DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
A. Scope of Work
For each year of the contract, the U.S. Government guarantees a minimum order of 36,000 liters of gasoline and 30,000 liters of diesel. The maximum amount of fuel ordered under each year of the contract shall not exceed 270,000 liters gasoline and 342,000 liters of diesel.
The Contracting Officer may issue oral orders that will be confirmed in writing. The Supply Clerk will be the Contracting Officer’s Representative (COR) for this order and s/he will submit delivery order on an OF-347 form signed by the Contracting Officer. In case the designated COR is replaced by another supply clerk, the contractor will be notified through a letter signed by the Contracting Officer.
The fuel provided will be High Speed Diesel and HOBC Gasoline. For supply and delivery of the fuel, the Contractor shall be paid the fixed price per unit as listed in the scope of services. This price is not to exceed any official rate, as set by laws enacted by the government of Bangladesh.
B. Delivery:
(a) The contractor shall deliver fuel to the U.S. Embassy located at the Annex Building located at Plot #1 Progati Sharani, J-Block, Baridhara Residential Area, and Dhaka 1212. Delivery must be made between the hours of 8:00 – 16:00 local time, from Sunday through Thursday. Other hours, if requested by the Embassy, may be approved by the Contracting Officer's Representative (COR). The contractor shall deliver the fuel by tanker truck within 48 hours of receipt of the delivery orders issued under the contract. Any contractor personnel involved with the delivery of the fuel shall comply with Embassy regulations for receiving supplies. The Contracting Officer's Representative (COR) will be responsible for instructing contractor personnel at the time deliveries are made. The driver of the tanker truck must submit an invoice to the COR for approval at the time any delivery is made. During Hartal (political unrest) and/or during any unforeseen circumstances a police escort must be coordinated by the Embassy to ensure the safety of the shipment. The Receiving Clerk will then initiate the offload once the results are confirmed by the Fuel Pump Operator.
(b) Contractor’s delivery trucks must be equipped with proper hoses and adapters for the 4-inches receiving inlets at the Embassy. Trucks must be in good shape without leak from the lines, PTO and/or seals and without any hiding compartments; no oil or fuel leak will be accepted on the compound. The Government may accept gravity unloading due to position of the receiving inlets adapters. Contractor and COR shall check and ensure that all the seals are intact before opening a new shipment.
(c) The U.S. Embassy may have one of its fuel trucks go to any of the contractor’s depots to pick up fuel for delivery to scheduled Embassy residences and offices. Contractor will be notified when the Embassy schedules to do so.
(d) Contractor are required to adhere to the Government safety rules by ensuring that all the safety equipment and apparatus are setup on site and proper safety wear must be worn at all times.
(e) After the fuel is offloaded, the COR will sign off on the delivery/invoice, annotate any remarks, and prepare a Receiving Inspection Report, thereafter forward the invoice to our financial section for payment.
C. Price Adjustment:
(a) The unit price per liter of diesel and gasoline may be adjusted based on increases or decreases in the official price of fuel, mandated by the government of Bangladesh.
(b) To request an adjustment in price, the Contractor must provide written notification of the price change to the Contracting Officer at least one week before the new price is to be effective. This notification must be accompanied by a copy of the official announcement of the price change, showing the new price and its effective date. The officer or general partner of the Contractor having overall responsibility for the Contractor's affairs shall certify the submission by written signature.
(c) The U.S. Government will make no adjustment to the contract price that relates to any wages, overhead, fixed costs, general and administrative expenses, materials, or profit. Only the amount which is a direct result of an increase or decrease in the price of oil to be delivered under this contract shall be considered by the U.S. Government as the basis for contract price adjustments.
(d) The Contractor may not request an adjustment under this clause after final payment has been made under this contract.
(e) This clause shall only apply to laws enacted by the government of Bangladesh which meet the criteria set forth above. The U.S. Government will make no adjustments in contract price due to currency devaluations or fluctuations in exchange rates.
D. Quality Control
The USG will test for water the fuel delivered before the fuel leaves the delivery truck. If there is an excessive percentage of water in the fuel (greater than 2%), the Contractor shall provide a replacement delivery of non-contaminated fuel immediately.
E. QUALITY ASSURANCE AND SURVEILLANCE PLAN (QASP)
This plan provides an effective method to promote satisfactory contractor performance. The QASP provides a method for the Contracting Officer's Representative (COR) to monitor Contractor performance, advise the Contractor of unsatisfactory performance, and notify the Contracting Officer of continued unsatisfactory performance. The Contractor, not the Government, is responsible for management and quality control to meet the terms of the contract. The role of the Government is to monitor quality to ensure that contract standards are achieved.
