J&A NUMBER 03-10
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below using 6.302-5, Authorized or Required by Statute, pursuant to the authority cited herein.
JUSTIFICATION
1. Identification of Agency and Contracting Activity.
Office of Naval Research
2. Nature/Description of Action. This justification and approval authorizes and approves the issuance of an SBIR Phase III Cost Plus Fixed Fee Contract that is derived from, extends, or logically concludes efforts performed under prior funding agreements and is authorized under 10 U.S.C. 2304(b)(2) or 41 U.S.C. 253(b)(2).
3. Description of Supplies/Services. During the proposed effort DoubleShot Inc. will develop a prototype laser augmented stereo camera inspection system for 3D mapping of the volume of a crater hole resulting from an Improvised Explosive Device (lED) lED blast. Additionally a system will be developed and evaluated which can mark, document, and operationally display the geo-referenced locations of roadside lED's. This effort is a follow-on to DoubleShot's successful SBIR Phase III NOOOI4-07-C-0386, which was entitled "Enhanced Targeting, Navigation, and Visualization for Combat Vehicles." Specifically this effort is a follow-on to the task of the previous Phase III under which DoubleShot researched obtaining object shape information for lED detection. The estimated value for this effort is $1,548,318.00 ($1,102,712 base and $445,606 option). The proposed research falls within the scope of ONR programs in lED threat mitigation. Successful conduct of this research will reduce the risk to Marines of roadside lED's and reduce exposure of Explosive Ordinance Disposal (EOD) personnel to lED and sniper hazards.
4. Identification of Statutory Authority. The statutory authority permitting other than full and open competition is Title 10, U.S.C. 2304 (c)(5) as implemented by the Federal Acquisition Regulation (FAR) 6.302-5.
5. Demonstration of Contractor's Unique Qualification. The proposed performer provides the unique capabilities and experience of the principal investigator and key personnel as described in the proposal and possesses the necessary facilities for the conduct of the proposed work. The contractor has a strong record of delivering counter-lED technology for combat vehicles.
6. Description of Efforts to Ensure Other Potentials Sources Were Sought. The initial project was advertised under SBIR effort on Topic N04-901 entitled "Technologies to Defeat Improvised Explosive Devices (lED's)." The contractor chosen performed on the Phase I, Phase II, and Phase III aspects of the project, making them the only contractor capable of performing the research in a cost effective manner.
7. Determination of Fair and Reasonable Cost. The contracting officer fully relied on cost or pricing data submitted and certified by the contractor except for the following: Direct Labor, CONTRACT NUMBER N00014-10-C-0269 1
Labor Overhead, and G&A rates provided by DCAA, which the contracting officer only partially relied on submitted and certified cost and pricing data.
8. Description of Market Survey. The original solicitation, 2004.2, was posted under SBIR Topic N04-90l on 01 MAR 2004. The Small Business Research and Development Enhancement Act (P.L. 102-564) waives further competition for follow-on work to an SBIR project to satisfy the requirements of CICA. The waiver provided by P.L. 102-564 negates the need for a market survey for this action.
9. Any Other Supporting Facts. The only requirement for Phase III efforts under the SBIR Program Solicitation is that "the small business is expected to obtain funding from the private sector and/or non-SBIR Government sources to develop the prototype into a viable product or non-R&D service for sale in military and/or private sector markets." Outside source funding will be provided by JIEDDO. Additionally, page 5 (Le., 60075) of SBA's SBIR Policy Directive, dated 24 SEP 2002, states:
"..there is no limit on the number, duration, type, or dollar value of Phase III awards made to a business concern," or "on the time that may elapse between a Phase I or Phase II award and Phase III award, or between a Phase III award and any subsequent Phase III award."
