This service includes responding to winter snow storms, ice storms, treating of ice patches in cold weather, and responding to reports of ice and snow patches in roads, parking areas, in front of buildings, and on sidewalks.

These services include but are not limited to plowing roads and parking lots, plowing sidewalks and building entrances, salting roads, parking lots, and handicap parking spaces, and treating building entrances, crosswalks, and sidewalks with magnesium chloride. The bulk salt is used to melt and remove snow and ice on roads, parking lots, and loading dock areas, and the magnesium chloride is used to melt and remove snow and ice from building entrances, crosswalks, and sidewalks.

Contractor shall supply and deliver 50 pound bags of magnesium chloride pellets on pallets which will be stored on-site in the salt shed also located at building 309 the Grounds Service and Support shop. These materials will be used during the winter months in response to winter snow and ice storms. As these materials are used, they will need to be restocked so that they are readily available for use in response to the next winter storm. 4.0 Scope

4.1 Bulk Road Salt

PAGE 6 OF 29 SB1341-17-RP-0004

The government will require bulk delivery of road salt and magnesium chloride pellets.

Truck deliveries can be made with tandem or triple axel dump trucks. After each winter storm, an inventory of the road salt stored in the salt storage shed will be made. If it is determined that restocking of the salt storage shed is needed, an order will be placed.

Once the order is placed delivery of the road salt to restock the salt shed should be made within 48 hours. Based on historical usage data, an approximate maximum of 400 tons of road salt could be used in one winter season depending on the severity, frequency, and number of winter storms. Quantity may increase or decrease based on the need by the government.

4.2 Magnesium Chloride Pellets

Magnesium chloride pellets will be delivered palletized. After each winter storm, an inventory of the magnesium chloride pellets stored in the salt storage shed will be made.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
