1 SCOPE OF WORK:

1.1 The work includes the following and incidental related work:

1.1.1 Provide repairs to Substation 7 in accordance to all drawings and specifications per attachments (2) through (7).

2 BASIS OF BID:

2.1 The contractor shall provide a firm fixed price for each work item and reflect the value of the material, labor and equipment with a line item total by completing the attached proposal form.

3 GENERAL REQUIREMENTS:

3.1 All work performed by the Contractor shall be in accordance with the requirements specified in herein and the project specifications and all local, State and Federal

Codes.

3.2 The means and methods of work associated with this project shall be in accordance with the tasks specified on the enclosed contract documents and the following general requirements:

3.3 Division 01 - General Requirements Specification

3.3.1 All requirements of Division 01 apply to this project unless otherwise noted herein or other contract documents or if means and methods do not invoke the requirement (i.e.: no confined space, no hazardous waste, etc.). Refer to the

3.3.2 The Contractor shall coordinate all work to permit Navy/Facility Operations to be performed during the course of work. It is anticipated that the Contractor may need to work outside normal work hours and /or weekends to ensure

Shipyard/Facility operations are not impacted by work performed by

Contractor. Additionally, some delays due to periodic work stoppages or changes in work sequence necessitated by the Shipyard/Facility operations should be anticipated and taken into account by the Contractor. The performance period and contract completion date specified by the Contract includes adequate float to cover any such delays that may result.

Consequently, any delay claimed by the Contractor will not be entertained if they are related to such schedule impacts due to Shipyard/Facility operations.

3.3.3 All work shall be fully coordinated with the Contracting Officer’s

Representative and PWD-ME and shall comply with all Work Restrictions specified in Specification Section 01 14 00.00 22.

3.3.4 Contractor shall provide all supervision, labor, materials, tools, equipment, and transportation necessary to perform tasks within this project.

3.3.5 The project is located in and adjacent to special requirement areas that require special Shipyard coordination and briefing. The Contractor shall coordinate work in these areas with Shipyard personnel. Areas are as indicated on the

Plans. Coordinate with CM/ET Construction Management Team.

3.3.6 The Contractor must ensure work is conducted and completed in such a manner to allow access for emergency response vehicles throughout the construction period.

3.4 Contractor Security Responsibilities (PNSY)

3.4.1 Contractor employees shall not transport, drink, or have in their possession any alcoholic beverages. Possession of any controlled substances without a physician's prescription is also prohibited. Any Contractor employee appearing to be under the influence of intoxicating liquor or narcotics will be apprehended by Shipyard Police, escorted off of the Portsmouth Naval

Shipyard, and turned over to the local Police Department.

3.4.1.1 Any vehicle found to contain controlled substances, including usable residue, may be seized and impounded. Within 24 hours of the work day following any vehicle seizure, the Portsmouth Naval Shipyard

Police will have determined whether forfeiture of the vehicle is required. If not, the vehicle will be returned to the owner or authorized agent. If the vehicle is determined to be appropriate for forfeiture, the Portsmouth Naval Shipyard's Legal Officer will notify the Drug Enforcement Administration of such seizure and

Page: 3 of 21 impoundment, for initiation of forfeiture proceedings pursuant to

Title 2l, U.S. Code, Section 88l. Such actions may be taken regardless of whether the owner/operator of the vehicle had knowledge of the presence of drugs in the vehicle. The Government may pursue criminal or other disciplinary actions pursuant to Title l8, U.S. Code, Section l382.

3.4.2 Possession of firearms, ammunition and/or explosives is prohibited. In the event explosives are required for construction work, specific handling requirements and approvals shall be obtained from the Security Officer via the

Contracting Officer.

3.4.3 Cameras, video equipment, or similar photographic equipment shall not be introduced into nor removed from the Portsmouth Naval Shipyard. In the event such equipment is required for performance of contract work, approvals shall be obtained from the Security Officer via the Contracting Officer.

3.4.4 Weapons (firearms, personal knives with blades 2-1/2 inch long or greater, Mace, Pepper Spray etc.) are not permitted aboard the Shipyard.

3.4.5 Cell phones equipped with cameras are permitted aboard the Portsmouth

Naval Shipyard outside NAVSEA controlled spaces such as the Controlled

Industrial Area (CIA), but taking pictures is not allowed.

3.4.5.1 The following are the penalties for any Contractor personnel or

Subcontractor Personnel that are found to be in possession of a camera or cell phone equipped with a camera taking pictures outside

NAVSEA spaces:

3.4.5.1.1 1st offense with pictures: Full investigation with security forces and NCIS, camera or cell phone confiscation, and depending on results of investigation 30 days restriction.

3.4.5.1.2 2nd Offense with pictures: The offender will be permanently barred from access to NAVSEA spaces.

3.4.6 Cameras, or cell phones equipped with cameras, are not allowed in any

NAVSEA space such as the CIA, NWA, CNIA or Security Island.

3.4.6.1 If a Contractor is found with a camera equipped cell phone in a

NAVSEA space, the Standard Access Control Badge (SACB) and

Defense Biometric Identification System card (DBIDS) will be confiscated. Access to the installation will be denied and a Security

Deficiency Log (SDL) will be issued.

3.4.6.2 Cell phones with no pictures of NAVSEA spaces:

3.4.6.2.1 1st Offense: There is a 10 day deadline for completion of the SDL. Credentials will be reissued to the offender once

Page: 4 of 21 the SDL response is received from the contracting company, reviewed and accepted by the Security office.

3.4.6.2.2 2nd Offense: The offender will be permanently barred from access to NAVSEA spaces.

3.4.6.3 Cell phones with pictures of NAVSEA spaces:

3.4.6.3.1 1st offense: The offender will be permanently barred from access to NAVSEA spaces.

3.4.6.3.2 At a minimum, all Superintendents & SSHO (and anyone acting in this capacity) shall have a CIA compliant mobile phone on their persons any time while work is occurring at the contract jobsite(s). The phone number(s) associated with these phones shall be provided during the pre-con meeting and work will not be allowed to proceed without one.

3.4.7 Laptops and any other computer, regardless of form factor, shall not be introduced nor removed from Portsmouth Naval Shipyard without authorization. Only business use computers are allowed. Contractors are not authorized to bring personally owned computers on-yard. If a computer is required to perform work on-yard, a Visitors Portable Computer Equipment

Registration form must be completed and submitted for approval. These forms can be obtained and completed at the pass office upon entrance to the shipyard or your shipyard POC.

3.4.8 Any computing devices that also have or had an installed camera, must follow the same requirements as cell phones. If the computing device is visiting a

NAVSEA space, it cannot have a camera. If the device has a camera, the only acceptable remediation is that the camera be professionally removed or drilled out and the resulting void must be filled with an opaque epoxy.

3.4.9 In the event that a camera is required for the performance of the contracted work, approval must be obtained from the C1120 security office. In the event of any deviation from the requirement to remove and epoxy the camera, authorization must be sought from C1120. All requests for camera use and deviations should come to C1120 through your COR or Shipyard POC.

Authorizations and approved computer registrations must remain with the devices and be presentable upon request. Devices without a documented approval or observed being used in a manner that violates the terms of the

Visitor Portable Computer Equipment Registration agreement are subject to search and seizure.

3.4.10 Use of wireless networking and communication on-yard by a contractor requires prior authorization. Communication devices such as cellular hotspots and wireless routers must also be registered using the same Visitors Portable

Computer Equipment Registration. This does not include air-cards and straight cellular data. It does include any device that transmits or broadcasts

Wi-Fi, including cellular phones with the personal hot-spot feature enabled.

3.4.11 Broadband internet connections must be authorized prior to use on-yard. All requests for physical cable service from an internet service provider (ISP) must be authorized and coordinated through C109. Contractors must work through their COR to request broadband access.

3.4.12 Driver use of a hand-held cellular phone in a moving vehicle on the

Portsmouth Naval Shipyard is prohibited. This prohibition does not include hands-free cellular phone devices. Hands-free devices include console/dash-mounted or otherwise secured cellular phones with integrated features such as voice-activation, speed dial, speakerphone or other similar technology for sending and receiving calls.

3.4.12.1 Driver use of any portable, personal listening device worn inside the aural canal, around or covering the driver's ear while operating a motor vehicle, is prohibited. Listening devices include wired or wireless earphones and headphones (including blue tooth or similar technology), and do not include hearing aids or devices designed and required for hearing protection.

3.4.13 The use of radar or laser detection devices to indicate the presence of speed recording instruments or to transmit simulated erroneous speeds is prohibited in accordance with OPNAVINST 5100.2H.

3.4.14 The Contractor shall indoctrinate personnel on access limitations to ensure security control is maintained as an integral part of their work pattern and habit.

3.4.15 Contractor is advised that any unescorted personnel found in security areas requiring a higher level clearance than the level represented by the badge displayed will be removed from the area with possible confiscation of security badges and vehicle passes.

3.5 Utility Locating Requirements:

3.5.1 The Contractor shall locate all utilities within the limits of ground penetrating work as specified in Specification Section 01 35 26.00 22.

3.5.2 The contractor shall provide the services of a qualified independent utility locating company/person(s) (Cannot be the Government’s Utility Locating

Firm). The utility locating company shall indicate the utility type, size, and depth of all utilities within the proposed area of excavation including, but not limited to, voice/data, electrical, gas, water, sanitary sewer, and storm drainage.

3.5.3 The Contractor shall be responsible for any damage to underground utilities which occur during excavation or ground penetrating work.

3.5.4 The contractor/excavator shall notify Dig Safe (1-888-344-7233) within 14 calendar days, but no more than 30 calendar days, prior to the start of excavation or ground penetrating activity. The contractor/excavator shall comply with the State of Maine “Dig Safe” law (Title 23, MSRA 3360-A). If there are any questions regarding the Dig Safe process or underground utilities, contact the Contracting Officer Representative.

3.6 Utilities Within and Under Concrete Slabs, Bituminous Asphalt and Other

Impervious Surfaces:

3.6.1 Utilities located within and under concrete slabs or pier structures, bridges, parking areas, and the like, are extremely difficult to identify. Whenever contract work involves chipping, saw cutting, or core drilling through concrete, bituminous asphalt or other impervious surfaces, the Contractor shall provide the services of a third party, independent, private locating company to locate any utilities within the limits of work. The third party, independent, private locating company shall locate utility depth by use of

Ground Penetrating Radar (GPR), X-ray, bore scope, or ultrasound prior to the start of demolition and construction. Outages to isolate utility systems must be used in circumstances where utilities are unable to be positively identified.

The use of historical drawings does not alleviate the contractor from meeting this requirement.

3.6.2 The Contractor shall ensure work is conducted and completed in such a manner to allow access for emergency response vehicles throughout the construction period.

3.7 Contractor Laydown Space:

3.7.1 Contractor lay down space is to consist of an area as shown on the contract documents. Any additional space required to complete this work must first be approved by the Contracting Officer.

3.8 Construction Site Plan

3.8.1 The Contractor shall submit a site construction plan showing the locations and dimensions of temporary facilities (including layouts and details, equipment and material storage area (onsite and offsite), access and haul routes, avenues of ingress/egress to the fenced area and details of the temporary construction safety fencing/barriers systems that complies with EM385-1-1 Sections 4 & 8.

3.8.2 Identify any areas where vehicle track pads will be installed to prevent the tracking of mud onto the pavement outside the project site limits. Indicate if the use of a supplemental or other staging area is desired.

3.8.3 Show locations & types of safety and construction fences/barrier systems, site trailers, construction entrances, trash dumpsters, temporary sanitary facilities, dewatering system storage tanks and infiltration pits. See EM385-1-1 Section

4.

3.9 Temporary Project Safety Fencing

3.9.1 Prior to the start of Construction, the Contractor shall furnish and erect temporary project safety fencing at the work site in accordance with the plans

& following requirements:

3.9.1.1 Temporary project fencing (or a substitute acceptable to the

Contracting Officer (GDA) and delineated in the APP) shall be provided on all projects. See also EM385-1-1 Sections 4 & 8.

3.9.1.2 Fencing shall extend from grade to a minimum of 4 ft above grade and shall have a maximum mesh size of 2 in. Fencing shall remain rigid/taut with a minimum of 200 lbs of force exerted on it from any direction with less than 4 in of deflection.

3.9.1.3 Signs warning of the presence of construction hazards and requiring unauthorized persons to keep out of the construction area shall be posted on the fencing. At minimum, signs shall be posted every 150

ft. Fenced sides of projects that are less than 150 ft shall, at minimum, have at least one warning sign.

3.9.1.4 Depending upon the nature and location of the project site, The

Contractor may request to modify the type of barrier or not install temporary fencing in some sections of the project site. The

Contractor’s SSHO shall submit a risk analysis (AHA) to the

Contracting Officer for review. This shall be based on a risk analysis of public exposure and other project specific considerations, and shall be included in the applicable AHA.

3.9.2 If the Contracting Officer approves the request and has determined fencing is not required, the Contractor shall install signs, other acceptable barriers systems, warning of construction hazards, shall be conspicuously posted.

3.9.3 If at any time it is determined the risk to the public changes based on the

Contractor’s work, the Contractor shall take immediate action to address any risk to the public.

3.9.4 The Contractor shall dispose of all removed materials in accordance with the

Shipyard/Facility, local, State and Federal regulations.

3.10 Concrete Work

3.10.1 Special attention shall be paid to any/all concrete work in/around Dry Docks.

Controls must be provided to ensure that concrete material (i.e., concrete

Page: 8 of 21 debris, dust, concrete sawing waste water, wash water, curing water, and storm water in contact with curing concrete) does not enter the closed drainage systems of any Shipyard dry dock. Also, elsewhere onsite, concrete material (as stated above) should be prevented from entering any drainage structure.

3.11 For any work on or near the roofs

3.11.1 The Contractor shall notify the CM/ET prior to commencing work in these areas as there are potential safety hazards associated with building transmitters. This work shall be fully coordinated with Code 109 (Roy Dodge) to ensure contractor safety.

3.12 For any work on or in a dry dock or pumpwell

3.12.1 All work completed within the dry docks and pumpwells shall have a

Flooding Mitigation Strategy Plan. The process for development of this plan shall start with a meeting to determine any locations of possible flooding.

3.12.1.1 The plan shall cover all penetrations through structures which may be sources of flooding of the pumpwell, the dry dock, or an associated structure.

3.12.1.2 Flooding sources considered include the Piscataqua River as well as surface rain water.

3.12.1.3 The plan shall identify the source of flooding, provide a strategy for mitigating flooding from that source and details on when that mitigation will be in place (e.g. pipe that is currently open to the river will have double valve protection when not actively being worked).

3.12.1.4 Provide product data sheets with the plan. The plan shall also include an inspection program to verify proper installation and maintenance of all mitigation strategies.

3.12.1.5 The plan shall be submitted and approved by the Contracting

Officer.

3.13 For any work working inside of or within 10 feet of the coping of the dry dock and its associated structures

3.13.1 Personnel working inside of or within 10 feet of the coping of the dry dock and its associated structures shall have Shipyard 6010 training. Associated structures include pumpwells, service tunnels, altar pits, etc. This training will be provided, at the Shipyard, to the contractor at no cost and is approximately

4 hours in duration. Coordinate training schedule with the Contracting Officer.

3.13.2 Personnel that complete 6010 training can serve as an escort for up to 5 additional contractor personnel or subcontractors. The escort must be within

10 feet or audio range, whichever is closer, and is responsible for the safety of the personnel they are escorting in an emergency.

3.14 Site Work Requirements:

3.14.1 For any Site work projects in the State of Maine:

3.14.1.1 Site work in the State of Maine Shoreland Zone, including any filling, excavation, landscaping, and/or other earthwork in excess of one cubic yard of disturbance, shall comply with State of Maine requirements for certification in erosion and sediment control practices. A certified individual shall be responsible for management of erosion and sediment control practices at the site each day earth moving activities occur. A certified individual is required to visit the site every day to ensure proper erosion and sediment control practices are followed. As an alternative, the Contractor may choose to contract with a certified individual to supervise the Contractor's work in Shoreland areas. Under the State of Maine's Shoreland

Zoning Statutes, the Portsmouth Naval Shipyard, Cutler Naval

Support Activity & Prospect Harbor Facilities are located within the state's Shoreland zone.

3.14.1.2 Erosion and sediment control measures shall be installed and maintained in accordance with Maine Erosion and Sediment Control

Law and Maine Erosion and Sediment Control Practices Field Guide for Contractors, latest edition. Erosion control inspections are required both before and after a precipitation event that has the potential to create runoff and at least weekly at a minimum.

Contractor shall provide inspection reports to CM electronically weekly.

3.14.2 The Contractor shall restore disturbed areas surrounding limits of work to original conditions. Reuse the existing soil material, if considered suitable, to the greatest extent possible, and compact in accordance with technical specifications. Suitable backfill material shall be fine readily compressible soil or granular material, at or near optimum moisture content, and shall not contain stones larger than 3 inches, frozen lumps, chunks of clay, mineral matter, or any other objectionable material.

3.14.3 Any pavement and pavement markings removed or disturbed by the construction shall be replaced in-kind.

3.14.4 During construction, the Contractor shall provide sediment erosion controls and dewatering controls to ensure that excavation material (i.e., debris, dust, silted or contaminated water, storm water) does not enter any drainage system.

Erosion and sediment controls shall be installed and maintained in accordance

Page: 10 of 21 with applicable state Best Management Practices appropriate for the site conditions.

3.14.5 Construction dewatering shall comply with Section 31 23 00.00 22 and State of Maine erosion and sediment control requirements and State water quality standards. Dewatering discharges shall be re-infiltrated within the project limits unless written permission is granted by the Government for an alternative method. Dewatering discharges shall not be released to the storm drain system.

3.15 Soil Management & Disposal Requirements

3.15.1 For this Project, the excavation work is located outside and/or within an IR

Site.

3.15.2 Any excess soils shall be sampled & tested by the Contractor. Once the sampling has been reviewed by Code 106.3, the Contractor shall transport the soils to a licensed disposal facility

3.15.3 The Contractor shall comply with the requirements specified in Section 31 23

00.00 22 for Soil Management and Disposal requirements. All soil sampling shall be coordinated with Code 106.3. Code 106.3 shall be notified at a minimum of seven (7) working days in advance of desired soil sampling event to allow Code 106.3 to be present during the sampling. No Soils shall be removed from PNSY without approval from Code 106.3.

3.16 Access to Unclassified Information

3.16.1 Access to U.S. Navy technical information manuals, documents, drawings, plans, specifications, and other information (e.g., photos, presentations, renderings, papers, etc.) is government propriety and restricted to an official need-to-know basis. Handle, control, and safeguard to prevent oral, visual, and documentary disclosure to the public, to foreign sources, and to personnel not having an official need-to-know.

3.17 Disclosure of Information (Only include based on input from PNSY PAO & Security)

3.17.1 The Contractor shall not release to anyone outside the Contractor's organization any unclassified information, regardless of medium (e.g., hard copies, computer files, film, tape, document), pertaining to any part of this contract or any program related to this contract, unless the Contracting Officer has given prior written approval;

3.17.2 Requests for approval under paragraph (a)(1) shall identify the specific information to be released, the medium to be used, and the purpose for the release. The Contractor shall submit its request to the Contracting Officer at least 10 business days before the proposed date for release.

3.17.3 The Contractor agrees to include a similar requirement, including this paragraph (c), in each subcontract under this contract. Subcontractors shall submit requests for authorization to release through the prime contractor to the

Contracting Officer.

4 PERIOD OF PERFORMANCE:

4.1 BASE BID PERIOD OF PERFORMANCE 335

4.2 ESTIMATED ON SITE TIME: 210

4.3 The Contractor shall mobilize and commence work as soon as reasonably feasible from date of contract award but no later than 3-4 weeks after award.

5 NOTIFICATION OF COMMENCEMENT:

5.1 In accordance with the contract award notification & contract requirements, the

Contractor shall provide payment and performance bonds for 100% of the contract/task order value, as well as a Certificate of Insurance to the Contracting

Officer within ten (10) calendar days of the award notification. Once bonds have been authenticated, the Contractor will be issue a Notice to Proceed.

5.2 The Contractor shall notify the Construction Manager assigned to this project to arrange and hold a pre-construction conference with all interested parties prior to start of work. The Pre-Construction Conference shall be held no later than 30

Calendar days from receiving the Notice to Proceed from the Contracting

Officer.

5.3 The following Preconstruction submittals shall be submitted to the Contracting

Officer fifteen (15) calendar days prior to the pre-construction conference:

6 WINTER CONSTRUCTION CONDITIONS:

6.1 This Task Order will require construction operations during winter weather. The

Contractor shall include all materials, labor, equipment, and supervision required to perform the above work in cold weather conditions.

7 HAZARDOUS MATERIALS:

7.1 The following hazardous materials are either known or assumed to be present within the work area based upon recent tests coordinated by PWD-ME or from review of record documents. The Contractor shall provide means and methods of work in conformance with all applicable local, State, Federal, and Shipyard Regulations pertaining to working within or near these materials.

Asbestos/Hazardous Building Materials; G. Brown; 3/19/20: If the evaluation indicates the presence of hazardous materials, including asbestos and/or heavy metals, the Contractor shall provide means and methods of work in conformance with applicable local, State, and Federal regulations pertaining to working within or near these materials.

7.1.1 Hazardous Soil:

7.1.1.1 Soils are assumed to be non-hazardous and no site specific Health &

Safety Plan (HASP) is required. If suspect soils are encountered, work must stop and PWD-ME EV and PNSY (Code106.3) must be notified.

7.1.1.2 All excess soils removed from the site must be disposed of at a non-municipal licensed landfill to track cradle to grave disposal.

7.1.1.3 All excess soils must be transported to Building 357 prior to leaving the Shipyard to be weighed and to process required shipping documentation.

7.1.1.4 For excess soils <50 cubic yards, the Contractor shall be responsible for hauling the material to a storage bin at PNSY (Building 357).

7.1.2 Asbestos: If evaluation indicates the presence of asbestos, the Contractor shall provide means and methods of work in conformance with all applicable local, State, Federal, and Shipyard Regulations pertaining to working within or near these materials.

7.1.3 Heavy Metal-Containing Paint: If evaluation indicates the presence of heavy metal-containing paint, the Contractor shall provide means and methods of work in conformance with all applicable local, State, Federal, and Shipyard

Regulations pertaining to working within or near these materials.

7.1.4 Other (PCBs, Mercury-containing Devices, etc.): If evaluation indicates the presence of other hazardous materials, the Contractor shall provide means and methods of work in conformance with all applicable local, State, Federal, and

Shipyard Regulations pertaining to working within or near these materials.

7.2 Unforeseen Hazardous Material

7.2.1 Contract documents identify materials such as friable and non-friable asbestos, heavy metals-containing paints, PCBs, and other OSHA-regulated

Page: 14 of 21 chemicals (i.e. 29 CFR Part 1910.1000). If other material(s) that may be hazardous to human health upon disturbance are encountered during construction operations, stop that portion of work and notify the Contracting

Officer immediately.

7.2.2 If any suspect materials are encountered and not identified as hazardous in the

Contract Documents, the Contractor shall have the material tested as follows:

7.2.3 Hazardous Material Sampling:

7.2.3.1 Conduct all required testing and reporting of hazardous materials

(e.g. asbestos, heavy metals, PCBs, etc.) per UFC 3-800-10N, General Environmental Requirements.

7.2.3.2 Conduct Asbestos, Heavy Metals, and PCB Surveys for utilities, structures, and any other items as determined necessary to determine if materials are hazardous. Analyze asbestos bulk samples by

Transmission Electron Microscopy (TEM). Analyze paint samples

(bulk and wipe samples) for RCRA 8 metals by atomic absorption spectrophotometry (AAS). Analyze waste stream samples for RCRA

8 metals using the Toxicity Characteristic Leaching Procedure

(TCLP).

7.2.3.3 Include the cost for sampling and analysis of the following in the base bid proposal for this project:

7.2.3.3.1 10 Asbestos bulk samples

7.2.3.3.2 10 Paint samples (bulk and wipe)

7.2.3.3.3 5 Composite TCLP lead samples for demolition waste stream categorization

7.2.3.4 If the sampling and laboratory analysis indicate that the material is not hazardous or poses no danger, the Government will direct the

Contractor to proceed without change. If material is hazardous and handling of the material is necessary to accomplish the work, the

Government will issue a modification pursuant to FAR 52.243-4, "Changes" and FAR 52.236-2, "Differing Site Conditions."

8 CODE/REGULATORY REQUIREMENTS:

8.1 All work performed by the Contractor shall be in accordance with the requirements specified in the Project Specifications and all local, State and Federal Codes.

9 ENVIRONMENTAL PROTECTION REQUIREMENTS:

9.1 The Contractor shall prepare and submit an Environmental Protection Plan in accordance with the requirements specified in Specification Section 01 57 19.00 22.

9.2 The Contractor shall ensure compliance with the requirements related to Concrete

Wash Water specified in Specification Section 01 57 19.00 22.

9.3 This task order does not have a separate State or Federal permit.

10 CULTURAL AND NATURAL RESOURCE REQUIREMENTS:

10.1 The Contractor shall include the following in their means, methods, and scheduling of work:

10.1.1 In the event that archaeological resources are identified during construction, work shall stop immediately and notify the Contracting Officer and PWD-ME

ENV (Kerry Vautrot, 207-438-4488/Peter Michaud 207-438-4095) for further direction. Work shall not resume until directed by the Contracting Officer to proceed.

10.1.2 The proposed project is located within an area of archaeological sensitivity and archaeological monitoring by an archaeologist meeting the Secretary of the Interior’s Professional Qualifications and on the Maine approved list is required to be onsite during all ground disturbing activities within this area.

The Contractor shall ensure compliance with the requirements related to

Specification Section 01 44 00.22 (Archaeological Monitoring PWD ME).

10.1.3 Building 165 is a historic building and this work will result in an adverse effect on historic properties. While the Navy has worked to minimize effects through incorporating design principles which comply with the Secretary of the Interior’s Standards for the Treatment of Historic Porperties: Standards for Rehabilitation whenever practicable, mitigation is required. In addition to the building repairs included in this scope, additional mitigation outlined in

Attachment (7) shall be required. Any deviations from the proposed design must be reviewed by the PWD-ME Cultural Resources Manager and may require submission by the GOV to the Maine State Historic Preservation

Office (45 day review)

10.1.4 Coordination with the PWD-ME IR Program Manager (Trey Chabot, 207-

438-1019) is required prior to construction.

10.2 Any modifications to the proposed action must be reviewed and approved by PWD-

ME ENV prior to implementation.

11 SITE SUPERVISION:

11.1 The Project Site Superintendent for this project shall meet the qualifications specified in Specification Section 01 30 00.00 22.

11.2 The Project Superintendent shall be on site during working hours. The Superintendent cannot the Site Safety and Health Officer (SSHO).

11.3 The Site Superintendent cannot be the Quality Control Manager.

11.4 Approval of the on-site Project Superintendent by the Contracting Officer is required prior to start of construction. Provide resumes for the proposed on-site Project

Superintendent describing their experience with references and qualifications to the

Contracting Officer for approval. The Contracting Officer reserves the right to interview the proposed on-site Project Superintendent at any time in order to verify the submitted qualifications.

11.5 The Site Superintendent is subject to dismissal if the above duties are not being effectively carried out. If the Site Superintendent is dismissed, project work will be stopped and will not be allowed to resume until a suitable replacement is approved and the above duties are again being effectively carried out.

11.6 Site Superintendent Qualifications

11.6.1 The project site superintendent must have a minimum of five (5) years' experience in construction with at least three (3) of those years as a superintendent on projects similar in size and complexity. See Div 1 Section

01 30 00.00 22 ADMINISTRATIVE REQUIREMENTS (PWD ME) for additional requirements.

12 SITE SAFETY:

12.1 The Contractor shall provide a competent Site Safety and Health Officer (SSHO) in accordance with the requirements specified in Specification Section 01 35 26.00 22.

12.2 The SSHO cannot perform the duties of the Site Superintendent. The SSHO cannot perform the duties of the QC Manager.

12.3 The Contractor shall be responsible for maintaining a work site compliant with EM

385-1-1 Safety and Health Requirements Manual (Latest Edition), including latest errata and changes) and all other OSHA regulations associated with the completion of the work.

12.4 Approval of the SSHO by the Contracting Officer is required prior to start of construction. Provide resumes for the proposed SSHO describing their experience with references and qualifications to the Contracting Officer for approval. The

Contracting Officer reserves the right to interview the proposed SSHO at any time in order to verify the submitted qualifications.

12.5 The SSHO is subject to dismissal if the above duties are not being effectively carried out. If the SSHO is dismissed, project work will be stopped and will not be allowed to resume until a suitable replacement is approved and the above duties are again being effectively carried out.

13 QUALITY CONTROL:

13.1 The Contractor shall implement a Quality Control Program in accordance with the requirements specified in Specification Section 01 45 00.10 22. Provide a Site QC

Manager in accordance with Section 01 45 00.10 22 to manage to implement and manage the QC Program.

13.2 The QC Manager cannot perform the duties of the SSHO.

13.3 The QC Manager cannot perform the duties of the Site Superintendent.

13.4 Approval of the QC Manager by the Contracting Officer is required prior to start of construction. Provide resumes for the proposed QC Manager describing their experience with references and qualifications to the Contracting Officer for approval.

The Contracting Officer reserves the right to interview the proposed QC Manager at any time in order to verify the submitted qualifications.

13.5 The QC Manager is subject to dismissal if the above duties are not being effectively carried out. If the QC Manager is dismissed, project work will be stopped and will not be allowed to resume until a suitable replacement is approved and the above duties are again being effectively carried out

14 MEASUREMENTS:

14.1 Contractor shall verify all measurements in the field prior to starting work.

Coordinate with the Contracting Officer Representative when scheduling visits to the site prior to construction activities.

15 CLEANUP:

15.1 Contractor shall clean up the job site daily, and shall use his or her own equipment to clean the work area to the satisfaction of the Contracting Officer Representative.

Upon completion of project work, contractor shall clean the work area free of equipment, tools, materials, trash, debris and dust. Upon site stabilization as defined by State and Federal erosion and sediment control laws, all temporary erosion and sediment controls shall be removed and disposed of in accordance with State and

Federal disposal regulations.

16 SUBMITTALS

16.1 Provide submittals as defined herein and in the contract documents including, but not limited to, the following in accordance with Specification Section 01 33 00 Submittal

Procedures:

16.2 For any projects that are awarded with a contract value of greater than $250,000, the

Contractor shall utilize NAVFAC’s Electronic Construction & Facility Support

Contract Management System (eCMS).

16.3 See Section 01 31 23.13 22 for eCMS requirements. The eCMS can be accessed at http://wl001.uat.navfac.us/cmicuat/SdMenu/. The administrator will provide a user name and password to log in.

17 AVAILABILITY AND USE OF UTILITY SERVICES

17.1 The following utilities will be made available to the Contractor without charge:

17.1.1 Electricity

17.1.2 Potable Water

17.2 See Specification Section 01 50 00 for additional requirements.

18 ORDER OF PRECEDENCE:

18.1 In the event of conflict or inconsistency between any of the requirements included in the scope of work outlined herein conflict with the attached Div 1 Specs or the Div 1

Specs included in the original IDIQ Contract, the requirements outlined in this scope of work document will take precedence.

19 FACILITY TURNOVER PLANNING MEETINGS (NAVFAC Red Zone - NRZ)

19.1 The Contractor shall meet with the Government to identify strategies to ensure the project is carried to expeditious closure and turnover to the Client in accordance with

Specification Section 01 30 00.00 22. Start the turnover process at the Pre

Construction Conference meeting and convene at the Facility Turnover Meetings once the project has reached approximately 75 percent completion or three to six months prior to Beneficial Occupancy Date (BOD), whichever comes first.

19.2 See Appendix A of Section 01 30 00.00 22 for an example of the Facility Turnover

Planning Meeting Agenda, NRZ Checklist & POAM.

20 OPERATION & MAINTENANCE MANUALS

20.1 The Contractor shall submit O&M Manuals in accordance with Specification Section

01 78 00.00 22. Contractor shall provide three (3) hard copies and two (2) electronic copies on CD’s of the operation and maintenance manuals. Data shall be submitted for final approval no later than 30 calendar days prior to project completion.

Operation and Maintenance Manuals shall be consistent with manufacturer’s standard brochures, schematics, printed instructions, general operating procedures, and safety precautions.

20.2 For this Project the following Data Packages are required for the following equipment:

20.2.1 Low Voltage Gear Data Package No. 4

20.2.2 Switchgear #1, #2, #3 Data Package No. 4

20.2.3 Voltage Regulator A, B, C Data Package No. 4

21 eOMSI

21.1 The Contractor shall provide the eOMSI Facility Data Workbook and complete the actions outlined in accordance with Specification Section 01 78 24.00 22.

21.2 An initial, pre-edited draft of the Model & Facility Data Matrix tab within the eOMSI

Facility Data Workbook is attached (Attachment 6).

21.3 The Government will provide this eOMSI Facility Data Workbook electronically to the Contractor upon award. The Contractor shall add, delete, and update Master systems, Systems, and Subsystems that may have changed during construction, or any items that may have been omitted or missed during design, at no additional cost to the

Government. Complete the KTR Facility Data File tab based on the selection of

Master systems, Systems, and Subsystems installed.

22 INTERNAL SERVICE REQUIREMENTS LIST

22.1 The Contractor shall furnish a list of installed equipment furnished under this contract.

22.2 An initial, pre-edited draft of the Internal Service List is attached (Attachment 7).

22.3 Include all information usually listed on manufacturer's name plate. The Internal

Service Requirements List should include, as applicable, the following for each piece of equipment installed: description of item, location (by room number), manufacturer, model number, serial number, capacity, floor coverings, wall and ceiling surfaces;

types and square footage of coverage, lighting fixtures, bathroom fixtures, windows and HVAC filters.

23 WARRANTY MANAGEMENT PLAN

23.1 The Contractor shall submit a warranty management plan in accordance with

Specification Section 01 78 00.00 22 at least 30 days before the planned pre-warranty conference, submit the warranty management plan for Government approval.

24 AS-BUILTS/ RECORD DRAWINGS

24.1 The Contractor shall provide as-built drawings for the project.

24.2 The as-built drawings shall be two (2) sets of hard copy paper contract drawings by red-line process described in Specification Section 01 78 00.00 22 to reflect the current as-built conditions during the prosecution of the project.

24.3 The Contractor shall keep the working as-built drawings current and shall keep at least one set available on the jobsite for review at all times.

24.4 Changes from the contract plans which are made in the work or additional information which might be uncovered in the course of construction must be accurately and neatly recorded as they occur by means of details and notes.

24.5 Within 20 working days of substantial completion of all phases of work, the red line as-builts shall be incorporated into the provided project drawing PDF Project

Drawing Set files using Adobe software, thus creating the PDF Project As-Built

Drawing Set. Submit the PDF Project As-Built Drawing Set and the original the red line as-builts for approval by the DM/CM and CAD department. Upon approval of these submittals, provide the final PDF As-Built Drawing Set file on CD as well as two (2) full size hard copies of the completed PDF Project As-Built Drawing Set.

25 DD FORM 1354 - REAL PROPERTY RECORD CARD

25.1 The Government will provide the Draft DD Form 1354, Transfer and Acceptance of

Military Real Property filled in with the appropriate Real Property Unique Identifiers

(RPUID) and related construction Category Codes to summarize the designed real property assets that apply to this contract.

25.2 The Contractor shall meet with the Contracting Officer and the Real Property

Accounting Officer during the Pre-Construction Meeting and the Project Closeout

Meetings to modify and include any necessary changes to the DD Form 1354.

25.3 The Contractor shall provide the Interim DD Form 1354 that uses the appropriate division of the RPUIDs/ Category Codes to represent the final constructed facility and include all associated cost. Coordinate the Contractor's Price and Payment structure with the structure of the RPUIDs/ Category Codes.

26 TRAINING

26.1 Prior to acceptance of the facility by the Contracting Officer for Beneficial

Occupancy/ Placed in Service Date, the Contractor must provide a comprehensive project-specific Government personnel training program for the systems and equipment of the facility specified in the technical specifications of this Contract. The trainees must include the Facilities Management Specialist, maintenance staff, and applicable building occupants.

26.2 Coordinate, schedule, and ensure that training is completed. Instructors shall be well-versed in the particular systems that they are presenting. For each training session;

submit dates start and finish times, and locations; outline of the information to be presented; names and qualifications of the presenters; and list of texts and other materials required to support training.

26.3 Contractors shall provide to the Contracting Officer two copies of the training course in DVD video recording format. Capture within the recording, in video and audio, all
