureau of Prisons, specifically FCI Pekin located at 2600 S. 2nd Street in Pekin, Illinois, seeks to award an operating lease to Scriptpro USA Inc. for the Scriptpro 150 CRS equipment and software currently installed in the facility's pharmacy. The required items include the CRS 150 unit, Smart Card Scanner, Host Based System Security (Robotic System), Customer Hard Drive Retention Robotic Systems, Endpoint Security, SPX00 CRSX with i5c4 CPU, and Windows 11 OS with i5c6 CPU and hardware upgrade. The quoted price is $2,382.62 per month, totaling $28,591.44 for fiscal year 2027. The justification cites 41 U.S.C. 3304(a)(1) and FAR Part 6.103-1(b) as the statutory authority for sole source acquisition based on only one responsible source being available.
The Contracting Officer, Gary Kurtz, determined that Scriptpro USA Inc. is the only vendor capable of providing this requirement due to proprietary control of the equipment and software. Market research conducted under FAR Part 10 confirmed the requirement is a commercial item, but the proprietary nature of the system eliminates competition. No other vendors expressed written interest, and no barriers to competition exist that can be overcome. The Contracting Officer certified the price as fair and reasonable based on historical pricing for the same equipment. The justification was signed on September 18, 2026, with a commitment to monitor for future competitive opportunities if other vendors develop compatible replacement systems.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Pursuant to the Federal Acquisition Regulation (FAR) Deviation Subpart 6.103-1 , the Federal
Bureau of Prisons (BOP) has determined that the acquisition of the Scriptpro 150 CRS
Operating Lease from Scriptpro USA Inc. is the only vendor that can provide this requirement to
FCI Pekin.
Agency:
Department of
Justice
Bureau of
Prisons
FCI Pekin 2600 S. 2nd
St.
Pekin, IL 61554
Nature and/or Description of Action Being Taken: FCI Pekin intends to make an award to a sole source provider, Scriptpro USA Inc, for the requirement of an operating lease for the Scriptpro 150
CRS equipment and software installed the FCI Pekin Pharmacy.
Description of supplies or services required to meet the agency's needs: The following line items:
CRS 150 (1), Smart Card Scanner (1), Host Based System Security (Robotic System) (1), Customer
Hard Drive Retention Robotic Systems (1), Endpoint Security (per robotic system) (1), SPX00, CRSX with i5c4 CPU (1), Win 11 OS, i5c6 CPU and Hardware upgrade (1); are installed in the FCI
Pekin Pharmacy located at 2600 S. 2nd St. Pekin, IL 61554. The quoted price for all line items is
$2,382.62 per month, with a total of $28,591.44 for FY 27.
Statutory Authority permitting other than full and open competition: This justification is being submitted for approval in accordance with 41 U.S.C. 3304(a)(1), and FAR Part 6.103-1(b)
(Only one responsible source and no other supplies or services will satisfy agency requirements).
Determination that the nature of the acquisition requires use of the authority cited:
The Scriptpro 150 CRS is currently installed in the FCI Pekin Pharmacy. This equipment is used
Bureau wide and has BARS approval. Removing this equipment and attempting to procure equipment form another vendor would result in a competitive process to include tech approvals at the
Central Office level that would inhibit the mission of the FCI Pekin HSU and create additional costs that would not be recovered by competition.
Efforts made to solicit from as many potential sources as practicable, including whether a notice was or will be publicized:
Scriptpro USA Inc.is the only vendor that can be used because they are the manufacturer of the
Scriptpro 150 CRS, and have proprietary control of the equipment and software.
Contracting Officer Determination that the cost to the Government will be fair and reasonable:
The Contracting Officer determines the price for this equipment to be fair and reasonable based on prices paid in the past for the same equipment.
Description of the Market Description Market Research
Conducted Market Research was conducted in accordance with FAR Part 10 and to the extent commensurate with the urgency, established value and complexity of the requirement. Market
Research supported the determination concerning the most suitable approach for acquiring the subject supplies and services. It has been determined this requirement cannot be met in accordance with FAR Part 8. Market Research revealed the requirement is a commercial item customarily available through the commercial marketplace. However, due to the proprietary nature of the equipment and software.
Other facts supporting the use of other than full and open competition:
There are no other vendors that can provide this requirement.
List of sources expressing in writing interest in the acquisition:
None. This became a sole source acquisition because the equipment is manufactured by Scriptpro
USA Inc. and they have proprietary control over the equipment and software being leased.
Action taken, if any, to remove or overcome any barriers to competition:
There is only one source currently available that can provide the requested materials. This requirement will be monitored to determine if other vendors are able to replace hardware, software and monitoring systems that would make for a competitive acquisition. A formal solicitation would be issued at that time.
Contracting Officer's Certification:
I hereby certify that this request for justification and Approval for Other than Full and Open
Competition is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge. I hereby certify that the supporting data provided by the technical and requirements personnel that form the basis for this justification are certified as complete and accurate. See attached memo from the General Foreman.
