. 1 STATEMENT OF WORK
I. BACKGROUND
On February 4, 2014, the National Institute of Standards and Technology (NIST) announced the Organization of Scientific Area Committees (OSAC). The OSAC is a collaborative body of more than 600 forensic science practitioners and other experts who represent all levels of the government, academia and industry.
NIST has established OSAC to strengthen the nation’s use of forensic science by supporting the development and promulgation of forensic science consensus documentary standards and guidelines, determining each forensic discipline’s research and measurement standards needs and ensuring that a sufficient scientific basis exists for the test protocols called for in the standards in each discipline. The ultimate objective of the
OSAC is to maintain a sustainable organizational infrastructure that produces consensus documentary standards and guidelines to improve quality and consistency of work in the forensic science community.
The OSAC will consist of five Scientific Area Committees (SACs) that report to a Forensic
Science Standards Board (FSSB). Each of the five SACs has discipline-specific subcommittees. The five SACs are:
(1) Biology/DNA;
(2) Chemistry/Instrumental Analysis;
(3) Crime Scene/Death Investigation;
(4) Digital/Multimedia; and
(5) Physics/Pattern Interpretation.
A Human Factors Committee, Legal Resource Committee and Quality Infrastructure Committee will provide input to the FSSB, SACs and SAC Subcommittees on standards and guidelines being developed within the OSAC infrastructure and be responsible for specific duties in their resource committee content area.
The Forensic Science Standards Board establishes the governance rules to ensure quality standards and guidelines are developed and to encourage their use in the provision of forensic science services, administers overall operation of the organization, approves all standards for inclusion in the OSAC Registry of Approved Standards, updates and disseminates the list of approved standards and guidelines, resolves disputes and appeals on developed standards and guidelines, and engages in international developments relevant to forensic science quality standards.
The Resource/Support Committees play a critical support role for the entire OSAC by providing their expertise during reviews and development of standards within the OSAC.
The Human Factors Committee will provide guidance on the influence of systems design on human performance and on ways to minimize cognitive, contextual and confirmation bias and mitigate errors in complex tasks.
The Legal Resource Committee reviews and provides a legal perspective on standards within the OSAC.
The Quality Infrastructure Committee provides guidance on quality issues throughout the
OSAC and will interface with standards development organizations and accrediting bodies as needed.
The Scientific Area Committees approve standards and guidelines identified by the subcommittees and provide coordination when standards and guidelines span multiple disciplines. SACs may identify and/or develop standards and guidelines that affect the entire scientific area. The SACs and subcommittees will identify standards, test methods and requirements for lab accreditation appropriate to the scientific area and discipline.
The SACs and subcommittees can identify standards and guidelines developed by other organizations, can catalyze the development of needed standards and guidelines, or may in certain circumstances develop new standards and guidelines themselves. The SAC grants final approval of a guideline.
PAGE 8 OF 59 SB1341-16-RP-0025
Final approval of a standard is granted by the FSSB after approval by the SAC. OSAC-approved standards will make up the OASC Registry of Approved Standards. OSAC-approved guidelines will make up the OSAC Registry of Approved Guidelines. The registries are publicly available and located at the following website:
http://www.nist.gov/forensics/osac/osac-registries.cfm
The ultimate objective of the OSAC is to maintain a sustainable organizational infrastructure that produces consensus documentary standards and guidelines to improve quality and consistency of work in the forensic science community.
II. OBJECTIVE
NIST requires the award of an indefinite delivery/indefinite quantity (IDIQ) contract.
The Contractor shall perform services required for the operation of the OSAC.
III. GENERAL REQUIREMENTS
-All work to be performed under this contract shall be issued via firm fixed price task orders.
-Over the life of the contract, the Contractor shall communicate with the Contracting
Officer’s Representative (COR). The COR may determine that work requires the Contractor to communicate directly with designated member(s) of NIST OSAC Affairs, the OSAC Affairs
Program Manager, and/or other federal staff. The COR shall be made aware of all communication when the COR is not directly involved in a discussion.
Unless the option task has been exercised and the Contractor is required to make travel arrangements for participants under a task order, the Contractor shall not contact committee members nor shall committee members contact the Contractor to perform work or during the performance of work under any task order.
-The Government and the Contractor must be cognizant of the Paperwork Reduction Act. Any task order that requires use of a structured questionnaire, survey, or discussion which presents specific questions to ten or more non-federal employees, may require that the questionnaire, survey instrument or discussion questions be approved or cleared by the
Office of Management and Budget (OMB) prior to use in any form. The Contracting Officer’s
Representative will retain responsibility for obtaining the required OMB approval/ clearance;
-In accordance with the U.S Government Printing Office, Government Printing and Binding
Regulation, the term duplicating/copying as defined in the regulation requires that materials produced by use of an automatic copy process or copy-duplicating machines must
NOT be utilized to produce work exceeding 5,000 production units of any one page and work exceeding 25,000 production units in the aggregate of multiple pages without the prior authority of the Central Printing and Publications Management Organization or the Joint
Committee on Printing. The COR or Task Order Manager (TOM) will retain responsibility for obtaining the required approval.
-The Contractor shall not release any document publicly or to any party, without the prior written approval of the COR. The COR shall be responsible for obtaining any required NIST Public Affairs Clearance necessary for any given document or deliverable prior to public release.
-The Government shall maintain unlimited data rights to all deliverables resulting from this contract, in accordance with data rights clause incorporated in full text into the contract.
-The Contractor shall submit draft and final versions of all required deliverables.
Upon receipt of a draft deliverable, the COR will provide comments within 14 calendar days from receipt of a given deliverable. The Contractor shall make any needed changes to
PAGE 9 OF 59 SB1341-16-RP-0025
the report and deliver a final version not later than 15 calendar days from receipt of electronic or written comments from the COR.
-With respect to meeting planning, in the event an unplanned emergency or weather causes NIST to be unable to hold any of the meetings during the period indicated, NIST shall coordinate with the Contractor to reschedule the meeting or meetings not later than 60 days after notice of reschedule at no charge or penalty to the Government. The
Contractor shall provide alternate dates in the event of hazardous weather, which may be subject to negotiation with the COR.
IV. Option Tasks
Section VII of this statement of work, Tasks, includes the following tasks that are identified as “option” tasks:
-Administrative, Task C
Requires the Contractor to meet Low Level FedRAMP Requirements.
-On-Line and Web Based, Task A
Requires the Contractor to meet Low Level FedRAMP Requirements.
-Meeting Planning, Task B
Requires the Contractor to meet Moderate Level FedRAMP Requirements.
These tasks require the Contractor to handle NIST data and personally identifiable information (PII) that has been determined by the Department of Commerce to have a security risk of low or moderate.
Recent market research and procurement history clearly indicates that meeting low level and moderate level FedRAMP requirements is not currently prevalent in the market place.
Therefore, meeting low level and moderate level FedRAMP requirements is not required to receive an award, however, the Contractor must meet low level and moderate level FedRAMP requirements during the period of performance of the contract.
The Government will formally incorporate these tasks, via modification, upon confirmation by NIST personnel to the Contracting Officer that the Contractor meets low level and moderate level FedRAMP requirements.
Reference the FedRAMP background information below.
V. Meet Low Level FedRAMP Requirements After Award
The Contractor shall, through use of their own resources and at their sole expense, engage a FedRAMP accredited third-party assessment organization (3PAO) to perform an assessment of all components and controls within the system boundary* to meet low level
FedRAMP requirements (unless this has already occurred).
NIST will review the 3PAO assessment results which may result in a need for additional information and clarifications that may be discussed via e-mail, phone, or in person.
NIST will only use the Contractor services to store, process, or transmit data categorized with a FIPS 199 low impact level for confidentiality and integrity (e.g., proprietary and PII) after NIST agrees that the 3PAO assessment results identify an acceptable level of risk and that NIST issues a low level Authority to Operate (ATO).
* The system boundary must include all contractors and sub-contractors that transmit, store, access or can access NIST data. NIST must approve system boundaries.
The Contractor shall not be granted access to data that has been assessed as low riks until the low level authorization has been granted by NIST. Therefore, tasks requiring access to low level data have been included as “option tasks” and shall be performed by the Government until such time as the authorization is granted. If the authorization is
PAGE 10 OF 59 SB1341-16-RP-0025
granted, the Government plans to formally incorporate the option tasks, allowing the
Contractor the opportunity to perform additional work.
If the Contractor, after award, does not engage the 3PAO and/or provide additional information and clarifications that NIST may require to make changes, the Government reserves the right to terminate the contract at no cost to the Government or not exercise a subsequent option period.
The Contractor shall not, at any time request, obtain or handle low risk NIST data associated with work under this contract, unless the low level authorization has been granted by NIST and the contract modified to formally incorporate option tasks.
VI. Meet Moderate Level FedRAMP Requirements After Award
The Government has a requirement for the Contractor to provide travel reimbursement and the ability to access and manage personally identifiable information (PII) that will be transmitted and stored electronically and/or in hard copy for some task orders.
Consequently, the Contractor must, ultimately, be required to meet moderate level FedRAMP requirements. It is noted that this requirement flows down to any subcontractor that will have access to PII as a part of their required responsibilities.
The Contractor shall, through use of their own resources and at their sole expense, engage a FedRAMP accredited third-party assessment organization (3PAO) to perform an assessment of all components and controls within the system boundary* to meet moderate level FedRAMP requirements (unless this has already occurred). NIST will review the 3PAO assessment results which may result in a need for additional information and clarifications that may be discussed via e-mail, phone, or in person.
NIST will only use the Contractor services to store, process, or transmit data categorized with a FIPS 199 moderate impact level for confidentiality and integrity
(e.g., proprietary and PII) after NIST agrees that the 3PAO assessment results identify an acceptable level of risk and that NIST issues a moderate level Authority to Operate
(ATO).
* The system boundary must include all contractors and sub-contractors that transmit, store, access or can access to PII and NIST data. NIST must approve system boundaries.
The Contractor shall not be granted access to PII until the moderate level authorization has been granted by NIST. Therefore, tasks requiring access to PII shall be included as
“option tasks” and performed by the Government until such time as the authorization is granted. If the authorization is granted, the Government plans to formally incorporate the option tasks, allowing the Contractor the opportunity to perform additional work.
If the Contractor, after award, does not engage the 3PAO and/or provide additional information and clarifications that NIST may require to make changes, the Government reserves the right to terminate the contract at no cost to the Government or not exercise a subsequent option period.
The Contractor shall not, at any time request, obtain or handle PII or NIST data associated with work under this contract, unless the moderate level authorization has been granted by NIST and the contract modified to formally incorporate option tasks.
Background Information – FedRAMP
The Federal Information Security Management Act of 2002 (FISMA) is a United States Law that recognized the importance of information security. The Act requires that all federal agencies develop, document and implement an agency-wide program to provide information security for information and information systems that support the operations and assets of the agency, including those provided by or managed by another agency, contractor, or other source. The FISMA requirements are not just for websites, but apply to any vendor, PAGE 11 OF 59 SB1341-16-RP-0025 network, or computing environment that has NIST data in it. FedRAMP was developed to be compliant with FISMA.
The Federal Risk and Authorization Program (FedRAMP) is a risk management program for large outsourced and multi-agency information systems used by the U.S. Government.
FedRAMP authorizes and continuously monitors IT services that are used by multiple federal departments and agencies. This approach uses a “do once, use many times” framework that will save cost, time, and staff required to conduct redundant agency security assessments.
The requirement for FedRAMP approval and/or the Authorization to Operate applies when the
Contractor, and possibly their subcontractors, will have access to NIST data and/o personally identifiable information. This process of assessing the Contractor’s (and subcontractor’s) processes and procedures with respect to the handling and securing of
PII is not limited to electronic data, but also applies to data that is or will be maintained in hard copy as well.
VII. TASKS
1. Kick-Off Meeting Base Contract
Upon award of the base contract, the Contractor shall attend a kick-off meeting, on-site at NIST Gaithersburg not later than 15 business days after award of the contract. The
Contract Specialist (CS), COR and other authorized NIST personnel shall be in attendance.
The kick-off meeting shall be utilized to review roles and responsibilities of all parties involved in the contract, review all contract requirements, and further discuss the IT security review.
Task Orders
The statement of work for individual task orders shall indicate if a kick-off meeting is required for any given task order.
