STATEMENT OF WORK

Electronic State Regulatory Monitoring Services

I. Introduction:

The contractor shall provide access to an online searchable database of all current (within 18 months) proposed, proposed amendments to, and adopted regulations and legislation from all 50 states and the District of Columbia, and provide tagging functions to allow NIST to sort by relevancy regulatory and legislative measures of interest to NIST. On a daily basis, the contractor shall alert NIST in the form of e-mailed reports of the newly identified potentially relevant regulatory items published by the states and the District of Columbia.

II. Background:

The goal of the Standards Coordination Office (SCO) at the National Institute of Standards and Technology (NIST) is to equip U.S industry with the standards and conformity assessment-related tools and information necessary to effectively compete in the global marketplace. SCO works closely with NIST laboratories to identify opportunities for NIST participation in standards and conformity assessment-related activities. SCO also coordinates with both the private sector and other federal agencies regarding standards activities and programs. SCO monitors standards development and conformity assessment activities globally and provides research and information services as well as training, publications, and policy analysis. SCO staff work closely with U.S industry, standards developers, and other government agencies, to build a standards infrastructure to support innovation and create opportunities for business to thrive.

The World Trade Organization (WTO) Technical Barriers to Trade (TBT) Inquiry Point is located in SCO and helps to promote trade. In fulfillment of US obligations under the Agreement on Technical Barriers to Trade (TBT), the Inquiry Point notifies draft and final U.S. federal and state regulations which could have an impact on international trade. NIST is required to review and evaluate proposed and amending state level regulation for possible Technical Barriers to Trade issues.

III. Task Requirements:

The contractor shall:

1) Identify and send to NIST daily four e-mailed reports on state regulatory and legislative items:

Electronically identify, filter, and monitor state regulatory actions, proposed, enacted, and revised, as well as state legislative proceedings (introduced, implemented, subsequent action, signed by the governor, revised, and amended) for all 50 states and the District of Columbia. This tracking is specifically to identify and monitor regulatory (at proposed, amending, and final rulemaking stages) and legislative actions (until signed by the governor) for non-agricultural manufactured goods and products, and for agricultural products or food products, when marking, labeling, grading, or packaging is at issue.

a. Regulatory items: Identify and send to NIST daily two e-mailed reports of newly identified (within 5 days (or less) of publication or action by the state) relevant U.S. state regulatory actions (as identified above) through the regulatory lifecycle, from notice of proposal and commenting stage, through adoption, implementation, and revision. For each item identified, include the responsible agency, the title of the measure, date proposed, date to be or date adopted (if applicable), effective and/or emergency adoption date, comment end date, summary, state agency contact information, status (i.e., proposed, effective) citation to the state code or regulation, citation to publication of the notice in the state register, digest, etc., including title of publication, date, volume, and page numbers.

i. One e-mail report will be comprised of relevant proposed and relevant revised (tracked) proposed regulations,

ii. Another e-mail report will be comprised of final (adopted) tracked/relevant regulations.

b. Legislative items: Identify and send to NIST daily two e-mailed reports for

i. Relevant introduced legislation (within 5 days of publication or notice / action by the state legislature, and

ii. Bills (tracked legislation) that are signed by the governor into law.

Daily e-mail report requirements are subject to change based on Government need; which is standard commercial practice.

2) Make available to NIST internet-based searchable databases containing all current (back to 18 months or more prior) regulatory and legislative actions with sorting and tracking functions for NIST relevant items so that NIST can add relevant and remove irrelevant items as needed.

3) Provide access to the full-text of all regulatory and legislative items within 5 days or less of action or publication by the state.

4) Perform customized, manual analysis, filtering, and review to identify regulatory and legislative items relevant to NIST and screen out items not relevant to NIST.

5) Track an unlimited number of relevant bills and proposed regulations, and continue tracking bills and regulatory items NIST is already tracking, per a list of items to be provided by NIST.

6) Use an unlimited number of keywords or phrases (including existing list and additional keywords as requested by NIST) to identify and track legislation and regulatory activity relevant to NIST.

7) Revise and add new search terms used to screen (proposed) regulation and legislation of interest to NIST.

8) Provide access to web-based interface and information for no less than four simultaneous users;

including support for their login access and credentials.

9) Create, on a daily basis, a list of bills, legislative and regulatory actions that are potentially relevant to NIST using automated keyword searching and Boolean operators.

10) Proposed and final regulation and legislation identified per NIST criteria must be exportable to various formats, including Excel from the online database.

11) Provide 24-hour minimum advance warning of system outages and expected impact.

12) Maintain from point of service a repository of all data pushed to NIST and all historical data NIST provides to contractor.

13) Accept and answer requests and provide reporting for coverage of items from past dates.

14) Provide NIST with a single point-of-contact at the company who is familiar with contract requirements, tracked measures to resolve issues and update our profile within 48 hours of a NIST user having contacted the company. If additional time is required, the reason for the extension shall be documented and submitted to the NIST Technical Representative via e-mail within 48 hours of the concern and/or issue being identified.

15) Provide unlimited telephone and e-mail support for questions regarding operation.

IV. Deliverables:

The contractor shall perform in accordance with the foregoing task requirements and is responsible for successfully providing all corresponding deliverables as included in the chart below. The contractor shall submit deliverables to the Technical Point of Contact (TPOC) via e-mail. Not Applicable = N/A.
