About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for the Federal Bureau of Prisons (BOP) at FCI Pekin. The document justifies a sole source acquisition of a ScriptPro 150 Prescription Dispensing System monthly rental and technical support services from ScriptPro USA Inc. for Fiscal Year 2026, with a total value of $27,643.44. The procurement is being pursued under FAR 6.302-1(a)(2) because the ScriptPro system is a proprietary item already installed at FCI Pekin, is the only system approved in the BOP Formulary manual, and ScriptPro's warranty would be voided if alternative equipment or software is installed. Market research revealed no alternative sources, and attempting to find a replacement would result in duplicative costs that would not benefit the government. The Contracting Officer has determined the pricing to be fair and reasonable through comparison with previous contracts and maintained Federal Supply Schedule (FSS) pricing.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

For

FCI Pekin Pursuant to the Federal Acquisition Regulation (FAR) Part 6.302-1(a)(2), and the Bureau of Prisons Acquisition Policy (BPAP) Part 6.304 (c), the Federal Bureau of Prisons (BOP) has determined that the procurement of a ScriptPro 150 Prescription Dispensing system monthly rental and technical support services form ScriptPro USA Inc. meets the criteria established for other than full and open competition. This limitation on competition is justified as supported by the following information in accordance with FAR Part 6.303-2:

(1) IDENTIFICATION OF THE AGENCY:

U.S. Department of Justice Federal Bureau of Prisons FCI Pekin 2600 S. 2nd St.

Pekin, IL 61554

(2) NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:

This action is for the sole source acquisition of a ScriptPro 150 Prescription Dispensing System monthly rental and technical support for FY 26.

(3) DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY NEEDS:

The acquisition of a ScriptPro 150 Prescription Dispensing System monthly rental and technical support for FY 26. The value of the requirement is $27,643.44.

(4) AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL

AND OPEN COMPETITION:

41 U.S.C. 253(c) (2), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2), When the supplies or services required by the agency are available from only one responsible source, or, for

DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

(5) A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR

THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED:

FAR Part 6.303-1(b)(1)(i): Unique supplies or services available from only one source or only one supplier with unique capabilities. The ScriptPro 150 Dispensing System has already been installed and is in use at FCI Pekin. It is the only such item approved for use in the BOP Formulary manual.

ScriptPro’s warranty is voided if equipment or software is installed other than as authorized in writing by ScriptPro USA Inc.

(6) A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE INCLUDING WHETHER OR NOT A

NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY FAR SUBPART. 5.2:

FAR Part 6.302-2(b)(2): Market research revealed no responsive sources. The ScriptPro 150 Dispensing System is a proprietary item available only from ScriptPro USA Inc. Attempting to find a replacement would result in a duplication of costs that would not be financially beneficial to the Government.

(7) A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO

THE GOVERNMENT WILL BE FAIR AND REASONABLE:

Price analysis has been conducted in accordance with FAR 15.404-1(b)(2)(v), The Contracting Officer has determined the price to be fair and reasonable through comparison of proposed prices with previous contracts with ScriptPro. Furthermore, despite the line items in this contract action no longer being offered as part of ScriptPro’s FSS Schedule contract, ScriptPro is still offering FSS pricing.

(8) A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED:

Market research was conducted to deem the cost fair and reasonable in relation to past experience with this vendor.

(9) ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION:

None

(10) A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE

ACQUISITION:

None.

(11) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR

OVERCOME BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR

THE SUPPLIES OR SERVICES REQUIRED:

Approve like kind items for use in BOP facilities.

(12) CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS ACCURATE AND

COMPLETE:

In accordance with FAR 6.303-2(12), I certify that the justification is accurate and complete to the best of my knowledge and belief. The estimated price listed is deemed fair, reasonable and advantageous to the Government based on prior purchased orders and submitted quotes.
