Attachment A: NIST NCNR SPENT FUEL CELL SHIPMENT SOW

PACKAGING AND SHIPMENT OF IRRADIATED NUCLEAR FUEL FROM NATIONAL

INSTITUTE OF STANDARDS AND TECHNOLOGY TO THE DEPARTMENT OF ENERGY

SAVANNAH RIVER SITE, AIKEN, SC.

STATEMENT OF WORK

I. Background

The National Institute of Standards and Technology (NIST) owns and operates a twenty (20) MW nuclear test reactor, which goes by the name of National Bureau of Standards Reactor (NBSR). The purpose of the NBSR is to provide high intensity neutron beams for the pursuit of scientific research.

The NBSR is fueled by thirty (30) highly enriched fuel elements. During the course of a year it produces approximately twenty-eight (28) spent fuel elements.

The fuel elements are made up of Uranium Oxide Materials Testing Reactor (MTR) type dispersion fuel plates. There are two (2), thirty (13)-inch-tall stacks of fuel plates lodged in every fuel element with a gap of six (6) inches between them. The fueled regions can be separated from the rest of the fuel element using an underwater saw, which allows the parts of the fuel assembly that contain no uranium to be treated as radioactive waste of a much lower classification than the parts containing highly radioactive uranium. The fueled pieces measurements are 13.5” x 3.5” x 3”.

In order to be in accordance with the Nuclear Regulatory Commission (NRC), NIST has to transfer its spent fuel to the Department of Energy (DOE) Savannah River Site (SRS) near Aiken, South Carolina.

II. Scope of the Work

This action is for the packaging and shipment of the spent fuel cells to the DOE-SRS. There are one-hundred and sixty-eight (168) severed fuel sections (about three (3) running years of fuel, i.e.

3x7x4=84 fuel elements). All of the one-hundred and sixty (168) fuel sections have been out of the reactor for at least two (2) years.

III. Requirements

A. The Contractor’s activity shall include, but is not limited to:

1. The Contractor shall ensure all communications are on a need-to-know basis and in compliance with 10 CFR 73 requirements.

2. The Contractor shall ensure all paperwork is properly marked and handled according to pertinent Nuclear Regulatory Commission (NRC) and Department of Transportation (DOT) regulations with copies being limited to only those required to complete the activity.

3. The Contractor shall provide truck transportation from Gaithersburg, MD to DOE-SRS in Aiken, SC. Truck transportation shall be in accordance with all relevant regulation.

4. The Contractor shall provide packaging (cask(s)) under a valid Certificate of Compliance issued by the NRC certified for use with materials-testing-reactor (MTR) type spent fuel from the NBSR.

5. The Contractor shall provide all tools that allow the cask(s) to be packed with fuel stacks (e.g.

crane; forklift; etc.). In the event the Contractor’s tools fail and to support the contingency situation, to ensure the timed window for delivery is met, an attempt to aid the Contractor with tools will occur. However, this does not alleviate the Contractor’s responsibility to be prepared and provide all tools necessary to successfully complete this requirement. In the instance where the Government may provide tools, the Contractor shall take note and inventory to ensure the tools are returned after completion of this requirement.

6. The Contractor shall provide the tools and equipment that allow the fuel stacks to be transferred from the NBSR storage pool to the cask(s). The Contractor shall specify how the fuel stacks will be moved from NBSR to the cask(s).

7. The Contractor shall responsible for all administration of all relationships with individual State Authorities regarding passage and escort of the shipment. This is to include but not limited to the coordination and scheduling of all clearances, checkpoints, permits, etc.

8. The Contractor shall organize the route from Gaithersburg to DOE-SRS Aiken, SC which shall be approved by NRC. A minimum of three (3) routes shall be provided.

9. The Contractor shall manage all interactions with federal, state and local authorities as applicable.

10. The Contractor shall provide for all necessary security measures while on the road from Gaithersburg to DOE-SRS Aiken, SC as required by State and Federal statutes and/or regulations.

11. As applicable, the Contractor shall comply with all regulatory requirements for this class of shipment.

12. Contractor shall provide all documentation pertaining to package testing and quality assurance requirements as specified in the Certificate of Compliance and supporting documentation for shipment. The Contractor shall keep documentation of all quality assurance documents, to include but not limited to, casks maintenance, leak testing, etc.

Copies of said documents shall be provided to the NCNR.

13. Shall provide appropriate clearances as specified in 10 CFR 73 for its personnel to deal with Safeguards information.

14. Shall provide a Project Manager who shall be the single point of contact for all interaction.

The Project Manger shall be onsite during the load and ship process.

15. Offer the shipment to officials from DOE-SRS ready and acceptable for unloading

16. The Contractor shall be responsible for providing a project specific Safety/Accident

Prevention Plan including radiological safety considerations. The Safety/Accident Prevention Plan shall at a minimum identify the risks associated with the loading and shipment of the spent fuel and how those risks will be mitigated. The Safety/Accident Prevention Plan shall address all safety risks from the commencement of the contract through the end of performance. In accordance with FAR 52.236-13 Alt. I, plan shall include an analysis of the significant hazards to life, limb, and property inherent in contract work performance and a plan for controlling these hazards.

17. A Transportation Security Plan shall be developed by the Contractor. The plan shall address at a minimum the associated risks associated with transportation, how the Contractor plans to mitigate those risks and proposed security measures the Contractor plans to use during shipment.

18. The Contractor shall provide a site-specific cask Loading Procedure that is in compliance with all regulatory requirements.

19. Upon successful delivery, the Contractor shall provide proof of delivery and offloading at

DOE-SRS.

B. The Government will provide the following to the Contractor:

1. Access to NCNR overhead crane with access to storage pool.

2. Access to NCNR facility. The NIST facility’s normal business hours are 8:00 a.m. through 5:00 p.m. Special accommodations may be made if access is required outside of normal business hours. These special accommodations have to be coordinated and approved through the Contracting Officer’s Representative (COR).

3. Nuclear information on individual fuel sections such as:

a. Residual Uranium content (grams)

b. Residual heat production (Watts)

c. Radioactivity (in Curies)

4. An agreement with DOE-SRS to receive the shipped spent fuel. This will be available at least sixty (60) days prior to the actual shipment date.

5. Health Physics (HP) oversight (radiation protection). The NIST HP representative(s) participating in the packaging activities will be aiming to confine this activity within the Regulatory definition of radiation exposure to be As-Low-As-Reasonably-Achievable (ALARA). To that end HP representatives are authorized to stop work should there be any health or exposure issues identified. HP will also perform and document truck and cask surveys throughout the packaging activities.

6. Individual handling of the one-hundred and sixty-eight (168) separated fuel sections will be exclusively provided by NBSR licensed personnel using handling tools provided by the Government.

7. Bill of Lading for the shipment(s).

8. As defined by the NRC, the ultimate party responsible for the safe and effective shipment of this material is the Government.

C. Kick-Off Meeting

The Contractor shall attend a Kick-Off meeting within one (1) month after date of award. The final date and time will be established after date of award by the Contracting Officer. The purpose of the Kick-Off meeting will ensure both the Government and Contractor achieve a clear and mutual understanding of all contract requirements and identify and resolve potential problems. It is not a substitute for the Contractor’s fully understanding of work requirements at the time offers are submitted nor will it be used to alter the final agreement arrived at in any negotiations leading to contract award.

IV. Period of Performance

This requirement consists of two (2) shipments. The first shipment shall take place no later than September 2018.

The period of performance for the first shipment is from date of award through 9/30/2018.
