SCHEDULE OF SUPPLIES/SERVICES, BLOCK 20
DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
I. Scope of Work
For each year of the contract, the U.S. Government guarantees a minimum order of 1,000 liters Gasoline and 1,000 liters of diesel fuel. The maximum amount of fuel ordered under each year of the contract shall not exceed 1,000,000 liters.
The contracting officer may issue oral orders that will be confirmed in writing.
The quality of the required fuel to be delivered to the U.S. Government must be certified by the Government of the Democratic Republic of Congo, and stored in the national distribution company SEP’s tanks. For supply and delivery of fuel, the contractor shall be paid the fixed price per unit as listed above. This price is not to exceed any official rate, as set by laws enacted by the government of the Democratic Republic of Congo.
Delivery:
The contractor shall deliver fuel products (gasoline and diesel fuel) to the U.S. Embassy Kinshasa in the following locations as instructed in each delivery order:
1. American Embassy Kinshasa
JAO Compound
498 Avenue Colonel Lukusa
Kinshasa, Democratic Republic of Congo;
2. American Embassy Kinshasa
310 Avenue des Aviateurs
Kinshasa/Gombe
Democratic Republic of Congo
Delivery must be made between the hours of 09:00 through 16:00 from Mondays through Fridays. The contractor shall promptly deliver the fuel by tanker truck on the date and time that are specified on delivery orders issued under the contract. Any contractor personnel involved with the delivery of the fuel shall comply with Embassy regulations for receiving supplies. The Contracting Officer's Representative (COR) will be responsible for instructing contractor personnel at the time deliveries are made. The driver of the tanker truck must submit a delivery slip to the COR for approval at the time any delivery is made.
Selection of Awardees for Individual Task Orders
(a) If more than one contractor has received an award for these services, the following procedures shall govern regarding issuance of individual task orders. No work shall be performed without a task order being issued to the contractor by the Contracting Officer.
(b) As the need for services arises, the Government will develop a price estimate.
If the estimate does not exceed US$3000, the Government will follow the procedures in paragraph (c) below. If the estimate exceeds US$3000, the Government will follow the procedures in paragraph (d) below.
(c) Orders not exceeding US$3000 - The Government will select a contractor for issuance of the task order. This decision will be based on the Government's best interests, which may include factors such as estimated price; past performance record; need to meet contractual minimums; or desire to avoid exceeding task order limitations set forth in Section I, FAR 52.216-19, "Order Limitations".
(d) Orders exceeding US$3000 - Unless one of the exceptions in paragraph (e) below applies, the Government will follow one of the following two scenarios:
(1) The Government will request each contractor to provide a quotation showing its main price, the availability of required products, a suggested delivery date and time AT NO COST TO THE U.S. GOVERNMENT. Whether or not the contractor is selected for an individual task order, the Government shall not be liable for any claim from the Contractor for the costs of submitting an offer. Selection will be based on a combination of estimated price and past performance information to include as a minimum the accuracy of previous deliveries; or
(2) If the Contracting Officer can establish which Contractor’s prices will result in the lowest price for the individual task order without requesting quotations, the Government will make its award selection based upon the prices set forth in the contract and past performance information gained as a result of contractor performance under this contract.
(3) Regardless of whether the procedures in paragraph (1) or (2) above were followed, selection of contractors shall not be protestable to GAO under Subpart 33.1 of the Federal Acquisition Regulation, except on the grounds that the order increases the scope, period, or maximum value of the contract. However, the Department of State does have an Acquisition Ombudsman who will review complaints by contractors to ensure that all contractors are afforded a fair opportunity to be considered for these task orders, pursuant to the procedures for award of task orders established herein.
(e) Exceptions to the procedures in paragraph (d) above:
The agency need for the required services is of such urgency that providing such competitive opportunity would result in unacceptable delays;
The order should be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order; or
It is necessary to place an order to satisfy a minimum guarantee.
Price Adjustment:
(a) The unit price per liter of gasoline and diesel fuel may be adjusted based on increases or decreases in the official price of gasoline and diesel fuel, mandated by the government of the Democratic Republic of Congo.
(b) To request an adjustment in price, the Contractor must provide written notification of the price change to the Contracting Officer at least one week before the new price is to be effective. This notification must be accompanied by a copy of the official announcement of the price change, showing the new price and its effective date. The officer or general partner of the Contractor having overall responsibility for the Contractor's affairs shall certify the submission by written signature.
(c) The U.S. Government will make no adjustment to the contract price that relates to any wages, overhead, fixed costs, general and administrative expenses, materials, or profit. Only the amount which is a direct result of an increase or decrease in the price of oil to be delivered under this contract shall be considered by the U.S. Government as the basis for contract price adjustments.
(d) The Contractor may not request an adjustment under this clause after final payment has been made under this contract.
(e) This clause shall only apply to laws enacted by the government of the Democratic Republic of Congo, which meet the criteria set forth above. The U.S. Government will make no adjustments in contract price due to currency devaluations or fluctuations in exchange rates.

This 4-character suffix may be assigned at the discretion of the business concern to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.
"Registered in the SAM database" means that-
(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, into the SAM database;
(2) The Contractor's CAGE code is in the SAM database; and
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS), and has marked the record "Active". The Contractor will be required to provide consent for TIN Attachment, Page 1 of 4 validation to the Government as a part of the SAM registration process.
"System for Award Management (SAM)" means the primary Government repository for prospective federal awardee information and the centralized Government system for certain contracting, grants, and other assistance related processes. It includes-

(2) The SAM registration shall be for the same name and address identified on the contract, with its associated CAGE code and DUNS or DUNS+4.
(3) If indicated by the Government during performance, registration in an alternate system may be required in lieu of SAM.
(c) If the Contractor does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.
(1) A contractor may obtain a DUNS number-
(i) Via the internet at http://fedgov.dnb.com/webform or if the contractor does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or
(ii) If located outside the United States, by contacting the local Dun and Bradstreet office. The contractor should indicate that it is a contractor for a U.S. Government contract when contacting the local Dun and Bradstreet office.

To remain registered in the SAM database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the SAM database to ensure it is current, accurate and complete. Updating information in the SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.
(g) (1)(i) If a Contractor has legally changed its business name, "doing business as" name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in Subpart 42.12, the Contractor shall provide the responsible Contracting Officer sufficient documentation to support the legally changed name with a minimum of one business day's written notification of its intention to-
