About this file
This is a Statement of Work (Schedule A) for Request for Proposal No. 260000001628 issued by the Michigan Department of Civil Rights (MDCR). The RFP seeks a qualified vendor to develop and deliver a comprehensive curriculum and training program designed to strengthen MDCR's enforcement capacity in housing and lending practices while addressing the emerging impact of artificial intelligence (AI) in these sectors. The scope of work requires the selected contractor to assess current MDCR enforcement division processes, develop practical tools and structured frameworks for discrimination identification, integrate coordination workflows between investigators and attorneys, support public education initiatives, and strengthen evidentiary development practices. Additionally, the contractor must provide AI-related tools, training, and workshops that enable MDCR staff to identify and investigate unlawful discrimination involving automated or AI-enabled systems, develop complex investigations involving multiple actors and decision points, address legal updates in housing and AI law, and support outreach to both housing providers and housing seekers. All contract activities must be completed within one year from the contract effective date. The contractor must submit a detailed project plan within 30 calendar days of contract award, including project breakdown, timeline, milestones, bi-weekly written status reports, and processes for addressing changes and issues.
Pricing is firm for the entire contract term with payment to be made via electronic funds transfer (EFT) once invoices are approved by the program manager. The State may request delivery order payments structured according to milestone schedules. The contractor must appoint one dedicated Contractor Representative for all State of Michigan account inquiries and two Key Personnel positions—one specializing in Legal, Civil Rights & Regulatory expertise and one in Housing Data Engineering—who must be approved by the State and respond to inquiries within 24 hours. Unauthorized removal of Key Personnel without State written consent may result in material breach charges and liquidated damages of $5,000 per individual, plus up to $3,000 in additional daily credits if a 30-calendar day shadowing period is not provided for replacement personnel. The contractor must comply with Americans with Disabilities Act (ADA) accessibility standards for all digital deliverables, maintain data retention and retrieval capabilities, and is subject to liquidated damages of $1,000 plus $100 per day for late or improper completion of contract activities. All contract activities must comply with SOM Digital Standards and adhere to State data security and confidentiality requirements.

Enter your company name Schedule A – Statement of Work Request for Proposal No.260000001628 Strengthening Enforcement Capacity in Housing & Lending Practices and Impact of Artificial Intelligence (AI) This schedule identifies the anticipated requirements of any Contract resulting from this RFP. The term “Contractor” in this document refers to a bidder responding to this RFP, as well as the Contractor who is awarded the contract. The term “bidder” is used to identify where specific responses to the RFP are required. Yellow fields are also used to identify areas where a bidder response is required.
The Contractor must respond to each requirement or question and explain how it will fulfill each requirement. Attach any supplemental information and reference it appropriately within your response.
Background Michigan Department of Civil Rights (MDCR) is an administrative agency with investigative and enforcement authority. The Enforcement Process includes all the tasks performed when a person interacts with MDCR about a civil rights-related need or concern, including investigation and resolution of complaints of unlawful discrimination, outreach and education, and community engagement.
Pursuant to civil rights laws, including but not limited to fair housing laws on both State and Federal level, discrimination is prohibited based on, race, color, religion, familial status, national origin, sex, sexual orientation, gender identity or expression, disability, age, marital status, and source of income. More specifically, fair housing laws protect a person engaging in a real estate transaction at any point during the process in which the individual views or purchases a home, views or rents an apartment or other living facility, obtains financing, such as a mortgage or home improvement loan. State and Federal laws also prohibit steering which is described as directing renters or home buyers to neighborhoods based on race and prohibit predatory lending which associates marketing less favorable home loans with people based on a protected characteristic.
AI is significantly transforming civil rights laws, including but not limited to fair housing laws by creating new risks for discrimination while prompting regulators to modernize enforcement. While AI offers efficiencies in marketing, tenant screening, and property management, its reliance on historical data can perpetuate bias against protected classes, leading to "disparate impact" claims even when discrimination is unintentional.
Scope MDCR is seeking a vendor who will develop a curriculum to enhance the current enforcement process related to Housing and Lending practices. This curriculum will strengthen MDCR mission and its enforcement capacity in the Housing and Lending practices and will provide guidelines and best practices used to address the recent increased impact of AI in the Housing and Lending field. The selected bidder will provide the MDCR staff with the necessary training and tools to use in their daily work that will help them recognize and act strategically towards their coordinated efforts to effectively address discrimination patterns, develop complex investigations, and provide public education and awareness to help communities recognize and act on such type of discrimination practices.
General Requirements MDCR is inviting proposals from qualified and experienced vendors that can provide assistance to the Department in effort to strengthen its Enforcement Division’s capacity in housing & lending practices and address the latest developments related to the impact of AI in this sector. The work should concentrate on the two main topics provided below, and both topics must be supported by vendor provided training:
Strengthening MDCR Enforcement Capacity in Housing and Lending Practices:
Bidder must develop and/ or demonstrate the ability to provide document review, current tools enhancement, training, workshops, case development and coordination processes that focus on the following:

ii) Bidder must evaluate all processes provided by the department.
b) Identify discrimination practices and provide practical tools, structured frameworks, and sustained advisory support to the Division’s ongoing investigation and enforcement mission.
c) Integrate the coordination between investigators and attorneys in both individual and more complex multi-party matters into the existing workflows.
d) Support public education and awareness efforts that reinforce enforcement priorities and help communities recognize unlawful discrimination concerns.
e) Strengthen evidentiary development and documentary practices that support legally sound enforcement decision-making.
f) Identify effective use of disparate impact frameworks and related legal theories in housing cases.

Key Personnel must be specifically assigned to the State account, be knowledgeable about the contractual requirements, and respond to State inquiries within 24 hours.
The State has the right to recommend and approve in writing the initial assignment, as well as any proposed reassignment or replacement, of any Key Personnel. Before assigning an individual to any Key Personnel position, Contractor will notify the State of the proposed assignment, introduce the individual to the State’s Project Manager, and provide the State with a resume and any other information about the individual reasonably requested by the State. The State reserves the right to interview the individual before granting written approval. In the event the State finds a proposed individual unacceptable, the State will provide a written explanation including reasonable detail outlining the reasons for the rejection. The State may require a 30-calendar day training period for replacement personnel.
Contractor will not remove any Key Personnel from their assigned roles on this Contract without the prior written consent of the State. The Contractor’s removal of Key Personnel without the prior written consent of the State is an unauthorized removal (“Unauthorized Removal”). An Unauthorized Removal does not include replacing Key Personnel for reasons beyond the reasonable control of Contractor, including illness, disability, leave of absence, personal emergency circumstances, resignation, or for cause termination of the Key Personnel’s employment. Any Unauthorized Removal may be considered by the State to be a material breach of this Contract, in respect of which the State may elect to terminate this Contract for cause under the Termination for Cause section of the Standard Contract Terms. Therefore, Contractor and the State agree that in the case of any Unauthorized Removal in respect of which the State does not elect to exercise its rights under Termination for Cause, Contractor will issue to the State the corresponding credits set forth below (each, an “Unauthorized Removal Credit”):
For the Unauthorized Removal of any Key Personnel designated in the applicable Statement of Work, the credit amount will be $5,000.00 per individual if Contractor identifies a replacement approved by the State and assigns the replacement to shadow the Key Personnel who is leaving for a period of at least 30-calendar days before the Key Personnel’s removal.
If Contractor fails to assign a replacement to shadow the removed Key Personnel for at least 30-calendar days, in addition to the $5,000.00 credit specified above, Contractor will credit the State $100.00 per calendar day for each day of the 30-calendar day shadow period that the replacement Key Personnel does not shadow the removed Key Personnel, up to $3,000.00 maximum per individual. The total Unauthorized Removal Credits that may be assessed per Unauthorized Removal and failure to provide 30-calendar days of shadowing will not exceed $3,000.00 per individual.
Contractor acknowledges and agrees that each of the Unauthorized Removal Credits assessed above: (i) is a reasonable estimate of and compensation for the anticipated or actual harm to the State that may arise from the Unauthorized Removal, which would be impossible or very difficult to accurately estimate; and (ii) may, at the State’s option, be credited or set off against any fees or other charges payable to Contractor under this Contract.
The Contractor must identify the Key Personnel, indicate where they will be physically located, describe the functions they will perform, and provide current chronological résumés.
